RESOLUTION NO. 2012-71
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS,
CALIFORNIA,APPROVING THE VACATION OF A PORTION OF AN EXISTING
IRREVOCABLE OFFER OF DEDICATION LOCATED ADJACENT TO 2151
GLASGOW AVENUE.
WHEREAS, Ying Yu Tam Lee, as Successor Trustee, under the declaration of Trust of the
Paul Andrew Lee and Ying Yu Tam Lee dated. May 12, 1988, submitted an application to vacate a
portion of an existing irrevocable offer of dedication adjacent to 2151 Glasgow Avenue, in the City
of Encinitas and
WHEREAS, the vacation proceedings are conducted under Chapter 4 of Part 3 of the State
of California Streets and Highway Code and
WHEREAS, On August 24, 2012, City staff distributed notices to residents within 500 feet
of the proposed vacation and to all public utility companies and
WHEREAS, the City Council of the City of Encinitas on October 10, 2012, heard all
persons interested in the proposed vacation at 6.00 p.m. in the City'bf Encinitas Council Chambers,
505 South Vulcan Avenue,Encinitas, CA 92024
NOW BE IT THEREFORE RESOLVED that the City Council of the City of Encinitas,
has adopted the Resolution vacate an existing irrevocable offer of dedication adjacent to 2151
Glasgow Avenue, in the City of Encinitas per Attachment A in accordance with the following:
1. The IOD vacation as proposed is consistent with California Code of Civil Procedure
Section 771.010.
2 The street vacation as proposed complies with the California Environmental Quality
Act since it is exempt from environmental review pursuant to Section 15061 (B) (3)
of the CEQA Guidelines.
RESERVING AND EXCEPTING from vacation and abandonment all existing private
and public easements other than easements specifically vacated hereon.
PASSED AND ADOPTED this 10`"day of October, 2012, by the following vote,to wit:
AYES. Barth, Bond, Gaspar, Muir, Stocks
NAYS- None.
ABSENT. None.
ABSTAIN- None
