following resolution is adopted :
WHEREAS , on May 23 , 1967 , Minute Item No , 79 , the Board adopted a
resolution declaring its intention to vacate and abandon the following
described County highway in the County of San Diego , State of California ,
pursuant to the request of Anthony P . Mahon , et al :
Portion of E Street as shown on May No . 326 of Colony
Olivenhain filed in the Office of ' the Recorder of the
County of San Diegoe

WHEREAS , the matter came on for hearing before the Board of Supervisors
of San Diego County , California , this 27th day of June , 1967 , at 11 : 00 a . m . ;
and evidence is on file that due and proper notice of said hearing has been
given as required by law ; and
WHEREAS , it appears further that no written protests or objections to
said proposed vacation have been filed , and no oral protests or objections
have been made ; and
WHEREAS , the Planning Commission , in its report filed in the office of
the Clerk of the Board of Supervisors on May 17 , 1967 ( Document No . 387856 ) 5
recommended that said highway be vacated and abandoned providing that the
property owner grants to the County without cost any additional right of way
needed to provide complete 20 foot radius corner roundings at road inter-
sections ; and
WHEREAS , on this date , in Minute Item No . 114 , the Board accepted an
Easement for Road Survey No . 448 , County Road A25- 1 , El Camino Del Norte ,
Olivenhain , Parcel 66463 ; NOW THEREFORE
The Board of Supervisors hereby finds that due and proper notice' of
the hearing on the resolution of intention to vacate said highway has been
given as required by law , and that said highway hereinafter described is
unnecessary for present or prospective public use ,
IT IS THEREFORE RESOLVED AND ORDERED that the hearing be and it is
hereby closed , and that that certain - County highway hereinafter described
be and it is hereby vacated and abandoned :
The easterly 10 feet of E Street ' as shown on Map No . 326
of Colony Olivenhain filed in the Office of the Recorder
of the County of San Diego lying westerly of and adjoining
the westerly line of •Block 52 of said Map No . 326 ,
EXCEPTING THEREFROM that portion thereof lying northwesterly
of a 20- foot radius curve concave southeasterly that is
tangent both to the northerly line of said Block 52 and to

WHEREAS , after investigation the County Planning Commission
has approved and recommended the proposed vacation ( Document No .
.387856 ) ; and
WHEREAS , it appears to this Board that said hereinafter
described highway is not needed for present or prospective use as
a county highway ; NOW THEREFORE
BE IT RESOLVED by the Board of Supervisors of the County of

Colony Olivenhain , Map 326 .
On September 30, 1966 , the Planning Ca®nission considered the reQueat of
Anthony P . Mahon , et sl, that portions of the subject road be vacated and
recamnnended approval with •the provisions that the petitioners grant to the
County without cost 11 feet of additional right of way on the easterly side
of Rancho Santa Fe Road between E1 Camino i�el Norte and Ninth Street , and
any additions) right of way needed to provide 20 foot radius property line
returns at street intersections .
On April 28, 1967 , the Planning Commission reconsidered this matter, re-
scinded its action of September 30, 1.96'(; and
RDCOMMEIVDED:
Vacation of the easterly 10 feet only of "E" Street adjacent to Block 52 ,
Colony Olivenhain , Yip 326 , providing the property o�rner grants to the
Gounty without coat any additional right of Kay needed to provide complete
20 foot radius corner soundings at road intersections .
� DISCUSSION :
Reason for change in recamnendation : Property Demers adjacent to the west -
erly boundary of "E" Street have chosen not to comply with provisions
previously recoaumended by tho Planning Commission .
The road easements required by the Ccmmiasion iu its recommendation of
April 28, 1967 , have been filed with the County Engineer .
A legal description of the reccenmended vacation is attached . _
