Gentlemen :
On May 20 , 1968 ( 101 ) our Board considered Mr . James 0 . Huffman ' s
petition to vacate all of the County ' s interest in an easement
for a portion of " L " Street in Olivenhain . At the hearing the
Planning Department requested that the County not vacate all of the
easement through Mr . Huffman ' s property because a specific plan
for Camino Del Norte Road had not been adopted and it was
anticipated that a portion of the " L " Street easement through
Mr . Huffman ' s property would be necessary .
Mr . Huffman agreed to accept a partial vacation of the easement
as a result of the Planning Department ' s request . Subsequent to
the hearing on May 20 , 1968 , a specific plan for Camino Del Norte
has been filed and it appears that that portion of the " L " Street
easement on Mr . Huffman ' s property in which the County retained
an interest will not be needed .
Mr . Huffman now desires that the County vacate the remaining portion
of the " L " Street easement on his property . It would seem
inequitable at this time to require Mr . Huffman to pay another
filing fee for a road vacation , inasmuch as he agreed to permit
the County to retain the partial easement in the event that it
' was needed .
Therefor , it would be my recommendation that our Board implement
Board of Supervisors Policy I - 22 which would permit Mr . Huffman to
petition for vacation of the remainder of the County ' s interest in
" L " Street , without the requirement of an additional filing fee .

Abandonments I - 30 1 of 1
Purpose
To establish a policy with respect to acquisitions for , or vacations
or abandonments of street widenings or alignment projects of a minor
nature without a report of the Planning Commission .
Background
Section 65402 of the Planning and Zoning Law ( Section 65000 , et seq . ,
Government Code ) provides in substance that where a county has adopted
a general plan or part thereof which is applicable to the establishment,
vacation , or abandonment of streets , no real property shall be acquired
by dedication or otherwise for street purposes , and no street shall be
vacated or abandoned unless the matter shall have been submitted to
and reported on by the County Planning Commission as to conformity with
the general plan or part thereof . Said Section 65402 further provides `
that the foregoing provisions shall not apply to acquisitions , vaca - I
tions or abandonments in conjunction with street widening or alignment
projects of a minor nature if the legislative body so provides by
ordinance or resolution .
Policy
It is the policy of the Board of Supervisors that : A report of the
Planning Commission shall not be required in regard to acquisitions ,
vacations or abandonments in conjunction with street widening or
alignment projects when such acquisitions , vacations or abandonments
are of a minor nature .

Purpose
To establish a policy which identifies the circumstances under which
the Board of Supervisors or Planning Commission will initiate variances
and special use permits .
Background
From time to time the Board of Supervisors and Planning Commission
have been requested to initiate variances and special use permits .
It is apparent that there needs to be some policy guideline to assist
the Board and the Commission in determining when it is appropriate
for the County to initiate these matters .
Policy
It is the policy of the Board of Supervisors that : Variances and
• special use permits will be initiated by the County only in the
following instances :
1 . If the request is made by a non -profit organization and ,
in the opinion of the Board of Supervisors or the Planning
Commission , appears to be in the public interest .
2 . If , after considering a statement supplied by the applicant ,
it is the opinion of the Board of Supervisors or the
Planning Commission that the request is due to a hardship
resulting from some error or negligence on the part of the
County or its employees .

ON MOTION of Supervisor Dent , seconded by Supervisor Cozens , the � ' \
following resolution is adopted :
WHEREAS , on April 15 , 1968 , Minute Item No . 51 , the Board adopted a
resolution declaring its intention to vacate and abandon a portion of " L"
Street between Blocks 88 and 89 of Colony Olivenhain , pursuant to the request
of Alexander J . Nosal and James 0 . Huffman ; and
WHEREAS , the matter came on for hearing before the Board of Supervisors
of San Diego County , California , this 20th day of May , 1968 , at 11 : 00 a . m . ,
and evidence is on file that due and proper notice of said hearing has been
given as required by law ; and
WHEREAS , the Planning Commission , in its report filed in the - office of
the Clerk of the Board of Supervisors on April 4 , 1968 ( Document No . 399253 ) ,
recommended approval of the vacation of the southerly 375 feet only of said
street ; and
WHEREAS , C . E . Swanson , of the Planning Department , orally informs the
Board that the Commission recommended that only the southerly portion of said
street be vacated because of information from the County Engineer indicating
that the northerly portion of said street would be used in a proposed realign -
ment of a County prime arterial road known as Camino Del Norte in connection
with Highway 395 ; and
WHEREAS , James 0 . Huffman appears before the Board and requests
information on why only a portion of said road is to be vacated , but makes
no protest ; and
WHEREAS , it appears further that no written protests or objections to
said proposed vacation have been filed , and no oral protests or objections
have been made ; NOW THEREFORE
The Board of Supervisors hereby finds that due and proper notice of the
hearing on the resolution of intention to vacate said highway has been given
as required by law and that said highway hereinafter described is unnecessary
for present or prospective public use .

of Colony Olivenhain filed in the Office of the
Recorder of the County of San Diego lying between
Block 88 and Block 89 of said Map No . 326 lying

Gibson , the following resolution is adopted ;
WHEREAS , Alexander J . Nosal and James 0 . Huffman

WHEREAS , after investigation the County Planning Commission
has approved and recommended the proposed vacation ( Document No , dln-
399253 ) ; and
WHEREAS , it appears to this Board that said hereinafter
described highway is not needed for present or prospective use as

At its regular meeting of February g , 1968 , the Planning Commission
considered this matter and
RECOMMENDED : The vacation of the southerly 375 feet �only�bf subject

DISCUSSION :
A��L " Street is unimproved , unused and runs between 13th which
has been vacated and Lone Jack Road ( formerly 14th Street ) .
B . Parallel north -south streets on either side have been closed .
C . No property owner will be deprived of access .

mission

of an unused and useless street was filed by myself and A . J . lRosal ,

Since in t he period of time from then until now I have received no
communication whatsoevor concerning tho status or disposition of
this request I fool this inquiry is certainly in order .
I have received no reply from you to guy letter and again ask you
to please inform me of the status or disposition of the petition .

hoar from you by Jan. 5 , 1963 there is little also to be concluded
