AN ALLIEY IN ENCINITAS
• PUBLIC NOTICE IS HEREBY GIVEN that the board of Supervisors
adopted a resolution on November 13 , 1951s declaring its intention
to vacate and abandon the following described County highways
All of the alley in B lock 1 of ;t . L . Durand ' a
Addition , according to the Map thereof No . 206 ,
filed in the Office of the Recorder of San Diego
County ,
The Board has fixed Tuesday , December 18 , 1951s at the hour of
10 . 30 a . m . of said day , and the chamber of said Board , Room 310 San
Diego City and County Administration Building, , Civic Center, San
Diego , California , as the time and place for hearing on said resolu-
tion of intention to vacate and abandon said alley.
YOU ARE 11SHEBY NOTIFIED to appoar at the time and place fixed
for said hearing and show cause , if any you have , why said alley
should not be vacated and abandoned .
For further details , reference is hereby made to said resolution
of intention on file in the office of the Clerk of the Board of
Supervisors , Room 308 San Diego City and County Administration Build-
ing , Civic Center, San Diego , California .

sworn , deposes and says : That he is , and was at all times herein
mentioned , over the age of eighteen years , a citizen of the United
States , and competent to be a witness herein ; that at the request
and instance of the Clerk of the Board of Supervisors of the County
of San Diego , California , he securely and conspicuously posted
notices according to law along the road proposed to be vacated , a
copy of which notice is hereto attached ; that such notices were
posted not less than fourteen days before the date of hearing on
the resolution of intention to vacate and abandon said road , to
wit , the same were posted the day of , 1951 .

On motion of Supervisor Rowell , seconded by Supervisor
Bird , the following resolution is adopted :
WHEREAS , Paul G . Kennard and others have requested the vacation
of an alley in Block 1 of Durand ' s Addition , Encinitas ( Document
C' f ' (,
No . 138006 ) ; and
WHEREAS , after investigation the County Planning Department has
approved and recommended the proposed vacation ( Document No . 1,39271 ) ;
and
WHEREAS , it appears to this Board that the highway recommended for
vacation by said Department is not needed for present or prospective
use as a County highway ; NOW THEREFORE
BE IT RESOLVED by the Board of Supervisors of the County of
San Diego that it is the intention of this Board to vacate and
abandon the following described County highway :
All of the alley in Block 1 of M . L . Durand ' s Addition ,
according to the Map thereof No . 206 , filed in the Office of
the Recorder of San Diego County .
IT IS ORDERED that Tuesday , the 18th day of Decembor
19511 , at the hour of 10 : 30 ofclock a . m . , in the chamber of
said Board , Room 310 San Diego City and County Administration Building ,
Civic Center , San Diego , California , be and they are fixed as the time
and place for a hearing on this Resolution of Intention .
IT IS FURTHER ORDERED that the Clerk of this Board 3ive notice
of the hearing of this resolution and of the time and place fixed
for the hearing by publication of a notice thereof in the Encinitas
Coast Dispatch , a newspaper of general circulation published
in the County of San Diego , for at least two successive weeks prior
to said day fixed for said hearing , and that the Clerk also cause
similar notices to be conspicuously posted along the line of said
highway proposed to be vacated as above described .

Block One of Durand ' s Subdivision , map 206 , Fancinitas .
This request was referred to the Planning Commission for
recommendation , and oil October 23 the Board received a
report from gar . 11,011lerI Director of' Planning , advising
that at its regular meeting of October 11 the Planning
Commission recommended v . cation of said alley for the
following reasons :
)) , 8ubjeet alley is not improved and not required
for access to the rear of any abutting property .
b . Subject alley is not used for any utility lines .
c . The alley within the block immediately to the
south ( Block 1 Clearman ' s Addition ) was vacated
In 1948 , and subject alley has no value by reason
of lack of continuity .

alley which was prepared by the Surveyor- Road Commissioner ,

The Board of Supervisors on September 18 , 1951 , referred to the
Planning Commission the following petition , signed by Paul G .
Kennard , owner of Lot l ; Olive E . and Ada Marie Kennard , owners
of Lots 2 to 10 , inclusive ; and E . G . Thornton , owner of Lots
11 and 12 ; in Block One of Durands Subdivision , Map 2069
Encinitas :
" WHEREAS ; The streets and alleys of Clearman ' s Subdivision ,
Map 207 , Encinitas have been vacated , and
" WHEREAS ; The alley in Block One of Durands Subdivision ,
Map 206 , Encinitas , is now only one block in length and
in unimproved , and
" WHEREAS ; The level of the said alley is considerably
higher that the street grade of Santa Fe Drive at the
intersection , and
"WHEREAS ; The undersigned owners of all the lots in the
said block do declare that the improvement of the said
alley would serve no useful purpose .
"NOW THEREFORE , we the undersigned owners of the lots
set opposite our respective names , same being all the
lots in the said block , do hereby petition your board
to take such action as may be necessary to declare the
