The Planning Commission has forwarded you a copy of their letter
dated May 29, 1956, recommending denial of your request and setting
forth its reasons for such recommendations .

1 . Reference is made to your letter of April 26 , 1956 , concerning
the request of Everett and Harriet Baumgardner for vacation of
a road. easement adjacent to the easterly boundaries of Lots 30 ,
31 , and 32 , and. the southerly boundary of Lot 30 , Avocado Acres
No . 3 , Map No . 2063 ,
2 . At its regular meeting of May 25 , 1956 , the Planning Commission
consid.ered. this matter and recommended that subject request be
denied. .
3 . Reasons for this recommendation include the following :
a . It is the policy of the Planning Commission to recom -
mend. vacation only when it has been clearly demon-
strated. that the road has no present or anticipated.
future use . It cannot be established at this time
that subject vacation meets this one requirement .
b . An abutting property ormer has protested the vacation .

There appears of record a Aoad Easement of 4.0 feet in width 20 feet of
which forms the Easterly part of "Lots 30 , 31 and 32 in Avocado Acres AO .
3 as shown on Hap No . 2063 filed October 3 , 1927 the other 20 feet formed
the Westerly part of acreage now owned I believe by itay Zellers and
John Holly .

Since said Aoad Easement has never been used as a road we desire to have j
it closed .

fWe believe there is also a strip of 20 feet of an old Road Easement which
( has never been used as a road and forms the Southerly pant of the Easterly
225 . 56 feet of lot 30 but which was included for Street purposes/p in the
Map idU . 2063 filed October 3 , 1927 and later Grant Deeded to N . F , j
Baumgardner by the Plator who made the ij:ap referred to however there has
been resently 15 feet of the v+ esterly end of the strip referred to set
aside for road purposes it is desired to have both these it®gd Easements
including the remaining part of 210 . 56 feet of the Ed Fletcher Co . Easement
closed except he 15 feet referred to .

Gentlemen :
This letter refers to a request made to the Board of
Supervisors for the vacation of an easement lying adjacent
to the Easterly boundary of Lot 32 to 30 and lying adjacent
to a portion of the Southerly boundary of Lot 30 in Avacado
Acreas No . 3 , Map 2063 .
The San Diego Gas & Electric Company maintains and
operates electric and gas facilities within those areas to
be vacated ; however, this Company has in its possession
certain easements covering these existing facilities and ,
therefore , does not object to the proposed vacation .
