ON A;OTION of Super- visor Taylor , seconded by Supervisor lledgecock ,
the follo�%iing resolution is adopted :
1pI11EREAS , on August 10 , 1977 , the Board adopted a resolution declaring
its intention to vacate and abandon a portion of Newcastle Avenue bet%seen
Kilkenny Drive and S .-J-i Elijo Avenue , Cardiff area ; and
WHEREAS , the r.:at- ter came on for hearing before the Bcard of Supervisors
of the Country of San Diego , State of Californ4_a , this 21st day of September ,
1977 ; and evidence bcin g on file that clue and proper notice of said hearing
has been given as required by law ; and
IATHE1:Et1S , the Planning Coru-nission in its report filed in the office
of the Clerk of tLe 1�oard of Supervisors on July 27 , 1977 , Board of
Supervisor :; Document ido . 545393 , recommended , with the concurrence of
the Dcpar �I. ent of Lind Use and Environmental Regulation , that said County
Highway be vacated as requested by Yvonne S . Tricbel , et al . ; and
WHEREAS , it appears that no written protests or objections to the
proposed vacation have been filed , and no oral protests or objections
have been made ; NO10 THL•' RUORE ,
The Board of Supervisors hereby finds that due and proper notice
of the hearing on the proposal to vacate said County highway has been
given as required by law , and that- said real property hereinafter des -
cribed is unnecessary for present or prospective public use .
IT IS RESOLVED AND ORDERED that the hearing be and it is hereby
closed ; that a finding be and it is hereby made that , pursuant to
Section 6 . 2 ( b ) of the San Diego County Procedures for Environmental
Impact Review , the vacation is not subject to the environmental review
process ; and that the following described County highway be and the
same is hereby vacated and abandoned :
Parcel 1; o . 76 - 0861 -A
That portion of Newcastle Avenue ( 50 feet wide) in Cardiff , in the County
of San Diego , State of California , according to Map thereof 1� o . 1928 , filed
November 14 , 1910 in the Office of the Recorder of said County lying between
Blocks 3 and 4 of said Map No . 1298 .
EXCEPTING tlierefrom that portion lying northwesterly of a line that is
parallel with and :; 0 . 00 feet Southeasterly of the r_cntcrline of Kilkenny
Drive ( 40 feet wide ) as said Drive is shomi on said Map 14o . 1298 .

ALSO EXCEPTING that portion lying Southeasterly of a line that is parallel
with and 28 . 00 feet Northwesterly of the centerline of San Elijo Avenue (40. 00
feet wide) according to Map thereof Road Survey No . 1132 filed in the Office
of the County Engineer of said County .
RESERVING AND EXCEPTING from vacation and abandonment easements and rights
pursuant to any existing franchise or renewals thereof, or otherwise , at any
time , or from time to time , to construct , maintain , operate , replace , remove ,
renew and enlarge lines of pipe , conduits , cables , wires , poles and other
structures , equipment and fixtures for the operation of gas pipe lines , ,
telegraphic and telephone lines and for the transportation or distribution of
electrical energy and water and for incidental purposes including access to
protect the property from all hazards in , upon , over and across the above
described portions of highways proposed to be vacated and abandoned ; and
RESERVING AND EXCEPTING from vacation and abandonment easements and rights at
any time and from time to time to construct , maintain , operate , replace ,
remove and renew sanitary sewers , storm drains and appurtenant structures
including access to protect the property from all hazards in , upon ,,, over
and across the above described portions of highways proposed to be
vacated and abandoned .
PASSED AND ADOPTED by the Board of Supervisors of the County of
