Fordem the following resolution is adopted:
WHEREAS, Spencer Smith, et al, has requested the vacation of the
hereinafter described portion of a County Street, Highway or Public Service
Easement (Document No. 665222 ); and
NO Re
WHEREAS, Section 8334 of the Streets and Highways Code, provides that the
Board of Supervisors of any County may retain or may summarily vacate any
portion of a County Street, Highway or Public Service Easement which portion is
excess right-of-way and not required for said highway; and
WHEREAS, the County Planning Commission has recommended said portion of
County Street, Highway or Public Service Easement be vacated (Document No. 665222
); and
WHEREAS, it appears to this Board that said portion of County Street,
Highway or Public Service Easement as recommended for vacation by said
Planning Commission is not needed for present or prospective use as a County ,_
Street, Highway or Public Service Easement; NOW THEREFORE
IT IS FOUND, DETERMINED, AND DECLARED that the right of way to be vacated
cannot be used as a non-motorized transportation facility, And that the proposal
is not subject to the environmental impact review process; ACCORDINGLY,

BE IT RESOLVED AND ORDERED that the vacation of the hereinafter described
County Street, Highway or Public Service Easement is consistent with the General
Plan of the County of San Diego; and
BE IT FURTHER RESOLVED that this Board of Supervisors finds that the
hereinafter described portion of County Street, Highway or Public Service
Easement is excess right-of-way and not required for said highway; and
BE IT FURTHER RESOLVED that the hereinafter described portion of County
Street, Highway or Public Service Easement be and is hereby vacated pursuant to

the procedures prescribed by Chapter (commencing with Section ), Part
Division 9 of the Streets and Highways Code:

All that portion of the West Half'of San Diego Avenue and the North Half of
West Seventh Street as shown on COLONY OLIVENHAIN -in the County of San Diego,
State of California, according to Map thereof No. 326, filed in the Office of
the County Recorder of said County July 8, 1885, adjoining the Southerly 3
acres of the Easterly 5 acres of Block 92 of said Map No. 326.
TOGETHER with those portions of the East Half of said San Diego Avenue adjoining ,`
that portion of Lot 27 of the Subdivision of RANCHO LAS ENCINITAS in said County
according to Map thereof No. 848 filed in said Recorder's Office June 27, 1898,
included in that land described in Parcel 2 of deed to SPENCER A. SMITH, recorded
July 24, 1974, in said Recorder's Office as File/Page No. 74-198973 AND included
in that land described in deed to THOMAS J. LINGLE, et ux, recorded'June 13, 1978,;
as File/Page No. 78-243304 in the Office of said County Recorder.
