ON MOTION of Supervisor Hamilton, seconded by Supervisor Moore,
the following resolution is adopted:
WHEREAS, on November 7, 1979, Board Order No. 10, the Board
adopted a resolution declaring its intention to vacate and abandon Alm ,
a portion of Warwick Avenue east of Somerset Avenue, Cardiff area;

{a WHEREAS, the matter came on for hearing before the Board of
Supervisors of the County of San Diego, State of California, this V'
12th day of December, 1979,_ at 9:00 a.m. ; and evidence being on

file that due and proper notice of said hearing has been given as H
required by law; AND
WHEREAS, the Planning Commission, in its report filed in the H
office of the Clerk of the Board of Supervisors on October 25, 1979
(Board of Supervisors Document No. 592835) recommended, with con-
currence of the Department of Planning and Land Use-, that the Board
approve the vacation requested by Paul H. Jones; AND Z
WHEREAS, a representative of the Department of Planning and
t: Land Use addresses the Board, making use of Staff Exhibit 1, a M
series of photographs of aforementioned area, Board of Supervisors
Document No. 595491, and states that the petitioner has previously
a ` vacated the northerly half and is proposing now to vacate a portion
of the southerly half and that the Department of Planning and Land
Use, with the concurrence of the Planning Commission, now recom-
mends that the Board approve said vacation; AND O
WHEREAS, Scott Engleharn addresses the Board and speaks in C
ti opposition to the recommendation because he feels that if the area Zr
to the north is subsequently improved with single family residences,
the street should be available for circulation; NOW THEREFORE
The Board of Supervisors hereby finds that due and proper notice
of the proposal to vacate said highway has been given as required by
law; and that said highway hereinafter described is not useful for C
present or prospective public use.
IT IS RESOLVED AND ORDERED that the hearing be and it is hereby
closed; that the subject right of way is not useful as a non-motorized
transportation facility and that the proposal is not subject to the

environmental review process; AND

BE IT FURTHER RESOLVED that the Board of Supervisors does hereby
vacate and abandon, excepting reservation for protection of existing
