Re Vacation and'.Abandonment of
a Portion of Fifth Street,. Block 41,
Map 148, Encinitas.
ON MOTION of Supervisor Dent; seconded by Supervisor Bonet', the
following resolution is adopted:
WHEREAS, on March 7, 1967, Minute Item•No. $6, the Board. adopted a
resolution declaring its intention to vacate and abandon the following
de.scribed.County highway in the County of, San Diego, State of California,
pursuant to the request of Mrs. Jeanne Geierman:
That portion of Fifth Street as shown on Map No. 14$ 'of Encinitas
filed in the Office pf the Recorder 'of the County of San Diego lying'
northerly of the westerly prolongation of the southerly line of
Lot 14 in Block 41 of said Encinitas and lying southerly of the
center line. of "D" Street, as shown on said Map of Encinitas;
and
WHEREAS, the matter came on for hearing before the Board of Supervisors
of San Diego County, California, this 4th day of April, 1967, at 11:00 a.m.; _
and evidence is on file that due and proper notice of said hearing has been
given as required by law; and
WHEREAS, it appears further that no written 'protests or objections to
said proposed vacation have been. filed, and no oral protests or objections
have been made; and
WHEREAS, the Planning Commission, in its report filed in the office
of the Clerk of the Board of Supervisors on March 1, 1967 (Document No.
384918), recommended that certain portions of said highway be vacated
and abandoned provided the owners of Lots 14 and 15, Block 41, of
r " Encinitas Map No. 148 agree,. in a form satisfactory to the County Counsel,
to loss of street access, said agreements being accepted by the Board on
this date, Minute Item No. 76; NOW THEREFORE
The Board of Supervisors hereby finds that due and proper notice of
the hearing on the resolution of intention to vacate said highway has been
'given as required by law, and that said highway hereinafter described 'is
unnecessary for present or prospective public use. .
IT IS THEREFORE RESOLVED AND ORDERED that the hearing be and it is
hereby closed, and that that certain County highway hereinafter described
be and it is hereby vacated and abandoned:
That portion of Fifth Street as'shown on Map No.- 148 of Encinitas
filed in the Office of the Recorder of the County of San Diego lying
northerly of the westerly prolongation of the southerly line of
Lot 14 in Block '41 of said Encinitas and lying southerly of the
center line of "D" Street, as, shown on said Map of Encinitas,
PASSED, AND ADOPTED by the Board of Supervisors of the County of
San Diego, State of California, this 4th day of April, 1967, by the
following vote:
AYES: Supervisors Boney, Dent, Austin and Cozens
NOES: Supervisors None -
ABSENT: Supervisor Gibson
