Re : Resolution to Abandon a Portion of Twelfth Street ,
Olivenhain , Map 326
Honorable Sirs :
We wish to ask for a denial of the above referenced street
abandonment scheduled for your consideration November 16 ,
1965 .
We are property owners of land affected by this proposed
abandonment . Considering the extreme length of legal de -
scription , our property may be identified by Assessor ' s Par-
cel No . 259 - 190- 13 .
An easement exists from our land to Twelfth Street , The
public right -of -way for Twelfth Street is a highly desirable
and necessary route for access and utilities to the south and
east portions of our land . We estimate our route to public
water and other utilities and to paved public roads would be
increased by 800 feet by the abandonment . Great financial
loss and inconvenience for us and others would result from
the abandonment .

AND ABANDON COUNTY HIGHWAY
On motion of Supervisor Austin , seconded by Supervisor
Cozens , the following resolution is adopted ;
WHEREAS , Dorothy S . Daniels for Floyd Le Burrows
requested the vacation of the hereinafter described county highway
( Document No . 356807 ) ; and
WHEREAS , after investigation the County Planning Commission
has approved and recommended the proposed vacation ( Document No
. 365184 ) ; and
WHEREAS , it appears to this Board that said hereinafter
described highway is not needed for present or prospective use as
a county highway ; NOW THEREFORE
BE IT RESOLVED by the Board of Supervisors of the County of
San Diego that it is the intention of this Board to vacate and
abandon the following described county highway :
That portion of the south half of Twelfth Street as shown
on Map No . 326 of Colony Olivenhain , 'filed in the Office of

Dear Mrs . Daniels :
Reference is made to your letter of February 23 , 1965 , addressed to the
Board of Supervisors, concemLng the request for the vacation of the sou-
therly one-half of 12th Street adjoining Block 72 on the north and the
reduction of the right of way on "R" Street along the east side of Block
72 from the present 80 feet to 60 feet .
At its regular meeting of April 9, 1965 , the Planning Commission considered
this matter and: '
A. Reaomunended approval of the vacation of the portion of 12th Street
provided petitioner grants to the County without cost sufficient
right of way along Rancho Santa Fe Road to provide 51 feet easterly
of the centerline .
B. Recommended denial of the requested vacation of portions of "$"
Street .
The Planning Commission directed the staff to withhold transmittal of this
recommendation to the Board of Supervisors until the Surveyor-Road Commis -
sioner notifies the Planning Department by letter that the necessary ease -
ments have been offered to the County by you.
The Right of Way Agent in the office of the Surveyor-Road Commissioner will
prepare and forward to you the necessary documents which shall be duly signed
and returned by you. Said easements will be accepted and recorded only if
and when the Board. of Supervisors adopts a resolution vacating the above des -
cribed streets .
The Commission also directed that you be informed that a recommendation of
denial will be forwarded to the Board of Supervisors , if after one year
said condition has not been complied with unless , prior to the expiration
of one years

ON MOTION of Supervisor Cozens , seconded by Supervisor Dent , the following
resolution is adopted by the Board of Supervisors of the County of San Diego , State
of California :
WHEREAS , oat October 13 , 1965 , the Board adopted a resolution declaring its
intention to vacate and abandon the following described county highway in the County
of San Diego , State of California :
That portion of the south half of Twelfth Street as shoom on Hap No . 326
of Colony Olivenhain , filed in the Office of the Recorder of the County
of San Die,3o , lying easterly of the northerly prolongation of the center
line of "D " Street as said Street is shown on ?lap No . 326 , and lying
westerly oR the northerly prolongation of the east line of Block 72 of
said Colony Olivenhain;
and
WHEREAS , the sitter came on for hearing before the Board of Supervisors of
San Diego County , California , this 16th day of November , 1965 , at: 11 : 00 a .m . , and
evidence is on file that dus and proper notice of said hearing has been given as
required by law ; and
WHEREAS , it appears further that two written protests to the proposed vacation
have been filed and considered; and no oral protests or objections have been made ; and
WHEREAS , the Planning Commissioas , is its report filed in the office of the Clerk
of the Board of Supervisors on October $ , 1965 (Document No . 366791) , recommended that
said highway be vacated and abandoned ; 0Y.4 THEPWORE
The Board of Supervisors hereby finds that due and proper notice of the hearing
on the resolution of intention to vacate said highway has been given as required by
law , and that said highway hereinafter described is unnecessary for present or
prospective public use .
