Re Vacation and Abandonment of a
Portion of Fourth Street in Encinitas ;
ON MOTION of Supervisor Dent, seconded by Supervisor Cozens, the
I following resolution is adopted by the Board of Supervisors of the County
of San Diego, State of California:
WHEREAS, on June 13, 1961, the Board adopted a resolution declaring
#+ its intention to vacate and abandon the following described county highway
}' in the County of San Diego, State of California:
That portion of Fourth Street as shown on Map 148 of
Encinitas filed in the Office of the County Recorder of
San Diego County, lying southerly of the westerly prolongation
of the north line of Block 34 of said subdivision and northerlyy
of the westerly prolongation of the south line of said Block .
and
WHEREAS, hearing on said matter was held on July 18, 1961, Minute
Item No. 58 and

WHEREAS, it' appeared from the Affidavit of Publication and the Affidavit
of Posting on file in said proceedings that due and proper notice of said
hearing was given as required by law; and
WHEREAS, the Planning Commission in its report filed in the office of
the Clerk of the Board of Supervisors on May 16, 1961 (Board of Supervisors'
Document No. 302045) recommended that said request for vacation be denied;
but at said hearing the Director of Planning orally indicated that if the
necessary easements would be granted to the County to widen from 20 feet
to 40 feet the alley in Block 34 of Encinitas, that would appear to be a
r reasonable solution; and r

s WHEREAS, there were no other written or oral protests to said requested
i
vacation; and
WHEREAS, said hearing was closed and the Board ordered that said portion 4
of Fourth Street be vacated after the County has received the necessary
easement or easements *td*'increase-from -20'feet-to 40 feet the width of said _ y
alley; and
WHEREAS, in Minute Item Nos. 215 and 216 on this date, the Board
I accepted an Easement and a Subordination Agreement granting the necessary
right of way to increase from 20 feet to 40 feet the width of the alley in
Block 34 of Encinitas; NOW THEREFORE

The Board of Supervisors hereby finds that due and proper notice of the
hearing on the resolution of intention to vacate said highway has been given
as required by law, and that said highway hereinafter described is
I unnecessary for present or prospective public use.
IT IS THEREFORE RESOLVED AND ORDERED that that certain County highway

hereinafter described be and it is hereby vacated and abandoned:
E That portion of Fourth Street as shown on Map 148 of
Encinitas filed in the Office of the County Recorder of
San Diego County, lying southerly of the westerly prolongation
�Y of the north line of Block 34 of said subdivision and northerly
