J' ADDENDUM TO HISTORIC PROPERTY PRESERVATION AGREEMENT
THIS AGREEMENT is made and entered into by and between the CITY OF ENCINITAS, a
municipal corporation ("CITY"), and '`e'04 C V11� tiG 4z_ , Owner(s),
("OWNER(S)"herein after)of the real property located in the City of Encinitas commonly known as 221
Sunset Drive, Assessor's Parcel Number 256-411-61.d"PROPERTY", herein after):
Recitals
WHEREAS, California Government Code Section 50280, et seq. Authorizes cities to enter into
contracts with the owner(s)of qualified historical property to provide for the use, maintenance and
restoration of such historical property so as to retain its characteristics as a property of historical
significance.
WHEREAS, On December 14, 2005, the City Council of the City of Encinitas adopted
Resolution 2005-61 thereby declaring and designating the above PROPERTY as a Historical Property
pursuant to the terms and provisions of Resolution 2003-68, Administration of the Mills Act Contracts;
and
WHEREAS, the Historic Property Preservation Agreement entered into with the previous
owner(s), recorded by the County Recorder s Office as Document No. 2005-1105542 on December 27
2005, which is binding upon successors or assigns in title or interest; and
WHEREAS, Resolution No. 2011-59 adopted December 14, 2011, excludes any new additions or
structures completed on the property from Mills Act valuations; and
WHEREAS, CITY and OWNER(S) desire to amend the existing Historic Property Preservation
Agreement to exclude any new additions or structures completed on the property from Mills Act
valuations.
NOW THEREFORE, CITY and OWNER(S) agree:
1 Any new addition or structure completed on the PROPERTY shall be excluded from the
Mills Act valuations.
2. All other portions of the existing Historic Property Preservation Agreement, recorded by the
County Recorder's Office as Document No. 2005-1105542 on December 27,2005 shall
remain in full force and effect.
