Map thereof No. 848, filed in the office of the Recorder of San Diego County
June 27, 1898, and that portion of Block 95 in the Colony of Olivenhain, according
to Map thereof No. 326, filed in the office of the Recorder of San Diego, July 8,
1885, all being in the County of San Diego, State of California, all described as
a whole as follows:
COMMENCING at the intersection of the center line of "C" Street and the center line
of Ninth Street in Colony of Livenhain as said intersection is shown on Record of
Survey Map No. 4901, filed in the office of the County Recorder of San Diego County;
thence along the prolongation of said center line of Ninth Street, North 73009'West
765.00 feet; thence North 15°06110"East 400.00 feet to the True Point of Beginning;
thence continuing North 15°06110"East 405.23 feet to an intersection with the
Westerly prolongation of the center line of Tenth Street in Colony of Olivenhain;
thence along said prolongation line South 73°21110"East 420.00 feet more or less
to an intersection with the Southerly prolongation of the Easterly line of "B"
Street in Colony of Olivenhain; thence South 15°06121"West 40.00 feet to the
Southerly line of said Tenth Street; thence along the Westerly prolongation of
said Southerly line North 73 021110"West 97.50 feet; thence South 15 006121"West
365.23 feet to an intersection with a line that bears South 73°09'East from the
True Point of Beginning; thence North 73°09'West 325.00 feet to the True Point of
Beginning.

The Grantor hereby further grants to the County of San Diego the privilege and right to extend drainage structures and
excavation and embankment slopes beyond the limits of the herein described right of way where required for the con-
struction and maintenance of said County Highway. RESERVING unto grantor of the above described parcel of land,
his successors or assigns,the right to eliminate such slopes and/or drainage structures or portions thereof, when in the
written opinion of the County and/or District Engineer of Grantee, the necessity therefor is removed by substituting
other protection, support and/or drainage facility, provided such substitution is first approved in writing by said
Engineer(s). -
The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter grow), and road
building materials within said right of way, including the right to take water, together with the right to use the same
in such manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction,
reconstruction, improvement or maintenance of said highway.
The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all damages to Grantor's
remaining property contiguous to the right of way hereby conveyed by reason of the location, construction, landscap-
ing or maintenance of said highway.
(As used above,the term"grantor'shall include the plural as well as the singular number and the words"himself'and"his"shall
include the feminine gender as the case may be.)
