EASEMENT GRANT DEED
The Encinitas Ranch Community Association ("Grantor") hereby grants to Jaeson Ga11i
("Grantee"),a married man as his sole and separate property , and his successors and assigns, the
following real property in the city of Encinitas,county of San Diego, state of California:
AN EASEMENT FOR SEWER LATERAL PURPOSES, DESCRIBED IN EXHIBIT "A" AND
SHOWN IN EXHIBIT`B", BOTH ATTACHED AND MADE A PART HEREOF.
This Grant of Easement is made under the following conditions:
1. The easement is subject to the Declaration of Covenants, Conditions and Restrictions of
Encinitas Ranch (the "Declaration") recorded on February 26, 1999 in the San Diego
County Recorder's Office as document number 1999-0121953.
2. Grantee to indemnify and hold the Grantor harmless from all claims of injury and
damages to the Grantor or third parties caused by installation, operation, maintenance, or
removal of the sewer lateral.
3. Should any dispute arise out of this Easement Grant Deed, the dispute will be submitted for
binding arbitration. The Grantor and Grantee expressly waive their rights to a jury trial for
any such dispute.
4. Should any dispute arise from this Easement Grant Deed, the prevailing party in such
dispute will be entitled to recover its attorneys' fees in enforcing its rights hereunder,
whether through arbitration o'r' n
litigation.
