ON MOTION of Supervisor Walsh, seconded by Supervisor Boney, the
following resolution is adopted:

WHEREAS, on March 24, 1969, Minute Item No. 94, the Board approved
a bond for improvement of streets, Curb and Gutter Plan No. CG171; and
approved and authorized execution of an agreement with Atlantic Richfield
Company guaranteeing construction of streets in compliance with street
vacation conditions and Special Use Permit P68 -82 for freeway service
facility; and I t
WHEREAS, on March 24, 1969, Minute Item No. 95, the Board adopted a
resolution declaring its intention to vacate and abandon that portion of
Windsor Road which lies easterly of a line which is 30 feet east of a
centerline of Windsor Road which has a 200 -foot radius, and which inter-
sects Birmingham drive at an angle of 70 degrees exclusive of a normally
required corner rounding, Cardiff, pursuant to the request of William M.
Ferguson; and
WHEREAS, the Planning Commission in its report filed in the office
of the Clerk of the Board of Supervisors on March 12, 1969 (Document No.
411866), recommended that said portions of the highways be vacated and
abandoned, subject to certain conditions, which conditions have been met;
and
WHEREAS, the matter came up for hearing before the Board of Super-
visors of San Diego County, California, this 29th day of April, 1969, at
9:30 a.m., and evidence is on file that due and proper notice of said
hearing has.been given as required by law; and
WHEREAS, it appears further that no written protests or objections
to said proposed vacation have been filed, and no oral protests or
.objections have been made; NOW THEREFORE
The Board of.Supervisors hereby finds that due and proper notice of
the hearing on the resolution of intention to vacate said portions of
highways has been given as required by law, and that said portions of
highways hereinafter described are unnecessary for present or prospective
public use.
IT IS THEREFORE RESOLVED AND ORDERED that the hearing be and it is
hereby closed, and that certain portions of County highways hereinafter
described be and they are hereby vacated and abandoned:
