RE: MOONLIGHT BEACH SCHEMATIC DESIGN — CHANGE ORDER #4 (STORM WATER
ENGINEERING MODIFICATIONS)
Dear Ms. Rudloff:
This letter, when signed below and returned to me, will serve as Change Order #4 to the contract dated
March 30, 2009, between the City of Encinitas and Stephen Dalton Architects, Inc. This change order is
to cover the additional services required as a result of the Engineering Department's March 26, 2012
directive to redesign the storm drainage system. A brief history of this issue includes:
1. Conveying storm water from C Street to B Street has been a stated goal since the project's
inception.
2. The storm water system had been reviewed and accepted by Engineering, including two
separate SAC meeting reviews and prior to the Planning Commission approval.
3. Our consulting engineer had suggested an alternate design that would have diverted storm
water away from the B Street channel, but was directed by the City to continue with the original
design.
4. Comments from the Citys environmental reviewer were made only after the consulting engineer
had already completed the design, calculations and drawings for the original design.
The additional services covered by this change order include:
1. The consulting engineer's time to design an alternate storm water system, re-
calculate and update the hydrology report, coordinate with the Engineering
Department, and drafting modifications to previously completed construction
documents.
Compensation for the work specked in this change order shall be a Fixed Fee of $4.000. Please note
that the consulting engineer has offered to do this work "at cost" and the fixed fee above represents a
discount of approximately $3,000.
Please indicate your acceptance of this change order by signing where indicated below, and returning
the original to my attention. This change order does not change the terms and conditions of the original
