WHEREAS, on September 7, 1977, Board Order No. 15, the Board adopted n
a resolution of intention to vacate and abandon that portion o O
Avenue southeast of Kilkenny Drive in the Cardiff area, pursuant to oxford the

WHEREAS, the matter came on for hearing before the Board of Super-
visors of San Diego County, California, this 12th day of October, 1977, N
at 2:00 p.m. ; and evidence being on file that due and proper notice of D
said hearing has been given as required by law; and Z
WHEREAS, the Planning Commission, in its report filed in the office 0
of the Clerk of the Board of Supervisors on August 23, 1977 (Document No.
546196) , recommended, with the concurrence of the Department of Land Use m
and Environmental Regulation (LUER) , that said portion of Oxford Avenue 0
be vacated as requested, and also that a finding be made pursuant to V
Section 6.2(b) of San Diego Procedures for Environmental he environmental review O
that the requested vacation is not subject n
process, since it has been determined with certainty that this type of 0
project will not have a significant effect on the environment; and C
WHEREAS, it appears that no written protests or objections to the Z
proposed vacation have been filed, and no oral protests or objections
have been made; NOW THEREFORE, -<
The Board of Supervisors hereby finds that due and proper notice of
the hearing on the proposal to vacate said County highway has been given _
as required by law, and that said real property hereinafter described is D
unnecessary for present or prospective public use. M

IT IS RESOLVED AND ORDERED that the hearing be and it is hereby Piz
closed; that a finding be and it is hereby made that, pursuant to Section
6.2(b) of the San Diego County Procedures for Environmental Impact Review,
the vacation is not subject to the environmental review process; and that

Office of the County Recorder of said County on November 14, 1910, said portion r
of Oxford Avenue lying Southeasterly*of the Southeasterly right-of-way line of
KILKENNY DRIVE (40.00 feet wide) according to said Map No. 1298.
M RESERVING AND EXCEPTING from vacation and abandonment easements and rights n
pursuant to any existing franchise or renewals thereof, or otherwise, at any time,
or from time to time, to construct, maintain, operate, replace, remove, renew O
and enlarge lines of pipe, conduits, cables, wires, poles and other structures,
equipment and fixtures for the operation of gas pipe line, telegraphic and
telephone lines and for the transportation or distribution of electrical energy v
and water and for incidental purposes including access to protect the property L/1
from all hazards in, upon, over and across the above described portions of
highways proposed to be vacated and abandoned; and
RESERVING AND EXCEPTING from vacation and abandonment easements and rights at any
time and from time to time to construct, maintain, operate, replace, remove and Z
renew sanitary sewers, storm drains and appurtenant structures including access v
to protect the property from all hazards in, upon, over and across the above
described portions of highways proposed to be vacated and abandoned. m
