ON MOTION of Supervisor Taylor, seconded by Supervisor Walsh, the fol-
lowing resolution is adopted:
I
WHEREAS, on March 5, 1974, Board Order No. 19, the Board adopted a
resolution of intention to vacate and abandon a portion of Seventh Street,
"E" Street, and Alleys, in Blocks 31 and 36, Olivenhain area, pursuant to
the petition of Beverly and Marlyn Jakub, et al, (Vac. 73-51) setting the
hearing therefor on April 10, 1974, at 2:00 p.m. ; and
WHEREAS, the matter came on for hearing before the Board of Super-
visors of San Diego County, California, this 10th day of April, 1974, at
2:00 p.m. ; and evidence is on file that due and proper notice of said hear-
ing has been given as required by law; and
WHEREAS, the Planning Commission, in its report filed in the office
of the Clerk of the Board of Supervisors on February 14, 1974 (Document No.
484135), and in concurrence with the Planning Department, recommended that
said portion of Seventh Street, "E" Street, and Alleys, in Blocks 31 and 36,
Olivenhein area, be vacated, as requested, and also made a finding in
accordance with Section 65402 of the Government Code that the proposed vaca-
tion conforms to the San Diego County General Plan 1990 with respect to lo-
cation, purpose and intent; and
WHEREAS, it appears that no written protests or objections to said pro-
posed vacation have been filed, and no oral protests or objections have been
made; NOW THEREFORE
The Board of Supervisors hereby finds that due and proper notice of the
hearing on the resolution of intention to vacate said portion of said road
has been given as required by law, and that said portion of said road here-
inafter described is unnecessary for present or prospective use as a County
highway.
IT IS THEREFORE RESOLVED AND ORDERED that the hearing be and it is
hereby closed, that said vacation is not subject to the environmental re-
view process, inasmuch as it has been determined with certainty that this
type of project will not have a significant effect on the environment, and
that that certain portion of said road, hereinafter described, be and it
is hereby vacated and abandoned:

pursuant to any existing franchise or renewals thereof, or othen.ise, at any time,
or from time to time, to cons-truct, maintain, operatc, replace, remove, renew
and enlarge lines of pipe, conduits, cables, uir.os, poles and other structures,
equipment and fixtures for the operation of 4as pipe lines, telegraphic and telephone
lines and for the transportation or distribution of electrical energy and water
and for incidental purposes including access to protect the property from all
hazards in, upon, over and across the above described portions of highways proposed
to be vacated and abandoned; and
RESERVING AND EXCEPTING from vacation and abandonment easements and rights
at any time and from time to time to construct, maintain, operate, replace, remove
and renew sanitary sewers, storm drains and appurtenant structures including access
to protect the property from all Hazards in, upon, over and across the above
described •portions of highways proposed to be vacated and abandoned.
