ON MOTION of Supervisor Hamilton , seconded by Supervisor Taylor,
the following resolution.is adopted:

WHEREAS, on July 11, 1978, the Board adopted a resolution declar-
ing its intention to vacate and abandon portion of Kilkenny-Drive, east M
of Oxford Avenue, Cardiff area, Vac. 78-07, and n
WHEREAS, the matter came on for hearing before the Board of Supervisors 0
of the County of San Diego, State of California, this 16th day of August M
1978, at 10:00 a.m. ; and evidence being on file that due and proper notice 0
of said hearing has been given as required by law; and N
WHEREAS, it appears further that no written protests or objections y
to said proposed vacation have been filed, and no oral protests or ob- D
jections have been made; and Z
WHEREAS, the Planning Commission, in its report filed in the office
of the Clerk of the Board of Supervisors on June 27, 1978, (Board of
Supervisors Document No. 566162) recommended, with the concurrence of T
the Department of LUER, that said portion of Kilkenny Drive be vacated
as requested by Leonard E. Teyssier; NOW THEREFORE O
The Board•of Supervisors hereby finds that due and proper notice of (�
the hearing on the proposal to vacate said•highway has been given as O
required by law, and that said highway hereinafter described is unneces-
sary for present or prospective public use. C

IT IS RESOLVED AND ORDERED that the hearing be and it is hereby —�
closed; that a finding that the requested vacation is not subject to –�
the environmental review process be and it is hereby made; that a find-
ing pursuant to the Street and Highways Code that subject right-of-way _
cannot be used as non-motorized transportation facility be and it is
hereby made; and that the following described County highway be and it
is hereby vacated and abandoned: r
