A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS,
CALIFORNIA, APPROVING THE SUMMARY VACATION OF A PORTION OF THE
EXISTING EASEMENT FOR PUBLIC SEWER AND STORMWATER PURPOSES ON
OXFORD AVENUE.
WHEREAS, Frederick Parks made an application to vacate a portion
of existing easement for public stormwater and sewer purposes on a
closed portion of Oxford Avenue as shown on Record of Survey No.
11793 , recorded September 15, 1988; and
WHEREAS, the vacation proceedings are conducted under Chapter 4 of
Part 3 of the State of California Streets and Highway Code, and
WHEREAS, On April 29, 2004 , city staff distributed notices to
residents within 300 feet of the proposed vacation and to all
public utility companies, and city staff received one inquiry from
an affected resident requesting further information on the
proposed vacation.
WHEREAS, the City Council of the City. of Encinitas on August 18,
2004 , heard all persons interested in the proposed vacation at
6 :30 p.m. in the City , of Encinitas Council Chambers, 505 South
Vulcan Avenue, Encinitas, CA 92024 ; and
NOW BE IT THEREFORE RESOLVED that the City Council of the City of
Encinitas, approves summary vacation of a portion of existing
easement for public stormwater and sewer purposes on Oxford Avenue
as shown of Record of Survey No. XXXX, as shown in Exhibit `A' and
in accordance with the following:
