A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ENCINITAS
ACCEPTING A PREVIOUSLY REJECTED
IRREVOCABLE OFFERS OF DEDICATION OVER
FORTUNA RANCH ROAD
WHEREAS, on May 13, 1974 and on November 20, 1972, the County
of San Diego rejected two Irrevocable Offers of Dedication over
Fortuna Ranch Road for use as a public street;
WHEREAS, section 66463 of the Government Code of the State
of California provides that a rejected Offer of Dedication shall
remain open and subject to future acceptance by the City (who is a
successor-in-interest to the County of San Diego);
WHEREAS, on December 5, 1989, the Olivenhain Community
Advisory Board conditionally approved Tentative Parcel Map No. 89-
087 and required the developer to construct that portion of Fortuna
Ranch Road adjoining the Tentative Parcel Map;
WHEREAS, the developer has requested that the City Council
accept the previously rejected Irrevocable Offer of Dedication as
recorded May 13, 1974 as File/Page No. 74-123852 and a portion of
the Irrevocable Offer of Dedication recorded November 20, 1972 as
File/Page No. 310620 in order to construct the required public

street improvements;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Encinitas accepts the previously rejected Irrevocable Offer
of Dedication as recorded May 13, 1974 as File/Page No. 74-123852
and a portion of the Irrevocable Offer of Dedication recorded
November 20, 1972 as File/Page No. 310620 in the Office of the
County Recorder of San Diego County for use as a public street (See
Exhibit "A" and "B").
PASSED AND ADOPTED this 9th day of December, 1992, by the
following vote, to wit:
AYES: Bond, Davis, DuVivier, Wiegand
NAYS: None
ABSENT: Hano
