WITNESSETH: That in consideration of the mutual covenants and agreements to be kept and performed on the part of said parties hereto, respectively as herein stated: I. Said party of the first part covenants and agrees that It shall: The Sharmas will construct a sewer line connection for the APN 265-022-20 where Olivenhain Meetinn Hall Is located. Please see EXHIBR A- Plan for Construction of 4" PVC Sewer lateral on APN 265-022-22.00 The Sharmas'agree to pay all cost related to the construction of this orolect. 11. And said party of the second part covenants and agrees that it shall: The Olivenhaln Town Coundl will grant The Sharmas the permission to use the easement located on APN 265-022-20. Please see EXHIBIT B-Sewer Easement Legal Description. III. Other terms to be observed by and between the parties: a. The Sharmas will bear the cost of construction and clean up after the construction of the sewer line along with any other incidental cost which may arise during completion of this project. b. The Sharmas will property dispose of septic tank,and fill in,and restore the land to its original status. c. Maintenance of easement will be the sole responsibility of the Sharmas. d. The easement, as granted Is to be used exclusively for the purpose of the sewer line as described within this agreement. e. No improvements will be made to easement,without specific vote and written permission of the Olivenhain Town Council. f. Any damage made during or resulting from the construction of the Sharmas sewer line to any property in the surrounding neighborhood or the Town Council oropertt.the Sharmas agree to hold the 011venhain Town Council it's members and Board members harmless and will be Indemnify them against any harm or damages done in said construction. g. The permission to use the easement alone with the relevant terms of this aXreememt shall be Incorporated into the Sharmas'grant deed for the purpose of construction and maintenance. This agreement shall be binding upon the parties,their successors,assigns and personal representatives.Time is of the essence on all undertakings.This agreement shall be enforced under the laws of the state of California.
