Description /Justification: Proposed by resolution of the Encinitas City Council is the dissolution
of Geologic Hazard Abatement District (GRAD) No. 1 (Neptune Street). The GHAD was formed by
the City of Encinitas in 1994 to protect property from coastal bluff erosion, landslides, failures, and
other geologic hazards. The District includes property along Neptune Avenue within the City of
Encinitas. At the time the GHAD was formed, it was intended that the District be financially
independent from the City of Encinitas and establish an assessment district to finance
administrative costs and bluff maintenance programs. The City has lent the District $94,000 for
start-up legal services, operation expenses, assessment district feasibility study and insurance.
The City indicates that, following formation of the GHAD, there was little support for the formation
of an assessment district and individual property owners privately financed construction of the
necessary bluff protection devices (sea walls) to protect their property. The GHAD is now
considered inactive by the City because: (1) property protection has been accomplished, (2) an
acceptable financing mechanism to sustain the GHAD and its activities has not been established,
and (3) no other funding source, including City support, has been approved. Since the District was
formed by the City of Encinitas and not through a LAFCO action, a sphere of influence has not been
adopted for the District. A zero sphere of influence will have to be adopted for the District if the
dissolution of the District is approved. The Board of Directors of the GHAD has adopted a
resolution unanimously consenting to the dissolution of the District.
General Plan /Zoning: The affected territory is within the General Plan area of the City of Encinitas
and is zoned for single - family residential and open -space uses.
Location: West side of Neptune Street within the City of Encinitas north of Sylvia Street and south
of Grandview Street (Thos. Bros. pg. 1147/A3,A4,A5,B5,B6).

OF THE COUNTY OF SAN DIEGO
ADOPTING A ZERO SPHERE OF INFLUENCE FOR THE
GEOLOGIC HAZARD ABATEMENT DISTRICT NO. 1 (NEPTUNE AVENUE)
AND
MAKING DETERMINATIONS AND APPROVING THE
"DISSOLUTION OF GEOLOGIC HAZARD ABATEMENT DISTRICT NO. 1
(NEPTUNE AVENUE)"
On motion of Commissioner Horn, seconded by Commissioner Howard, the
following resolution is adopted.
WHEREAS, pursuant to Government Code Section 56425, the San Diego Local
Agency Formation Commission is required to develop and determine a sphere of influence
for each local governmental agency within the County; and
WHEREAS, an application has been made to adopt a sphere of influence for the
Geologic Hazard Abatement District No. 1 (Neptune Avenue); and
WHEREAS, a resolution of application was submitted to this Commission for
dissolution of the Geologic Hazard Abatement District No. 1 (Neptune Avenue), which
resolution was adopted by the City Council of Encinitas as Resolution No 96 -71, dated
August 28, 1996, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code, and
WHEREAS, the territory proposed for adoption of a zero sphere of influence and
dissolution is as described in the application on file with the Local Agency Formation
Commission, and
WHEREAS, the Executive Officer of the Commission has filed his report on said
adoption of a zero sphere of influence and district dissolution, which report was received
and considered by the Commission; and
WHEREAS, pursuant to Government Code Sections 56427 and 56828, the
Executive Officer of this Commission set a public hearing on the proposed adoption of a
zero sphere of influence and district dissolution for December 2, 1996, and gave notice of
the date, time, and place of said hearing in accordance with Government Code Sections
56834 and 56835, and
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The hearing was held on the date set therefore, and due notice of said
hearing was given in the manner required by law
(2) At that hearing the Commission called for, heard, and considered all
interested parties and read and considered the report of the Executive Officer
(3) In accordance with Government Code Section 57002, the Commission
hereby declares that this action requires a noticed public hearing by the conducting
authority.
(4) The Commission certifies that the determination by the City of Encinitas that
adoption of a zero sphere of influence and the district dissolution are exempted by State
CEQA Guidelines Section 15061(b)(3) from the requirements of CEQA has been reviewed
and considered
(5) The Commission has considered the factors enumerated in Section 56425
prior to adopting the zero sphere of influence for the Geologic Hazard Abatement District
No. 1 (Neptune Avenue)
(6) The Commission hereby determines that a zero sphere of influence shall be
adopted for the Geologic Hazard Abatement District No 1 (Neptune Avenue), and adopts
the Statement of Determinations as provided in Exhibit C pursuant to Section 56425 of the
Government Code.
(7) The Commission hereby approves the dissolution with boundaries as
described in Exhibit A attached hereto, subject to the conditions as stated in Exhibit B.
(8) The boundaries of the territory as described in Exhibit A are definite and
certain.
(9) The boundaries of the territory do conform to lines of assessment and
ownership
(10) The district is a property -owner district.
(11) The territory is inhabited.
(12) The territory proposed for district dissolution is hereby designated the
"Dissolution of Geologic Hazard Abatement District No. 1 (Neptune Avenue) "
(13) The Commission hereby designates the County of San Diego as the
conducting authority and authorizes the Board of Supervisors to conduct proceedings in
compliance with this resolution without an election.
(14) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code

Approved Terms and Conditions
1 Effective date of dissolution shall be the date of recordation with the County
Recorder (Government Code Section 56844[p])
2 As of the effective date of dissolution, Geologic Hazard Abatement District No 1
(Neptune Avenue) shall be dissolved, terminated, disincorporated and extinguished
and all its corporate powers shall cease (Government Code Section 56844[v])
3 The City of Encinitas shall be designated as the successor to the Geologic Hazard
Abatement District for the purpose of succeeding to all the rights, duties and
obligations of the District with respect to the enforcement, performance or payment
of any contracts and obligations of the District (Government Code 56844[m])
4. All property, whether real or personal, including all moneys (including cash on hand
and moneys due but uncollected) of the dissolved District shall be transferred to and
vested in the City of Encinitas (Government Code Section 56844[h & 1])
5 Payment of any fees or charges necessary to cover expenses of the proposed
dissolution shall be paid by the District. Such fees or charges, if any, may include,
but are not limited to, processing fees charged by the Local Agency Formation
Commission and processing fees charged by the State Board of Equalization
(Government Code Section 56844[v])

The following statement of determinations is prepared pursuant to Section 56425 of the
Government Code for designation of a zero sphere of influence for the Geologic Hazard
Abatement District No 1 (Neptune Avenue)
(1) The present and planned land uses in the area including agricultural and
open space lands
The District includes 50 residences on the west side of Neptune Avenue in the City of
Encinitas Land uses within the District are regulated by the City of Encinitas and there are
no plans to change existing land uses
(2) The present and probable need for public facilities and services in the area

which the agency provides or is authorized to provide
The District is not currently providing any services LAFCO's adopted sphere guidelines
indicate that a zero sphere should be designated for an agency when the provision of its

ON MOTION of Supervisor ibberts Seconded by Supervisor Cox
the following Resolution is adopted:
WHEREAS, the City of Encinitas adopted its Resolution of Application for
Dissolution of Geologic Hazard Abatement District No. 1 (Neptune Avenue) on
August 28, 1996, and subsequently thereto filed certified copies of said
Resolution with the Local Agency Formation Commission; and
WHEREAS, the Board of Supervisors found, as provided in Government Code
Section 57083, that the Board of Directors of the Encinitas Geologic Hazard
Abatement District No. 1 (Neptune Avenue) has, by unanimous resolution,
consented to the dissolution of the District; and
WHEREAS, on December 2, 1996 (5), the Local Agency Formation Commission
of San Diego County adopted its Resolution Approving the Dissolution of
Geologic Hazard Abatement District No. 1 (Neptune Avenue) subject to the terms
and conditions stated therein, and authorized the Board of Supervisors to
initiate and conduct proceedings for the dissolution of said District in
compliance with the Commission's Resolution; and
WHEREAS, the Clerk of the Board of Supervisors set March 11, 1997, at
10:00 a.m., in Room 310, as the date, time, and place of the hearing on the
proposed dissolution and did give notice by publication and posting, as
provided in Chapter 4 (commending with Section 56150) of Part 1; and
WHEREAS, at the time and place set for the hearing on the Resolution of
Dissolution, prior to consideration of protests, the Commission's Resolution
making determinations was read aloud or summarized, and at such hearing the
Board of Supervisors heard and received all oral and written protests,
objections or evidence which were made, presented or filed, as provided in
Government Code Section 57050; NOW THEREFORE

5. The dissolution of Geologic Hazard Abatement District, No. 1 is
hereby ordered without an election, as provided in Government Code
Section 57083, subject to the terms and conditions stated herein.
IT IS FURTHER ORDERED that the Clerk of the Board immediately transmit
six certified copies of this Resolution to the Executive Officer of the Local
Agency Formation Commission of San Diego County, so that the Executive Officer
may make the filings required by Chapter 8 (commencing with Section 56450),
Part 5, Division 1, Title 6 of the Government Code and by Chapter 8
(commencing with Section 54990) Part 1, Division 2, Title 5 of the Government
Code.

MAKING DETERMINATIONS AND APPROVING THE

On motion of Commissioner Horn, seconded by Commissioner Howard, the
following resolution is adopted:
WHEREAS, pursuant to Government Code Section 56425, the San Diego Local
Agency Formation Commission is required to develop and determine a sphere of influence
for each local governmental agency within the County; and
WHEREAS, an application has been made to adopt a sphere of influence for the
Geologic Hazard Abatement District No. 1 (Neptune Avenue), and
WHEREAS, a resolution of application was submitted to this Commission for
dissolution of the Geologic Hazard Abatement District No. 1 (Neptune Avenue), which
resolution was adopted by the City Council of Encinitas as Resolution No. 96 -71, dated
August 28, 1996, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for adoption of a zero sphere of influence and
dissolution is as described in the application on file with the Local Agency Formation
Commission; and
WHEREAS, t, e Executive Officer of the Commission has filed his report on said
adoption of a zero sphere of influence and district dissolution, which report was received
and considered by the Commission, and
WHEREAS, pursuant to Government Code Sections 56427 and 56828, the
Executive Officer of this Commission set a public hearing on the proposed adoption of a
zero sphere of influence and district dissolution for December 2, 1996, and gave notice of
the date, time, and place of said hearing in accordance with Government Code Sections
56834 and 56835; and
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows

(1) The hearing was held on the date set therefore, and due notice of said
hearing was given in the manner required by law.
(2) At that hearing the Commission called for, heard, and considered all
interested parties and read and considered the report of the Executive Officer.
(3) In accordance with Government Code Section 57002, the Commission
hereby declares that this action requires a noticed public hearing by the conducting
authority.
(4) The Commission certifies that the determination by the City of Encinitas that
adoption of a zero sphere of influence and the district dissolution are exempted by State
CEQA Guidelines Section 15061(b)(3) from the requirements of CEQA has been reviewed
and considered.
(5) The Commission has considered the factors enumerated in Section 56425
prior to adopting the zero sphere of influence for the Geologic Hazard Abatement District
No 1 (Neptune Avenue).
(6) -The Commission hereby determines that a zero sphere of influence shall be
adopted for the Geologic Hazard Abatement District No. 1 (Neptune Avenue), and adopts
the Statement of Determinations as provided in Exhibit C pursuant to Section 56425 of the
Government Code
(7) The Commission hereby approves the dissolution with boundaries as
described in Exhibit A attached hereto, subject to the conditions as stated in Exhibit B.
(8) The boundaries of the territory as described in Exhibit A are definite and
certain
(9) The boundaries of the territory do conform to lines of assessment and
ownership
(10) The district is a property -owner district.
(11) The territory is inhabited.
(12) The territory proposed for district dissolution is hereby designated the
"Dissolution of Geologic Hazard Abatement District No. 1 (Neptune Avenue)."
(13) The Commission hereby designates the County of San Diego as the
conducting authority and authorizes the Board of Supervisors to conduct proceedings in
compliance with this resolution without an election.
(14) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

The following statement of determinations is prepared pursuant to Section 56425 of the
Government Code for designation of a zero sphere of influence for the Geologic Hazard
Abatement District No. 1 (Neptune Avenue).
(1) The present and planned land uses in the area including agricultural and
open space lands
The District includes 50 residences on the west side of Neptune Avenue in the City of
Encinitas. Land uses within the District are regulated by the City of Encinitas and there are
no plans to change existing land uses.
(2) The present and probable need for public facilities and services in the area

(3) The present capacity of public facilities and adequacy of public services
which the agency provides or is authorized to provide.
The District is not currently providing any services. LAFCO's adopted sphere guidelines
indicate that a zero sphere should be designated for an agency when the provision of its
services are no longer required.
