Parcel 1:
The Southerly 100.00 feet of the following described land:
That portion of the Northerly 2 acres of Block 94 of Colony Olivenhain, in the City of Encinitas,
County of San Diego, State of California, according to Map thereof No. 326, filed in the office
of the County Recorder of San Diego County, July 8, 1995, and that portion of Lot 27 of the
Subdivision of Rancho Las Encinitas, according to map thereof no. 848, filed in the office of the
County Recorder of said County, June 27, 1898, together with those portions of the Westerly
half of "C" street adjoining on the East and "B" street adjoining on the West to Block 94 in the
colony of Olivenhain, and as said streets were vacated and closed to public use, all described
as a whole as follows:
Commencing at the Southeasterly corner of the land described in Deed to Albert H. Acosta, et
al, recorded December 8, 1959 In Book 8032, Page 53 of Official Records said point being
also the most Southeasterly corner of land described in Deed to Gilbert Preciado, et ux,
recorded January 29, 1964 as Instrument No. 17087 of Official Records; thence Northwesterly
along the Southwesterly line of said Acosta's Land a distance of 30.00 feet to the true point of
beginning; thence Northeasterly parallel with the centerline of said "C" Street a distance of
200.00 feet; thence Northwesterly parallel with the Southwesterly line of said Acosta's Land a
distance of 218.00 feet; thence Southwesterly parallel with the centerline of said "C" Street a
distance of 200.00 feet to the Southwesterly line of said Acosta's Land; thence Southeasterly
along said Southwesterly line a distance of 218.00 feet to the true point of beginning.

An easement and right of way for road and public utilities and incidentals thereto over that
portion of the Westerly half of "C" Street as vacated and closed to public utilities adjoining
Block 94 of the Colony of Olivenhain, in the City of Encinitas, County of San Diego, State of
California, according to Map thereof No. 326, filed in the office of the County Recorder of San
Diego County, July 8, 1885 on the East.
Excepting therefrom that portion lying within Parcel 1 hereinabove described.
Also excepting therefrom that portion lying Northerly of the Easterly prolongation of the
Northerly line of Parcel 1 herein above described.
And also excepting therefrom that portion lying Southerly of the Easterly prolongation of the
