SAN DIEGUITO WATER DISTRICT, an irrigation district organized and existing under and by
virtue of the laws of the State of California hereinafter called GRANTOR(S), do(es) hereby grant,
convey and dedicate in fee to the CITY OF ENCINITAS, STATE OF CALIFORNIA, hereinafter
called GRANTEE, the fee title for right of way and incidents thereto for a public highway upon,
over and across that certain real property in the City of Encinitas, County of San Diego, State of .
California, described as follows:

HEREOF BY THIS REFERENCE,
Whereas the Board of Directors of the San Dieguito Water District authorized the grant of
lands and authorized and directed the secretary . of the district to execute said grant deed
pursuant to the authority conferred by resolution No. 96-12, adopted June 26d, 1996 does hereby
grant said lands described in Exhibits "A" and "B".

This is to certify that the interest in real property conveyed by this easement to the City of
Encinitas, a Municipal Corporation, is hereby accepted by the undersigned agent on behalf of the
City Council of the City of Encinitas pursuant to authority conferred by Resolution No. 2001-55
of the City Council of the City of Encinitas adopted on October 10, 2001 and the grantee
consents to recordation thereof by its duly authorized officer.
