1939-16238CONVEYANCE OF EASEMENT FOR RIGHT OF WAY
THIS INDENTURE WITNESSETH, that R. W. YEAGER, of Encinitas,
San Diego County, California, for and in consideration of One
Dollar ($1.00) and other valuable consideration, the receipt of
which is hereby acknowledged, does by these presents convey unto
the qAN DIEGUITO IRRIGATION DISTRICT, of said County, its successors
and. assigns forever, an easement for right of way over and upon the
lands hereinafter described, for the construction, use, and main-
tenance thereon of pipe lines and the supports and appurtenances
thereof., convenient and necessary for the.purposes and uses of said
Irrigation.Districtr, together with the right of ingress and egress
over the adjacent landc of the Grantor herein, to the various points
of said. right of way necessary for the work and construction, main-
tenance, and, repair of said. pipe lines,: supports, and. appurtenances.
The said rights of ingress and. egress to be exercised with the least
possible detriment and inconvenience to the lands so used, and. any
,damage to growing'crops caused. thereby to be compensated for by
said District.
Said pipe lines shall, wherever practicable, be placed under
ground and, covered by the natural soil to a depth which will not
interfere with the cultivation of the land through which they ex-
tend, provided.that where it is necessary to the proper gradient
and construction of said lines, they may be carried over arroya.s
and. depressions in said right of way above ground. and. upon trestles
or other supports.
The premises over which this conveyance extend.s,are more
particularly described. as follows:
The Southerly * of the SW of the'-NWJ of Section
3. , T.13 S., R.4 d1, S'.B.B.M.
The contemplated. location of the center line of said pipe
line is shown upon the. attached plat, and said easement consists
of a strip of land. fifteen (15) feet in wid.th, more particularly
described as follows;
Description of center line of 15 foot.ea.sement.to be obtained
across the Southerly V of the SW~ of the NW' of Section"3, T.13 S.,
R. 4 W. S.B.B.M., located in San Diego County, State of California:
Beginning at a point on the Southerly 'boundary of SWIL, of NWT
of said Sec. 3, 356.14 feet N 89*49130" W of the SE corner
of the S* of the 'N* of said Section 3; thence N 30053125" W.
150.6 feet; thence N 14013125° W 207.3 feet to an intersection
with the Northerly boundary line of the Southerly of S`R
of the NWJ of said Section 3; said. intersection point be-
456.7 feet S S5° 351 N of the Northeast corner of the Sk of SWl~
of the Nw~ of said Section-3.
Includes rights of ingress and egress and use for water pipes
'and road. Purposes of lands within the boundaries of the Southerly..
4 of the SW of the NW4 of Section 3;' T.13 S. R. 4 _.W..• for a dis=
tance of 7f feet on both sides of the abovd. described centerline.
