FA RMER as Grantor of San Diego, County of San Diego, State of California for and in consideration of the sum of Ten Dollars (010.00) lawful money of the United States, paid by San Dieguito Irrigation Dis- trict, an irrigation district organized and existing under and by virtue of the laws of the State of California, as Grantee, receipt whereof is hereby acknowledged, does hereby grant unto said San Dieguitc Irrigation 'District, its successors and assigns, an ex- clusive and permanent easement of right of way in, upon, over and across the lands hereinafter described, for the purpose of locating, reldca.ting, constructing, reconstructing, maintaining, operating, Inspecting and repairing a pipe line .or pipe lines, and all fix- tures and appurtenances incidental thereto for use in connection therewith, for the transmission aid distribution of water and.all uses and purposes incidental thereto, together with the right of ingre4 thereto .and agress therefrom, to and along said right of way, together with the right to clear and keep clear said right of way from buildings, structures, explosive,.trees, and other ' r d material or growths detrimental to the uses he rein granted. The lands in which such easement of right of is hereby granted are situated in the County of San Diegg, State of Cali- fornia, and particularly described as follows, to wit: Lot 3 in Block 23 and Lot 1 in Block 35 *of- Rancho Santa Fe, in the County of San Diego, State of California, according to Map thereof No. 1742, filed in the. Office of the County Recorder of San Diego County °December 28, 1922. The route of said easement of right of way across the afore- said lands shall be as follows: Beginning at the most Easterl corner of said. Lot 3, said corner: being a point in a 111.67 foot radius curve concave Southeasterly whose center bears South 39 18 03'East; thence along the Southeasterly line of said Lot as follows: -1- I t � ,.�fJND PAGE c", 19 Southwesterly along said curve a distance of 65.48 feet to the beginning of a compound curve concave Southeasterly having a radius of 711.55 feet; thence Southwesterly along said curve 115-44 feet to the true point of beginning of . the center line herein described; thence leaving said Southeasterly line of said Lot, South 78 23 West 21€3.64 feet to the beginning of a tangent curve concave Northerly having a radius of 900 feet thence Westerly along said curve through a central angle of 9 39 30 a distance of * 151.71 feet; thence South 88 02 30 West 856.31 feet to the beginning of a tangent curve concave Northerly having a radius of 1000 feet* thence Westerly along said curve through a central angle of 4 07i 30" a distance of 72.0 feet; thence tangent to said curve North 87 501 West 461.73 feet to the beginning of a tangent curve concave South- easterly having a radius of 350 feet; tIAence Westerly along said* curve through a central .angle of 4 52 09 a distance of 29:74 feet to the West line of said Lot 1 in Block 35• It is expressly agreed that the Grantor shall have the right, at his own risk, to use the surface of the right of way hereby granted, for agricultural uses except for the planting and growing of.trees; and the right to.cross or make use of the surface in a manner not detrimental to the installation, construction, operation, inspection, repair, maintenance and replacement of a pipe line or pipe lines, or to any other purposes and uses as are or may be necessary or incidental to the construction, , maintenance and oper- ation of the Grantee's proposed pipe line or pipe lines. And the Grantor hereby agrees for himself, his successors or assigns, that he will not plant trees.or construct or cause to be constructed and maintained any buildings or structures of any nature or kind withintan feet of said pipe line; or store or permit to be stored or use upon said right of way any blasting supplies ex ®. plosives commonly used for blasting purposes. And the Grantee hereby agrees that it will avoid unreasonable interference with the use by Grantor and his successors of said right of way, and agrees not .to fence. the same, and_ agrees that the Grantor may enjoy the surface use of the land herein described, subject to the conditions above stated; and agrees to permit the installation by the Grantor of water pipes reasonably required for Grantor's use on . his said property over and across the right of way in a manner which will not interfere with the Grantee's pipe lines and operations, provided, if the location is to be under Grantee's pipe line, it must be installed subject to Grantee's 02® F A , supervision and approval, and the Grantee agrees, after the installation of its.pi.pe' lines, to restore the surface grade above the pipe to as near the original elevation as practicable. All present installed utilities will be interfered with as little as possible and if interrupted will be promptly restored to use at the expense of the Grantee. Grantee agrees indemnify Grantor and hold Grantor harmless against any and all damages, claims and. demands suffered by Grantor or asserted against Grantor, by reason of the construction, re- construction, maintenance, operation or repair of Granteel's pipe line or lines, or any appurtenances thereto, in, upon, over, along or across said right of way. That where damage is done to any plantings or improvements upon the land crossed by said pipe lines or of future maintenance, repairing and /or emptying any of the aforesaid pipe lines, either in respect to the right given for ingress and egress, or to leaks, emptying, or other causes not herein specified, Grantee must either promptly remedy the damage to the satisfaction of the Grantors or pay the cost of the: damage within thirty ( 30) days after bill therefor has been presented to it by the party claiming on STATE OF CAL IFORNIA COUNTY OF SAN DI EGO )SS 1 On this 26 day of April , 19509 A.D., before me, the undersig=n, a Notary Pu c n and for the said County and State, residing therein, duly commissioned and sworn, personally appeared LLOYD B.
