MEYER and LOIS M. MEYER, husband and wife, of Leucadia, California, for and in consideration of One Dollar ($1.00), and other valuable consideration, the receipt of which is hereby acknowledged., do by these presents convey unto the SAN DTEGUITO IRRIGATION DISTRICT of said County, its successors and assigns, an easement or right- of-way over and upon the lands hereinafter described, for the construction, use and maintenance thereon of pipe lines and the supports and appurtenances thereof, convenient and necessary for the purposes and uses of said Irrigation District, together with the right of'ingress and egress over the adjacent lands of the grantor herein, to the various points of said rights of way nec- essary for the work and construction, maintenance and repair of said pipe lines, supports and appurtenances. Said pipe lines shall, wherever practicable, be placed under ground and covered by the natural soil to a depth which will not interfere with the cultivation of the land through which they extend, provided that where it is necessary to the proper gradient and construction of said lines, they may be carried over arroyas and depressions and said right of way above ground and upon trestles or other supports. The premises over which this conveyance extends are lo- cated in the State of California, County of San Diego, and are more particularly described as follows: The Northerly 20 feet of the Easterly 383.50 feet of Lot 1, Section 5, Twp. 13 South, Range 4 West, San Bernardino Meridian; in the County of San Diego, t State of California, according to United States Government Survey approved April 19, 1881. BAUMGARTNER Mr. Abbey has just advised me that Mr. Baumgartner has authorized him to request the Court to modify the judg- ment previously rendered, concerning which I wrote you on June 16th, so as to provide that the easement will proceed along the Northerly 10 Feet and the Easterly 10 Feet of his property, with no restrictions or limitations whatsoever. In other words, instead of following the present course south of fAe euc_ &,lyjptus the pipe would be laid north of the eucalyptus trees between those trees and the boundary line, and nothing would be said concerning the right to pave over the property, the right to erect permanent improvements thereon, or the depth at which the pipe should be laid. The District would be granted a reasonable time within which to move the pipe from one side to the other of the trees. I questioned Mr. Abbey concerning the possibility of laying the pipe between the trees and the northerly bound- ary of the property, and he indicated that Mr. Baumgartner believed this could be done without damage to the trees. Will you please advise me whether this modification is acceptable to you? It is certainly much simpler from a legal point of view. FRANKLIN 7323 CABLE"GRACARY This will advise you that Judge Sherry yesterday determined that the District had the right to condemn an easement across the Baumgartner property upon payment of $600.00 compensation for a 10 -foot easement, the 10 feet to be located as follows: The Southerly 10 Feet of the Northerly 20 Feet, where the easement runs in an east -west line; and the Easterly 10 Feet of the property, where the easement runs in a north -south line. The ,judgment is to provide that the area may be paved, if desired, and that in the event paving or similar surface improvements are damaged by the District in replacing or repairing pipe, the District shall restore the surface to its previous condition. It is also tocontain a provision permitting Baumgartner to erect a gate, if he so desires, across the portion of the property near the highway. I am enclosing a statement of Mr. Mueller for his services as Appraiser in the sum of $150.00. The Court directed this to be paid by the District, and in view of the small award given for the property I could not strenu- ously protest. Meyer and myself and wife acquired from the Estate of Victor Fleming, approximately 36 acres of unimproved property located in Sections 5 and 33, Leucadia for a cash consideration of 1'40,000.00. Your Irrigation District valuation on this property last year was X38,300.00 as compared to the County of San Diego's assessed valuation of 1'27,80.0.00. Some time ago I spoke to your Assessor, Mr. T. F. Harrington, explaining that the present owners felt in view of the price paid that the District's valuation was excessive and requested that consideration be given to a re- duction in this year's tax roll. Under date of April 18th, Mr, Harrington advised me that the District's valuation on this property had been reduced to $33P910.00. On Feb. 9, 1950 I addressed a communication to the San Diego County's Assessor outlining the conditions of our pur- chase of this property and requesting a reduction of their assessed valuation of 1'27,800.00. Under date of May 8 1 1950, the County Assessor's Office advised that in view of the information given them, their assessed value on this property had been reduced to $14P990.00. For your consideration, beg to advise that the price paid for this property represents its true market value, in that it was purchased from the estate through competitive bidding and in no way can be considered a forced or stressed sale. It is my understanding that the estate of Victor Fleming represented a value of around two million dollars, the largest portion of which consisted of negotiable securities. The owners of this property feel that the adjusted value of $33 as placed on this property by the District is still excessive and not in keeping with the value placed on other comparable property in the District. While we realize that the District assesses property independent of the County, we are cer- tain that the difference in values of 1'33,910.00 by the District and 1'14,990.00 by the County cannot be justified. This he did and de- cided it was feasible to extend the pipe line beyond the drive way, but suggested sending a letter to the water board requesting same for- their a.pproval.. Then the discussion came up about the Freeway Highway, . consequently our plans were delayed'.
