The Undersigned, FERN1� Ho EZZELL, of Los Angeles,
County of Los Angeles, State of California, for and in
consideration of the sum of Ten Dollars ("';10.00) lawf ul
:coney of the United States, paid by San Dieguito Irrigation
District, an irrigation district organized and existing
under and by virtue of the laws of the State of California,
receipt whereof is hereby acknowledged, does hereby remise,
release and forever quit claim unto said San Dieguito
Irrigation District (hereinaft.er called the S
its successors and assigns, and exclusive and permanent ease-
ment of right of way in, upon, over and across the lands
hereinafter described, for the purpose of locating, re-
locating, constructing, reconstructing, maintaining, operat-
ing, inspecting and repairing a pipe line or pipe lines,
and all fixtures and appurtenances incidental thereto for
use in connection therewith, for the transmission and distri-
bution of water and all uses and purposes incidental thereto,
together with the right of ingress thereto and egress there-
from, to and along said right of way, together with the right
to clear and keep clear said right of way from buildings,
structures, explosive, trees, and other material or growths
detrimental to the uses herein granted,
The lands in which such easement of right of way
is hereby quitclaimed are situated in the County of San Diego,
State of California, and particularly described as follows,
to wit
Lot 4,Block 10, Rancho Santa Fe, in the County of
San Diego, State of California, according to Map
thereof Igoe 1742, filed in the office of the County
Recorder of San Diego County December 28, 1922,
The route of said easement of right of way across the aforesaid
lands shall be as follows:
Beginning at a point on the Northeasterly line of
said Lot 4, distant thereon North 45 57 'est
223.37 feet from the most *Easterly corner of said
Lot; thence South 59 29 Best 34.83 feet to the
beginning of a tangent curve concave Northerly having
a radius of 490 feet; thence aiesterly along said curve
through a central angle of 14 30 a distance of
124001 feet; thence tangent to said curve South 73
594 dest 289.79 feet to the beginning of a tangent
curve concave Southerly having a radius of 1510 feet;;
thence veesterly along said curve through a central
angle of 13 20 a distance of 351039 feet; thence
tangent to said curve South 60 394 pest 367092 feet;
to a point.on the southwesterly line of said Lot
distant thereon North 35 404 `Udest 616 .06 feet from
the most Southerly corner of said Lot 4.

It is expressly agreed that the Undersigned shall
have the right, at her own risk, to use the surface of the
right of way hereby quitclaimed, for agricultural uses except
for the planting and growing of trees; and the right to cross
or make use of the surface in a manner not detrimental to
the installation, construction, operation, inspection,
repair, maintenance and replacement of a pipe line or pipe

lines, or to any other purposes and uses as are or may be
necessary or incidental to the construction, maintenance and
operation of the District's proposed pipe line or pipe lines.
And the Undersigned hereby agrees that she will not,
nor will she give or grant to any one else the right to plant
trees or construct or cause to be constructed and maintained any
buildings or structures of any nature or kind within ten feet of
said pipe line; or store or permit to be stored or use upon
said right of way any blasting supplies or explosives commonly
used for blasting purposes.
And the District hereby agrees that it will avoid
unreasonable interference with the use by the Undersigned and
her successors of said right of way, and agrees not to fence
the same, and agrees that the Undersigned may enjoy the surface
use of the land herein described, subject to the conditions above
stated; and agrees to permit the installation by the Undersigned
of water pipes reasonably required for Undersigned's use on her
said property over and across the right of way in a manner which
will not interfere with the District's pipe lines and operations,
provided, if the location is to be under the District's pipe
line, it must be installed subject to the District's supervision
and approval, and the District agrees, after the installation of
its pipe lines,.to restore the surface grade above the pipe to
as near the original elevation as practicable. All present
installed utilities will be interfered with as little as possible
and if interrupted will be promptly restored to use at the expense
of the District.
The District, by its acceptance of delivery of this
instrument from the Undersigned, acknowledges and agrees as
follows: (a) the Undersigned has informed the District that the
Undersigned does not believe that she has or owns any title in
or to any of the lands hereinbef ore described; (b) that the
Undersigned shall have no obligation or liability whatsoever to
the District or to any of the District's successors or assigns
if this instrument is entirely ineffective to vest or create the
above described easement because the Undersigned does not in fact
