IN CONSIDERATION of the sum of One (41.00) Dollar,
the receipt of which is hereby acknowledged, and of the
further covenants and conditions agreed to be kept and
performed by the San Dieguito Irrigation District, a Body
politic and corporate, duly organized and existing under the
laws of the State of California, I, the undersigned, being
the owner , of the N.W. 1/4 of the N.E. 1/4 of Sec. 22, T.
13 S, R. 4 W,S.B.B.Mp.,loeated in San Diego County, Cali-
fornia, do hereby grant to the aforesaid District, its
successors and assigns, the right to lay, maintain and
operate a water pipe line over and upon the land above des-
cribed so long as the said pipe line shall be maintained and
used by said District, upon and under the following condi-
tions:
1. That the said pipe line shall be so laid that
the top thereof shall be at least twenty -four (24) inches
below the original surface of the lend, and that surplus
earth left after backf illing is finished must be evenly .
spread or scattered over the surface.
2. To permit the right of ingress and egress over
said land to such an extent as is necessary to the agents

of said pipe line, provided said right of ingress or egress
is exercised by them in such a way as to do the least pos-
sible damage to the plantings or improvements thereon.

3. To repair all leaks or breaks which may occur in
the pipe line promptly after their occurrence, and where
damage to any plantings or improvements upon the land is
caused by such leaks or breaks, the District must pay the
value thereof within a reasonable time thereafter.
4. That neither the undersigned, nor his heirs or
assigns, shall be liable for any damage to said pipe line
done in ordinary course of farm work, unless such damage
is due to the lack of reasonable care.
In casethe District does not carry out the terms of
this agreement, then the same shall be considered cancelled
and of no effect.
