ON NOTION of Supervisor Cozens, seconded by Supervisor Dent, the following resolution is, adopted: WNBREAS there is presented to the Board a letter from the Purchasing Agent trans®itting and recommending execution and recordation of a Grant of Easement for dater Pipelines and Quitclaim of Abandoned Easement, executed by the San Dieguito Irrigation District, and approved as to form by the County Counsel, wherein the County of San Diego, in consideration of the abandonment and quitclaim by said District of an easement for water pipelines and appurtenances across certain County -owned property known as Quail Park, in the County of San Diego, grants and conveys to said District an easement for said purpose across a portion of Quail Park, as more particularly described iri said Grant of Easement for dater Pipelines and quitclaim of Abandoned Easement, Board of Supervisare' Document No. 374375; NOW THEREFORE IT IS R MVIRH AND (IRMM that the Chairman of this Board be and. he is he"by.authoriaedl and di"Gted to execute said Easement for Water pipelines and Quitclaim of Abandoned Easement; and that the Clerk of this Board be and she is hereby authorized and directed to cause it to be recorded in the office of the County Recorddr, of the County of San Diego, State of California. Supervisors Gibson,,Boney, Dent, Austin and Cozens .NOES: Supervisors None ABSENT: Supervisors None . .. . .. . .. . .. . .. . .. 24 No. 6/8/66 kjll GRANT OF EASEMENT FOR WATER PIPELINES AND QUITCLAIM OF.ABANDONED EASEMENT THE SAN DIEGUITO IRRIGATION DISTRICT, in the County of San Diego, State of California, having acquired an easement for pipelines and appurtenances across certain property now owned by the County of San Diego, a political subdivision of the State of California, which said property is commonly referred to as Quail Park; said easement having been acquired by the Irrigation District from Anton Van Amersfoort by deed dated October 6, 1923 and recorded August 22, 1925, in Book 1122, at page 107 of Deeds, in the office of the County Recorder in the County of Szn Diego, State of California; and WHEREAS, San Dieguito Irrigation District is reconstructing the pipelirelocated within the aforesaid easement; and WHEREAS, the District and the County mutually agrees that it would be.desirable.to relocate said easement to a more suit- able location across said Quail Park; NOW THEREFORE ' THE COUNTY OF SAN DIEGO, in consideration of the abandonment and quitclaim of the above - described easement, by these presents grants and conveys to the SAN DIEGUITO IRRIGATION DISTRICT of the County of San Diego, its successors and assigns forever, an easement across and beneath the following described property for the construction, use and maintenance of water pipelines and appurtenances together with the right of ingress and egress over the adjacent lands of the grantor to the various points on said easement necessary for the work of construction, maintenance and repair of said pipelines and appurtenances. The said rights of ingress and egress shall be exercised with the least possible detriment and inconvenience to the lands so used and any damage - 1 - N to trees, plants, growing crops, buildings or structures caused thereby shall be compensated for by said District. The said pipelines, wherever possible, shall be placed under ground and covered by the natural soil to a depth which will not interfere with the cultivation of the land through which they extend. The property subject to said easement is situated in the County of San Diego, State of California, and is more particularly described as follows: All that real property in Section 10, Township 13 South, Range 4 West, San Bernardino Meridian, in the County of San Diego, State of California, according to U.S. Government Survey approved April 19, 1881, lying with- in a strip of land 15 feet in width, 7.50 feet on each side of a center line more particularly described as follows: Beginning at the Southquarter corner of said-Section 10; thence North 2 °10'25" East (record North 3 0 26'40" East) along the North and South center line of`said Section 10, a distance of 649.95 feet to the point of intersection of the Southerly line of the South � of the North � of the Southeast 4 of the Southwest 4 of said Section 10, which land hereinafter will be referred to as Parcel "B ", and the said North -South center line of said Section 10; thence Westerly along the said Southerly line of said Parcel "B" 15 feet to the TRUE POINT OF BEGINNING; thence North 2 1 10'25" East 22.60 feet; thence North 87 1 49 1 35" West 53.00 feet; thence North 2 °10'25" East 100.97 feet; thence North 13 0 03'59" East 204.24 feet to a point distant 7.50 feet Westerly along the Northerly line of said Parcel "B" from the intersection of the said Northerly line of said Parcel "B" and the said North -South center line of said Section 10 . - . In consideration of the grant of the above - described ease- ment by the County.to the District, SAN DID:;UITO IRRIGATION DISTRIC'I hereby abandons and quitclaims to the COUNTY OF SAN all of its right, title and interest in and to that certain easement for pipelines acquired by it by that certain deed executed by - 2 - Anton Van Amersfoort, dated October 6, 1923, and recorded August 22, 1925, in Book 1122, at page 107 of Deeds, in the office of the County Recorder of San Diego County, and in and to any pipelines within said easement. This instrument shall be effective only after execution by both the County of San Diego and the San Dieguito Irrigation District.
