Signature March 26, 1984 Date i YNo. 7 WEDNESDAY, MARCH 21, 1984 435 RESOLUTION OF THE BOARD OF SUPERVISORS ORDERING THE "KERN REORGANIZATION" WITHOUT NOTICE, HEARING, OR ELECTION ON MOTION of Supervisor Williams seconded by Supervisor Fordem , the following resolution is adopted: WHEREAS, pursuant to the District Reorganization Act of 1965, commencing with Section 56000 of the Government Code, application was made by petition of the prop- erty owner for the Kern Reorganization; and WHEREAS, on March 5, 1984, the Local Agency Formation Commission has, as Resolution No. RO 83 -17, adopted its "Resolution of the San Diego Local Agency Formation Commission Approving a Proposed Reorganization Including Annexation to the Cardiff Sanitation District and the Rancho Santa Fe Fire Protection Dis- trict and Detachment From the Rancho Santa Fe Community Services District" approving the proposed reorganization and authorizing the Board of Supervisors to initiate and conduct proceedings for the proposed reorganization in compliance with Resolution No. RO 83 -17 and pursuant to Government Code Section 56261; and WHEREAS, pursuant to Government Code Section 56261, a petition for the re- organization has been signed by 100 percent of the owners of land within the affected territory of the proposed reorganization; and WHEREAS, pursuant to Government Code Section 56439.5, the Board of Supervisors is authorized to conduct proceedings for the reorganization without notice, hearing, or election; NOW THEREFORE, IT IS RESOLVED, FOUND, ORDERED AND DETERMINED as follows: 1. The Board of Supervisors has considered the factors specified in Government Code Section 56435. 2. This reorganization consists solely of annexations and detachments. 3. Approved by the Local Agency Formation Commission of San Diego MAR - 5 '1984 Executive officer of said Commission EXHIBIT "A" Page 3 of 3 RO83 -17 ENVIRONMENTAL SUMMARY AND FINDINGS FOR SIGNIFICANT EFFECTS OF LOMA SAN ELIJO - TM 4254 (KERN REORGANIZATION) Lead Agency: County of San Diego SUMMARY (from County EIR, EAD Log #80 -8 -137) PROJECT DESCRIPTION The project is a division of 73.9 acres into 33 lots with an overall density of 0.44 dwelling units to the acre. A Grading Permit will be applied for to grade 25,000 cubic yards of material for roads and building pads. PROJECT LOCATION The property lies from 100 to 400 feet west of El Camino Real and about the same distance east of the high water line of San Elijo Lagoon. It is bounded on the northwest, west, and south by the San Elijo Lagoon Regional Park, Thomas Bros. Maps page 30, coordinates 2/B and C (Supv. Dist. V). LAND USE FACTORS AND SURROUNDING LAND USES The property is designated "Estate" on the San Dieguito Community Plan, which allows 1 du /2 and 4 acres. It is within the Current Development Boundary of the Growth Management Plan, according to the draft -EIR. Most of the area is classification R -R -S, which allows 1 du /2 acres. Two small areas on the north boundary are classified 5 -80, which is an open space designation. About nine large lots exist between the east property boundary and E1 Camino Real. Most of the land to the northwest, west, and south is undeveloped rolling grassy hills and floodplain which bound San Elijo Lagoon. The subject property includes a prominent knoll which is highly visible from Olivenhain to the north, E1 Camino Real to the east, Lomas Santa Fe to the south, and Cardiff Sea Village /Cardiff State Beach /Solana Beach to the west. BACKGROUND The project site was examined in 1974 for a proposed subdivision by Rick Engineering. Archaeology and Biology studies have been retained on file with the County. RECON updated this work in 1979, but the subdivision was never processed. The San Diego Gas and Electric Company has a large transmission line across the west edge of the property. This project was first heard by the ERB on May 7, 1981, but was sent back to the applicant for revisions prior to making any findings. Exhibit "B" Page 1 of 7 RO83 -17 MAJOR ISSUES: 1. Aesthetics /Local Coastal Plan Conflicts (No Mitigation Measures Proposed) Impact: Residential and road development up and atop a prominent grassy knoll which is visible throughout the San Elijo Regional Park and surrounding residential and transportation corridors will create an adverse visual impact and may be in conflict with Policies 94 (4), 122, and 124 of the proposed Local Coastal Plan. The project would grade a 56 foot wide paved street from Calle Loma San Elijo at the 70 foot contour up an 8% grade to the 170 foot contour at the top of a steep grassy knoll. House pads will level the two peaks and cut three (3) step -pads down the south. The grading of the knoll and siting of house pads on its slopes would be visible from homes around San Dieguito County Park, Lomas Santa Fe on the south, Cardiff Sea Village on the northwest, Olivenhain on the north, Inter- state 5 to the west, Manchester Avenue east of Interstate 5 and the San Elijo Regional Park. The location of the knoll is well illustrated on Figures 2 -3 and 2 -4 of the draft EIR. The key to this issue is the topographic landform on the piedmont which projects into the east end of San Elijo Lagoon. It rises south of Encinitas Creek and north of an unnamed creek in which La Orilla Road crosses. This land - form comprises patches of grassy disturbed vegetation, Chamise, Chapparal, and Coastal Sage Scrub. The northwestern base of the property includes an important part of an Ecological Resource Area, which will be impacted by the access road to El Camino Real. Mitigation: These impacts were determined by the Board of Supervisors to be insignificant. 2. Grading and Sedimentation Impact: Implementation of this project would result in a minimum of 25,000 cubic yards of grading to create roads and building pads (Lots 6, 7, 12, 4, 21, 28), which will remove protective watershed vegetation and subject the adjacent San Elijo Lagoon to severe sedimentation problems. Historic experiences at the Lomas Santa Fe project to the southwest and Cardiff Sea Village to the northwest have demonstrated that even the best available runoff /sedimentation systems cannot be guaranteed to adequately mitigate the tremendous flows of runoff and sediment which result for grading Huerhuero loams soils. Grading in the knoll area will create 20 foot cut and 15 foot fill banks. Table 2 -1 of the draft EIR on page 16 reveals that 20% of the property has grades of 25% or greater. The draft EIR provided insufficient data to demonstrate that this impact can be adequately mitigated. - 2 - R083 -17 Mitigation: (from Board of Supervisors TM 4254 Resolution) Prior to the issuance of a grading permit the subdivider shall comply with the following conditions: Said plans shall include the following provision: (1) Emergency erosion control measures to control soil movement satisfactory to the County Department of Public Works in the event the site is exposed to erosion during the period between November 1 to April 15. Erosion control measures shall include but not be limited to, slope protection, installation of jute matting or approved equivalent, desilting basins, energy dissipators, silt control, sand bagging and storm drains. (2) All building pads to be diked and the dikes maintained to prevent water from flowing from the pad until the streets and driveways are paved and water can flow from the pads without causing erosion, or construct drainage facilities to the satisfaction of the County Department of Public Works that will allow water to drain from the pad without causing erosion. (3) Tops of all slopes to be diked or trenched to prevent water from flowing over the crests of slopes. (4) As soon as cuts or embankments are completed, but not later than November 1, all cut and fill slopes shall be stabilized with a hydromulch mixture or an equal treatment approved by the County Department of Public Works. Between November 1 and April 15, approved slope protection measures shall proceed immediately behind the exposure of cut slopes and /or the creation of embankment slopes. (5) An irrigation system to be installed not later than May 15 following the planting of the slopes. (6) Sand bag check dams to be placed in a manner approved by the County Department of Public Works in unpaved streets with gradients in excess of 2% and on or in other graded or excavated areas as required by the County Department of Public Works. The location and details on the sand bags shall be shown on the plans. (7) Catch basins, desilting basins and storm drain system shall be installed to the satisfaction of the County Department of Public Works. - 3 - RO83 -17 (8) At or near every point where concentrated flow leaves the development, a desilting basin and an energy dissipator shall be required to be constructed to remove silt from the water and release the water at a non - erosive velocity. (9) The developer to maintain the plantings and erosion control measures described above until relieved of same by the County Department of Public Works. The developer to remove all soil intercepted by the sand bags, catch basins and desilting basins and keep these facilities clean and free of silt and sand as directed by the County Department of Public Works. The developer shall repair any eroded slopes as directed by the County Department of Public Works. 3. Biological Resources Impacts: The project is located on a peninsula -like upland area, between two eastern arms of the San Elijo Lagoon (and its tributaries) and lies within the adopted San Elijo Lagoon San Dieguito RCA. This RCA identifies lagoon, lagoon- associated and scarce upland resources of regional and supra - regional importance. In addition, the project lies within the Ecological Resource Area of the proposed San Dieguito Local Coastal Plan. This land use designation, extends 100 feet upland from the 100 year floodplain. (See policy 122). The project site is covered with grassland (former pastureland) and coastal sage scrub vegetation, the latter which has suffered 60 -70% loss in San Diego region. The onsite habitats are important for upland wildlife species, especially raptorial birds and serve as access areas to riparian and marsh habitats and food /water sources. Development as proposed will convert the existing habitats to suburban landscaped vegetation, introduce pets and children to adjacent more sensitive habitats, and restrict wildlife access to and through adjacent wetlands. The proposed project is not sufficiently buffered from adjacent lagoon/ riparian area. If the project is to be served by the proposed Lux Canyon Waste Treatment Facility, a pipeline and trench would have to be constructed across especially sensitive habitats to serve the project. Development of the site to the same number of units in a clustered pattern with peripheral open space adjacent to the ecological resource areas would substantially reduce potential impacts compared to the proposed project. Such a redesign would also reduce the need for extensive house pad grading on lots with steep topography and reduce siltation impacts to the wetlands. - 4 - RO83 -17 Mitigation: See Mitigation for Grading /Sedimentation 4. Archaeology Impacts: Implementation of this project will result in the destruction of five significant archaeological sites thought to be 1500 to 7000 years old. These coastal shell mound sites are rapidly disappearing as a result of high density develop- ment in the coastal strip. Three very important shell midden campsites, a buried shell lens (strata), and a surface scatter site are involved: (1) W -1633, 4000 square meters, contained flakes, manos, cores, Chione shell, midden. Thought to be eligible for inclusion on the National Register; (2) W -2167, 2 meters long in arroyo cut, contained Chione shell. Could be a buried kitchen area, (3) W -2168, 10,000 square meters, contained manos, flakes, scrapers, and oven rocks. Plowing has thinned the midden, but pockets may exist to considerable depth; (4) W -2170, 16000 square meters, one mano, two metate frag- ments, one hammerstone, and one piece of shell. The question of depth needs to be resolved by testing; (5) W -2924, 9100 square meters, contained manos, scrapers, cores, hammerstones, and shell. The midden has a depth of at least 80 cm. Staff believes that sites W -2168 and W -2024 are also eligible for inclusion on the National Register, although this status will be lost when they are graded. Mitigation (from Board of Supervisors TM 4254 Resolution) A qualified archaeologist shall to the satisfaction of the Environmental Analysis Coordinator: (1) Conduct surface collections, micro - mapping or controlled grid collection, and test excavations to (1) ascertain primary midden area, (2) depth of midden, (3) scientific uniqueness and significance at W -1633, W -2167, W -2168, W -2170 and W -2924; (2) Submit a research design for those sites to be salvaged; (3) Upon receiving approval on the research design, commence salvage excavation and submit a report of the Environ- mental Analysis Division. - 5 - RO83 -17 5. Sewer Availability Impact: Sewer service is currently unavailable in the Cardiff Sanitation District, due to a moratorium. The Department of Public Works has informed the applicant that this project does not qualify for a sewer connection. The applicant hopes to tie into the Lux Canyon Water Reclamation Facility. Mitigation: (from Board of Supervisors TM 4254 Resolution) Prior to approval of the final map, the developers, through SO -Cal Development, Inc., shall provide a secured line of credit to assure that the Lux Canyon Water Reclamation Facility will be funded and constructed. In addition, nominal connection fees in the form of instrument of credit shall be provided to the Cardiff Sanitation District for a period of eighteen (18) months to cover expenses for connection to and use of the San Elijo Water Pollution Control Facility. This is necessary to both retreat water during a one -year trial period and to provide approved treatment in the event the Lux Canyon Water Reclamation Facility should fail to operate as designed. The unused portion of the connection fees shall be refunded to SO -Cal Development, Inc., and other developers, following one -year of successful operation of the Lux Canyon Water Reclamation Facility as determined by the Cardiff Sanitation District. 6. Traf f i c Impacts: This project will add 333 ADT to the existing 1200 ADT, a 25% increase to traffic on El Camino Real. Another problem is sight distance along this highway. E1 Camino Real is only 20 feet wide and although under design capacity, this increase will be significant. Staff is also concerned that mitigation cannot be fully achieved since the property does not front on El Camino Real. There was considerable discussion as to alternative access routes at the ERB. Mr. Kern indicated that access off La Orilla Road was rejected due to potential impacts to southern salt marsh habitats. The same problem would occur if access were to cross Encinitas Creek. These impacts were not addressed in the EIR nor were they in the alternatives section.
