The OWNERS, any lenders, and their successors and assigns shall have no liability or responsibility whatsonever for maintaining or improving the easement area or any improvements within the easement area. C. CITY agrees to properly and safely maintain the trails and related improvements to a level satisfactory to serve sufficiently the public need. Construction and maintenance activities include, but are not limited to, work on, below, and above the surface of the easements. D. The CITY shall have no right to assign or grant this easement to any person or entity without the prior written consent of OWNERS and their successors or assigns. The OWNERS and their successors or assigns shall have no obligation to grant this consent and may deny this consent, in their sole discretion. This section shall not apply to successors in interest of the CITY. E. As a material term of this easement, the CITY shall refrain and to the extent reasonable ensure that the public uses the easement in a manner which does not create any private or public nuisance and in a manner which does not damage or harm the PROPERTY or interfere with the quiet enjoyment or the PROPERY by OWNERS or their successors and assigns. F. As a material term of this easement, the CITY agrees to hold harmless, indemnify, and defend the OWNERS, any lender loaning the OWNERS or any successor or assigns any sum secured by any trust deed or other interest in the PROPERTY, claims, causes of action, actions, losses, damages, fines, penalties, fees, costs, and expenses, of whatever type or nature, including all attorney's fees, expert fees and costs, and court costs incurred by any of the indemnified parties arising from a defence of any such claim or action, except claims and causes by the negligence or intentional misconduct of the indemnified parties. G. In the event of any action or proceeding to interpret, enforce, or invalidate any term of this easement, venue shall lie only in the North County Judicial District, County of San Diego. For valuable consideration of an exchange of an existing recreational trail location, OWNER hereby grants to the City of Encinitas ("CITY" hereinafter), (for the benefit of CITY), easements across PROPERTY located as described in Exhibits "A" and "B", which are attached hereto and made a part hereof, for Public Recreational Trail purposes which include, without limitation, use by members of the public to walk, jog, run, ride horses, and operate non-motorized bicycles. However, no motorcycles or other motor vehicles shall be permitted on the trails with the exception of emergency and maintenance vehicles. B. As a material term of this easement, the CITY shall be solely liable and responsible at all times for the maintaining the easement area and all trail improvements in the easement area in a good and safe condition for the CITY's intended purpose at the CITY's sole cost and expense. The OWNERS, any lenders, and their successors and assigns shall have no liability or responsibility whatsonever for maintaining or improving the easement area or any improvements within the easement area. C. CITY agrees to properly and safely maintain the trails and related improvements to a level satisfactory to serve sufficiently the public need. Construction and maintenance activities include, but are not limited to, work on, below, and above the surface of the easements. INTRODUCTION In accordance with your request we have performed a soils and geologic investigation of the — project for the construction of an emergency access road between Double LL Ranch Road in the City of Encinitas and Paseo Esmerado in the City of Carlsbad(see Site Location Map,figure 1). The purpose of this investigation was to evaluate the grading and construction of an access road, storm drain and structures between Double LL Ranch Road and Paseo Esmerado and to provide grading,pavement design and construction recommendations for the subject project. SCOPE The scope of our investigation included the following tasks: • Review of the readily available published and unpublished reports and documents relative to the subject site • Geologic reconnaissance and mapping of the site • Logging and Sampling of three hand auger borings • Laboratory analysis and testing of representative samples • Engineering and Geologic Analysis of the field and laboratory data • Preparation of this report presenting our findings,conclusions and recommendations regarding site conditions, site grading and recommendations for pavement design 3 0 6 0 INDUSTRY ST S U I T E 1 0 5 0 C E A N S I D E _ C A 9 2 0 5 4 TEL: 760.721.5488 FAX: 760.721.5539 GEOI�°�C G E O i E C M N I C A L C O N S U L i A N i 5 GENERAL SITE CONDITIONS The subject property is located west of Lone Jack road; along the northern side of the intersection — of the newly constructed Calle Margarita and Double LL Ranch road, in the City of Encinitas. The project area consists of gently sloping terrain with several incised ravines. Vegetation is light with heavy brush located along the ravines and canyon. Drainage is by sheet flow and is directed to the west-trending canyon by ravines. PROPOSED DEVELOPMENT — The project consists of the construction of a 22-foot wide emergency access road between Double LL Ranch Road and Paseo Esmerado. As part of this construction the site will be graded creating cut and fill slopes of up to 10-feet in height. Construction of an 18-inch storm drain with headwalls beneath the future road is planed near the connection with Paseo Esmerado. SITE INVESTIGATION As part of our investigation we have logged and sampled three exploratory test augers to a maximum depth of 5 feet along the proposed alignment(Figure 2 and Appendix A). — LABORATORY TESTING The field classification was verified through laboratory examination, in accordance with the — Unified Soil Classification System. The following laboratory tests were performed: 0 Direct Shear(ASTM: D 3080) -The test indicated a o=24 and c=250psf • Maximum Density— 116lbs. @ 12.5% Moisture • Expansion - UBC index of 90(Highly Expansive) SOIL AND GEOLOGIC CONDITIONS Soils encountered on-site during our investigation consisted of alluvium/colluvium and — sandstone/siltstone formational deposits. A brief description of each of the soils and geologic units encountered is provided below. Alluvium/Colluvium These deposits are composed of dark brown sandy clay and silty clay,which have been deposited by water and wind. Sandstone/Siltstone Formational Material These pale green and green sandstone and siltstone units appear to be part of the Del Mar Formation and underlie the entire roadway area. The unit consists of interbedded siltstone and sandstone. The proposed cut slope appears stable at this time but will have to be evaluated during grading. GEOPACIFI(A G E O l E C H N I C A L C O N S U L T A N T S Groundwater No evidence of groundwater was observed at this time. However, groundwater and perched _. water conditions can develop after the construction is complete and can result from very heavy rainy seasons and the addition of irrigation. Landsliding and Slope Stability Based upon our review of pertinent documents and our reconnaissance there are no indications of deep-seated landsliding on or adjacent to the subject site. It appears that the cut slope proposed at the north side of the western end of the access road would be grossly stable. If the cut is excavated in the claystone portion of the formational or exposes the clayey colluvium/alluvium there may be a surficial stability problem. This will be evaluated in the field during grading. Faults/seismicity -- Based upon a review of published geologic maps there are no active faults located on or in the immediate vicinity of the project. The nearest active fault is the Rose Canyon Fault Zone located approximately 8.0 miles southwest of the site. There are other active faults from 14 to 65 miles from the site,which could affect it. The site will be affected by high to moderate groundshaking as a result of an earthquake from any of these faults. CONCLUSIONS AND RECOMMENDATIONS Conclusions 1. Based upon the results of our geologic reconnaissance, subsurface investigation, laboratory testing and our experience in this area it appears that no significant geotechnical conditions were observed which would preclude construction of the access road or associated improvements. However,certain geotechnical conditions will require special consideration during the grading and construction phases. 2. The subject property of underlain by variable depths of soil and weathered rock deposits. These deposits may not be suitable for support of the roadway and improvements. 3. Since most of the soil available onsite is expansive, select import soil will be required for the proposed segmented walls. 4. It is anticipated that using the onsite materials for compacted fill will result in an expansion potential in the high range. This will affect the wall and pavement design and any concrete flatwork or structures. 5. Post construction seepage and/or saturated ground can adversely affect pavement,concrete and walls and slopes. Special consideration should be provided for surface and subsurface drainage during the design and construction phases. Additional recommendations during the grading phase may be necessary. 7GEOPAC G E O i E C H N C A L C O N S U L T A N TS Recommendations-Grading The existing soil deposits existing within the roadway alignment are not suitable for support of additional fill. All areas to receive fill and to 5 feet beyond the fill limits should be removed and recompacted to a depth of 4-feet.Wherever a fill slope is proposed a 15-foot wide key excavated a minimum of 2 feet into formational rock at the outside edge of the keyway should be graded. Removals and keying in the areas of the existing 18-inch RCP storm drains will have to be evaluated in the field during grading. Where cuts are less that 4 feet below finish grade and do not expose bedrock material,an additional 2-4 feet of removal and recompaction may be necessary. Fill should be placed in 6 to 8 inch loose lifts, moistened to 2-3 percent above optimum moisture, and compacted to a minimum of 90 percent of the laboratory maximum dry density. Additional recommendations will be presented should any unforeseen conditions be encountered during grading. Recommendations-Paving It is our understanding that you desire to have an all-weather durable pavement surface that does not consist of Asphaltic Concrete or Portland Cement Concrete. It is our recommendation that the roadway consist of either 6-inches of cement treated base(per Greenbook Specifications)compacted to 95%relative compaction founded on 12-inches of fill compacted to 95%relative compaction or bedrock scarified, moisture conditioned and compacted to 95%relative compaction to a depth of 12-inches.An alternative to this design would be 8-inches of decomposed granite(Class III Base)mixed with 6-7%by weight portland cement concrete and compacted to 95%relative compaction founded on 12-inches of fill compacted to 95% relative compaction or bedrock scarified,moisture conditioned and compacted to 95%relative compaction to a depth of 12-inches. LIMITS OF INVESTIGATION The analyses,conclusions and recommendations contained in this report are based on site -- conditions as reported by others and as they existed the time of our investigation, and further assume that the excavations to be representative of the subsurface conditions throughout the project site. Our investigation was performed using the degree of care and skill ordinarily exercised, under similar circumstances,by reputable soils Engineers and Geologists practicing in this or similar localities.
