PHASES 2 THROUGH 6 CONDOMINIUM PLANS
THIS AMENDMENT TO CAMBRIA AT ENCINITAS RANCH PHASES 2 THROUGH
6 CONDOMINIUM PLANS ( "Amendment ") is made as of the ,S - Fh day of June, 1998, by
Green Valley Associates II, LLC, a California limited liability company ( "Record Owner ") and
K/B Opportunity Fund IV, L.P., a Delaware limited partnership ( "Lender "), with reference to the
facts set forth below.
RECITALS
A. Condominium Plans for Cambria at Encinitas Ranch Phases 2 through 6 were
recorded on September 26, 1997 as Instrument No. 1997- 0477916 and March 11, 1998 as
Instrument No. 1998- 0132385 (Phase 2), September 30, 1997 as Instrument No. 1997- 0484531
and June 4, 1998 as Instrument No. 1998 - 0336294 (Phase 3), November 7, 1997 as Instrument
No. 1997- 0563416 (Phase 4), December 22, 1997 as Instrument No. 1997- 0652042 and re-
recorded March 11, 1998 as Instrument No. 1998- 0132386 (Phase 5) and March 23, 1998 as
Instrument No. 1998- 0154630 (Phase 6) in the Official Records of the San Diego County Recorder
(the "Condominium Plans ").
B. The undersigned, being all of the record owners of, and record holders of security
interests in the property described in the amended Condominium Plans, hereby certify their
consent to the recordation of this Amendment pursuant to the provisions of Section 1350 et seq.
of the California Civil Code.
NOW, THEREFORE, the Condominium Plans are amended as set forth below.
1. Defined Terms Except as otherwise defined herein, all capitalized terms used
herein shall have the same meaning as set forth in the Condominium Plans.
2. Common Area The last sentence of the definition of "Common Area" on page 2,
paragraph 3 of each of the Condominium Plans contained a typographical error by referring to the
"lower" vertical boundary of the subject module. The word "lower" is hereby deleted and
replaced with the word "upper" in each of the Condominium Plans.
3. . Effect of Amendment Except as modified hereby, the Condominium Plans remain
in full force and effect, in accordance with its terms. From and after the date of this Amendment,
all references to the Condominium Plans shall be deemed to refer to the Condominium Plans, as
amended by this Amendment.
4. Counterparts This Amendment may be executed in counterparts, all of which
when taken together, shall constitute one complete original hereof.
