as owner entered into a "Lien Covenant Regarding Real Property: Improvements Required as
Condition on Final Approval of Subdivision of Real Property" as Document No_ 2008-0522123
recorded October 3, 2008_ The Covenant detailed the requirement for the construction Of public
improvements for the benefit of the San Dieguito Water District for the property located at 1320
and 1340 Encinitas Boulevard, Encinitas California_ The public water improvements included 425
feet of 8"PVC main line extension, fire hydrants and other appurtenances_
2_ Bank of America National Trust and Saving Association granted a portion of said property
to VVal green Company, an Illinois corporation,thereby also being assigned as owner_
3. The plans and specifications for said improvements are On file at the District office_
4. Said improvements were completed by the owners and accepted by the San Dieguito Water
District Board c f Directors on the 16"'day Of December, 2009_
5. Walgreens Company, an Illinois corporation, posted security in the amount of $78,513_
Seven-five percent (75 13,16) Of the security has been released_ The District will retain twenty-five
percent (25%) of the security in the amount of$19,628. This Security will be released at the end of
the one-year warranty period_
6_ All requirements o£said Covenant have hereby been satisfied except for warranty_
7_ Neither acceptance Of said improvements by the Board of Directors nor this Notice
constitute a waiver of any defects in the work of the construction or installation o£ said
improvements_
