BACKGROUND: Similar to a jurisdiction that receives federal housing and community development funds and its requirement to prepare and approve a five-year Consolidated Plan, a housing authority must prepare and approve a five-year Public Housing Agency Plan to receive federal housing funds for its use in providing assistance to residents. Both the Consolidated Plan and the PHA Plan require a jurisdiction to also prepare and approve one-year action plans implementing the goals and objectives identified in the five-year plans. Section 511 of the Quality Housing and Work Responsibility Act of 1998 created the public housing agency five-year and annual plan requirement. The five-year plan describes the mission of the agency and agency’s long-range goals and objectives for achieving its mission over a five-year period, and its approach to managing programs and providing services for the upcoming year. In November 2008, the U.S. Department of Housing and Urban Development (HUD) issued a notice that provides administrative relief for small public housing agencies that are performing well. A qualifying small public housing agency is defined as not exceeding more 550 combined units of Section 8 vouchers and public housing, and does not have a failing score under an annual Section 8 Management Assessment Program (SEMAP) review. The Encinitas Housing Authority (EHA) qualifies as a small agency with only 136 Section 8 vouchers and a high performing SEMAP rating. Although qualifying small public housing agencies must prepare, approve and submit a five-year PHA Plan, the agencies are not required to submit annual action plans. HUD has provided a form for the preparation of the PHA Plan and only requires the first five sections to be completed. ANALYSIS : The draft PHA Plan (Attachment A) was noticed and made available to the public for at least 45 days for review and comment. No comments have been received. The PHA Plan must be submitted to HUD no later than 75 days prior to the end of this fiscal year. As described in the draft PHA Plan, the EHA will continue to serve the needs of lower income households within the City of Encinitas. The PHA Plan’s goals and objectives are contained within three broad themes: Efficiency and effectiveness; leveraging and expansion of services; and, ensuring fair housing. Efficiency and Effectiveness HUD requires a utilization rate of 95 percent. Utilization is the agency’s use of HUD’s voucher allocation or budgeted funds. The EHA will strive to achieve at least a 98 percent utilization rate and continue to be a high performer based on the annual SEMAP review. Leveraging and Expansion of Services The EHA owns 16 units for lower income households and will pursue a 95 percent occupancy rate. Additionally, a tenant-based rental assistance program funded with other federal housing funds provides the opportunity to assist more lower income households with their rent. These households are selected from the top of the EHA waiting list. Ensuring Fair Housing The EHA, through other City housing programs, will continue to retain a fair housing administrator for fair housing information and assistance. Additionally, the EHA will participate, in conjunction with other City housing events, in fair housing events and promote and further fair housing awareness. The draft PHA Plan also identifies the EHA’s past five-year performance on goals and objectives. The EHA met all of its goals and objectives. FISCAL AND STAFF IMPACTS : There are no fiscal or staff impacts to the recommended actions. HUD provides funding to the EHA for rental assistance payments and staff administrative costs. RECOMMENDATION : Conduct a public hearing on the proposed FY2010-15 Public Housing Agency (PHA) Plan; approve the FY2010-15 PHA Plan as drafted in Attachment A of this report; and, authorize the Executive Director to submit the FY2010-15 PHA Plan with any required certifications to the U.S. Department of Housing and Urban Development.
