VI%HERt;AS, pursuant to the C'ortese-Knox Loczl Government R.urganization Act of
1Lf 85 (Guvt. l'ude, Scction 5600 et seq.) preliminary proceedings were commenced by resoiution
uf application by this E3oard on February 23, 2000, as Resolution No. 2000-03, fax annexation to
the Cardiff Sanitation Jistrict (thereafter referred to as the District) of :ertain territory therein
ciescribed, which description has been modified pursuant to the directions of the Local Agency
Fonn;ation Commission; and
WHF R'r.AS, the annexation propused by said resolution of application was presented to
and approved by the Local Agency Furmation Commission of San Diego County on June 12,
?000 ana this District was designated as the conducting District and authorized by resolution of
orcfcr said aiinexatiun without notice or hearing and without an election pursuant to Govemment
t.:oc'.e, Sectioti 56837;
~ NOW, "I'HERE:FOitE, IT IS RESOLVEU, ORDERED AND DETERMINED, pursuant
to Guvernment CucJe Section 57025 et seq.;
a. T'he manner in wnich and by whom preliminary proceedings were commenced
was by reso!ution of application by this Board as stated above.
b. "I'hc territory to he annexed has bee>> designated DA 00-03 by the Local Agency
Formation Conunission, and the exterior boundaries of such territory are as
hereinafter described.
c. Thr territory proposed to be annexed is uninhabited and will be benefited by
such ar.nexation as rlescribed in Health and Safety Code Section 4830.
d. The reasons tiir the proposed annexation as set forth in the resolution of
application rc;ferred to above are:
I. Thc District is cmpoNvered to and is engaged in furnishing sewage
clisposal facilities.
2. Thc tcrritory pmposed to be annexcd to said District is developed and/or
proposcd to be devcloped and used for reside.ntial and/or commercial
~ purposes and provision }'or srivage disposal facilities for said territory is
csscntial fc,r such purposes.

e. 'I'he terms and conditions of tiie proposed anne:cation are: Payment of State
l3oard of Equaiization fees.
~ All the owijers of land within such territc,ry have given their written consent to
such annexation, as pravided in Gavernment Code, Section 56837; and there;ore,
as approved and authorized H• the Local Agency Forrnation Co►nmission, this
I3uard may aciopt its resolutiiln ordering the annexation without notice and
hearing atid without illl elCCill`Il, 1s provided in Government Code, Section
57002.
g. 'I'he regular County assessment role will be utilized and the affected territory will
not he taxed for existing bonded indebtedness.

Section 57002, the tiollowing described incorporated territory in the City of Encinitas, State of
Calilurnia, bc and it hereby is annexed to and made a part of the Cdrdiff Sanitation Bistrict.
