BACKGROUND•
Ordinance 2001-02 suthorizes the District Engineer ta mmke exceptions to requiremcats
and standa:ds related to the installAtion and maintcnance of sewer fscilities. T6is
erdinance would oaty allo°• such exceptions after the District Engineer issues a fiading nf
practicality und consistency with the intent of thc Code .o the City Manager. T6e
ordinance also authorizes the Aistrict Eagineer to impose conditions as any e:ceptions to
preserve t6mt intent. The Board introduced Ordinance 2001-02 on August 29. 2001
RECOMMENDATION:
Adopt OrJinance 2001-02.

Ord'enance 2001-02 aathoriaes t6e District Engineer to make cxceptions to requiremeats
and standards related to the installation and mmeotcoance of sewer facilities. This
ordiaance would only al4aw such exceptions after the Disirict Enganeer issues a 5nding of
practicality and consistency with the intent of the CcKf+e to tihe City Manager. The
ordinance also authorizes the District Engineer to impose conditioos on any exceptioc+s to
preserve that intent. The Board intraduced Ordinance 201-02 or, Augvst 29. 2001
RECOMMENDATION:
Adopt Ordinance 2001-02.

~ P1ease note tFat the ordinance authorizes suc6 exceptions only after the iD:strict Enginrer
issues a finding of practicality and corsistenry with the intcat of the Code to the City
Nlanager. The ordinance also authorizes tiee Di.ctrict Engineer to Ympose conditiens on any
exceptions to preserve that intent. If you should approve the ordinance it would becomc
effective 30 days after secamd readiag.
Finally, atter t6e new City Engineer is on boas•d, my office intends on ercodifying t6is
ardinanee 4a sddcess specitic ciicurnstanees ::•arran:iag ezcepiians to e:t6er requi-cmeats
or standards. Until that fime, t6is ordinance would serve to "fiil the gap^ wherc 3uc6

A uew section 18.16.125 is 6ereby added to the Cardiff Sanitation District Ccrde to rcad as
follows:
"18.16.125 RRquirements and 5tandards - District Engineer authorization
The District Engineer may autluorize exceptions to requirements aad stacaalards contaiaed
in this Chapter subsequeut to issuing a finding of practicaliry aad subaeantial consisteme}•
with the intent of t6is Code to the 4^ity Manager. The District Enginesr may imposR
conditioas on aay said exceJption necessary to preserve the intent of t6is Code."
