Dear Mr. Schnoebelen: In accordance with your request, this report has been prepared to summarize the result of the in -place density tests performed in the seawall backfill at the subject site by Southern California Soil & Testing, Inc. The backfill tested was located approximately at the lower half of the slope situated between the upper and lower walls. These tests were performed between June 21 and July 6, 1995. Field density tests were taken in accordance with ASTM 132922 -91 under the direction and at the location chosen by our field representative. The results of these tests are shown on the attached Plate Number 2. Maximum dry density determinations were performed on representative samples of the soil used in the compacted backfill according to ASTM D1557 -91, Method A. The results of this test, as presented on Plate Number 2, were used in conjunction with the field density tests to calculate the percent of relative compaction of the compacted backfill. The backfill material was placed by means of a conveyor system and compacted by "jetting." The jetting operations were approved by our firm to be an adequate means for compaction and the aforementioned material was approved as suitable for "jetting." The contractor shall properly grade all excavated surfaces to provide positive drainage and prevent ponding of water. He /she shall control surface water and avoid damage to adjoining properties or to finished work on the site and shall take remedial measures to prevent erosion of freshly graded areas until such time as permanent drainage and erosion control measures have been installed. 3. All areas to be filled shall be prepared to be filled and fill shall be placed in accordance with standard specifications. All vegetable matter and objectionable material shall be removed by the contractor from the surface upon which the fill is to be placed. Loose fill and alluvial soils shall be removed to suitable firm natural ground. The exposed soils shall be scarified to a depth of 6" and then compacted to a minimum of 90 percent. It shall be the contractor's responsibility to place, spread, water and compact the fill in strict accordance with specifications. 4. Cut and fill slopes shall be cut and trimmed to finish grade to produce smooth surfaces and uniform cross sections. The slopes of excavations and embankments shall be shaped, planted and trimmed as directed by the engineer of work and left in a neat and orderly condition. All stones, roots and other waste matter exposed or excavation or embankment slopes which are liable to become loosened shall be removed and disposed of. The toe and top of all slopes shall be rounded in accordance with the Grading Ordinance. 5. Offending vehicles will be cited and towed. 18. Any entrance gates used to gain access through the Publc Beach area shall be immediately locked after access. The proposed winter season berm and drainage system of Moonlight Beach State Park, when constructed, shall be maintained in good working order on a continuous basis, and any breach to the berm due to the operations of the permittee shall be properly filled or sandbagged before the end of the current low tide period. Any sand loss or damage resulting from the failure to maintain the winter berm will be at the expense of the Contractor to restore or repair, respectively. 21. Schnoebelen DESCRIPTION OF ENCROACHMENT PERMIT AND PERMITTEE's DUTIES AND OBLIGATIONS 1.0 LOCATION OF ENCROACHMENT AREA The location of the beach access encroachment area is depicted on the map which is contained in Attachment B to this Covenant. 2.0 PURPOSE OF ENCROACHMENT: The purpose of the beach access encroachment permit is to entitle PERMITTEE to use the PUBLIC'BEACH RECREATIONAL AREA as required for the construction of the seawall at the PROJECT SITE. 3'.0 USE OF PUBLIC BEACH RECREATIONAL AREA 3.1 PERMITTEE shall submit to the City Engineer a written proposal setting forth the day[s], hours] and safety conditions in accordance with which PERMITTEE proposes to use of the PUBLIC BEACH RECREATIONAL AREA during the construction of the seawall. 3.2 The CITY's Engineer shall expeditiously issue written direction setting forth the day[s], hour[s] and safety conditions reasonably necessary to protect the public from PERMITTEE's use of the PUBLIC BEACH RECREATIONAL AREA during the construction of the seawall. 3.3 PERMITTEE agrees not to go upon or use the PUBLIC BEACH RECREATIONAL AREA for any purpose involving the construction of the seawall at the PROJECT SITE on any day or at any hour, except in complete conformance with the terms and conditions of this Covenant which includes the written directions signed by the CITY's Engineer. 4.0 TERM OF ENCROACHMENT PERMI This COVENANT shall be effective upon its execution by the CITY and shall remain in effect until canceled by the CITY. 5.0 OTHER PROVISIONS In consideration of CITY's execution of this Covenant: 5.1 PERMITTEE waives the right to object to the formation of any geologic hazard abatement district, assessment district or maintenance district which includes within its boundaries the cov 4218 Version: March 9, 1994 11:40 Page 6 DOMINANT ESTATE and which concerns sand replenishment or the stabilization of the DOMINANT ESTATE property. 5.2 PERMITTEE agrees that if and when the CITY or a special district determines that it is necessary for the DOMINANT ESTATE to participate in a project which addresses the stabilization of the DOMINANT ESTATE property, the PERMITTEE shall either construct the project or pay PERMITTEE's fair share of the cost to construct such project. 5.3 PERMITTEE agrees not to develop in any manner the DOMINANT ESTATE except as authorized by CITY's ordinances and then only in accordance with issued permits. Among other things, but without limitation, this shall prohibit the alteration of land forms and the erection of structures of any type, except as permitted or authorized by CITY. 6.0 ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS AND POSSIBLE CONSEQUENCES: WAIVERS 6.1 ASSUMPTION ON RISKS BY PERMITTEE. PERMITTEE acknowledges and assumes the risk that: a. the design, construction, maintenance, or functioning of the seawall may not result in the stabilization of the DOMINANT ESTATE and may result in the destabilization of the DOMINANT ESTATE and may otherwise cause damage to the DOMINANT ESTATE, the public beach, persons, adjacent public or private property, or other property; b. The use of the PUBLIC BEACH RECREATION AREA as set forth in Part 3.0 herein above, may result in the destabilization of the DOMINANT ESTATE and may otherwise cause damage to the DOMINANT ESTATE, the public beach, persons, adjacent public or private property, or property in the vicinity; and C. Aspects of the seawall project may be judicially challenged by third parties. 6.2 WAIVER OF CLAIMS AGAINST CITY. For claims that are alleged to have arisen, directly or indirectly, from the plans, design, construction, maintenance, functioning or failure of the seawall or from the use of the PUBLIC BEACH RECREATION AREA as set forth in Part 3.0 herein above, PERMITTEE unconditionally waives all present and future claims against CITY and CITY's officers, officials, employees, and agents. 6.3 PERMITTEE's waiver herein includes, but is not limited to, claims concerning PERMITTEE's use of the PUBLIC BEACH RECREATION AREA; alleged defects in the plan, design, construction, maintenance, or functioning of the seawall; alleged defects in the materials furnished in the construction of the seawall; alleged injury to persons or property allegedly caused by, or in any way related to, the seawall or PERMITTEE's use of the PUBLIC RECREATION AREA; or any alleged inverse condemnation of property as a consequence of the design, construction, maintenance or functioning of the seawall. This Section is expressly not intended to act as Version: March 9, 1994 11:40 Page 7 a limitation to the broad waiver set forth in Section 6.2. . 6.4 PERMITTEE agrees that for claims that are alleged to have arisen, directly or indirectly, from the CITY's efforts to assist PERMITTEE in constructing a seawall or using the PUBLIC BEACH RECREATION AREA, PERMITTEE unconditionally waives all present and future claims against CITY and CITY's officers, officials, employees, and agents. 6.5 PERMITTEE's waiver set forth in Sections 6.2, 6.3 and 6.4 does not apply to claims that are alleged to have arisen out of the sole, active negligence or deliberate, wrongful act of CITY. 6.6 It is further understood and agreed that all of PERMITTEE's rights under § 1542 of the Civil Code of the State of California and any similar law of any state or territory of the United States are hereby expressly waived with respect to claims against CITY and CITY's officers, officials, employees, and agents relating to the seawall or the use of the PUBLIC BEACH RECREATION AREA. Section 1542 reads as follows: 1542. Cer tain claims not affected by creneral release. A general release does not extend to claims whic the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor. 7.0 ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS AND POSSIBLE CONSE UENCES: INDEMNIFICATION AND HOLD HARMLESS 7.1 PERMITTEE TO INDEMNIFY AND HOLD CITY HARMLESS. PERMITTEE agrees to indemnify and hold CITY and CITY's officers, officials, employees and agents harmless from, and against any and all liabilities, claims, demands, causes of action, losses, damages and costs, including all costs of defense thereof including attorneys' fees, arising out of, or in any manner connected directly or indirectly with, any acts or omissions of PERMITTEE or PERMITTEE's agents, employees, subcontractors, officials, officers or representatives in respect to the seawall or the use of the PUBLIC BEACH RECREATION AREA. Upon demand, PERMITTEE shall, at its own expense, defend CITY and CITY's officers, officials, employees and agents, from and against any and all such liabilities, claims, demands, causes of action, losses, damages and costs. 7.2 PERMITTEE agrees to indemnify and hold CITY and CITY's officers, officials, employees and agents harmless from, and against any and all liabilities, claims, demands, causes of action, losses, damages and costs, including all costs of defense thereof including attorneys' fees, arising out of, or in any manner connected directly or indirectly with, the CITY's efforts or actions to assist PERMITTEE in the seawall construction. 7.3 PERMITTEE's indemnification and hold harmless obligation herein includes, but is not limited to, claims concerning alleged defects in the plans, specifications and design of the seawall; but does not extend to liabilities, claims, demands, causes of action, Version: March 9, 1994 11:40 Page 8 • losses, damages or costs that arise out of a defect in the plans, specifications or design that is a result of a change required by CITY to the PERMITTEE's proposed plans, specifications or design so long as such change is objected to, in writing, by PERMITTEE, and the writing is filed with the City Engineer more than ten days prior to the commencement of work. 7.4 PERMITTEE's indemnification and hold harmless obligation herein includes, but is not limited to, claims concerning PERMITTEE's use of the PUBLIC BEACH RECREATION AREA; alleged defects in the plan, design, construction, maintenance, or functioning of the seawall; alleged defects in the materials furnished in the construction of the seawall; alleged injury to persons or property allegedly caused by, or in any way related to the seawall or PERMITTEE's use of the PUBLIC RECREATION AREA; or any alleged inverse condemnation of property as a consequence of the design, construction, maintenance or functioning of the seawall. This Section is expressly not intended to act as a limitation to the broad indemnification and hold harmless provisions set forth in Sections 7.1, 7.2 and 7.3. 7.5 By approving the improvement plans, specifications and design or by inspecting or approving the seawall or the use of the PUBLIC BEACH RECREATION AREA, CITY shall not have waived the protection afforded herein to CITY and CITY's officers, officials, employees and agents or diminished the obligation of PERMITTEE who shall remain obligated in the same degree to indemnify and hold CITY and CITY's officers, officials, employees and agents, harmless as specifically provided above. 7.6 PERMITTEE's obligation herein does not extend to liabilities, claims, demands, causes of action, losses, damages or costs that arise out of CITY's intentional wrongful acts, CITY's violations of law, or CITY's sole active negligence. 7.7 The CITY herein expressly does not waive any defenses, immunities or other protections from liability afforded to the CITY by the laws of the United States or the State of California, to include without limitation, the California Government Code. Actual staff time and accounts payable expenditures are recorded to an assigned project code for each applicant requested service. A 67% administrative overhead surcharge is also applied to all services. Applicants are also requested to provide deposit amounts based on guidelines approved in City ordinances. If plan check costs exceed deposits, the applicant shall pay the outstanding balance prior to permit issuance. Public improvement projects (i.e., road construction, sewer main extension, etc.) require the retention of a 25% warranty of the project cost estimate for a one -year period following the date of acceptance. The contractor shall design, construct and maintain all safety devices, including shoring, and shall be responsible for conforming to all local, state and federal safety and health standards, laws and regulations. 8. Grading and equipment operating within 1/2 mile of a structure for human occupancy shall not be conducted between the hours of 5:30 p.m. and 7:30 a.m. nor on Saturdays, Sundays and City recognized holidays unless in conformance with a work schedule approved by the Director of Engineering Services and Superintendent of Parks and Beaches. 9. No grading operations shall commence until a pregrading meeting has been held onsite with the following people present: Engineering Inspector, Assistant Planner, Lifeguard Supervisor, Civil Engineer, Soils Engineer, Grading Contractor, and Permittee. The pregrade meeting shall be scheduled with the City at least 48 hours in advance by calling (619) 633 -2770. 10. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. 11. Upon final completion of the work under the grading permit but prior to final grading approval and /or final release of security, an as- graded certification shall be provided stating: "The grading under Permit No. 4283 GI has been performed in substantial conformance with the approved grading plan or as shown on the attached as- graded plan ". This statement shall be followed by the date ands signature of the Civil Engineer who certifies such grading operation. B. NOTIFICATIONS 1. The existence and location of underground utility piPes and structures shown on these plans were obtained by a search of available records. To the best of our knowledge there are no existing utilities except as shown on these plans, however: The contractor is required to take due precautionary measures to protect any existing pol4566 2 utilities or structures located at the work site. It is the contractor's- responsibility ! to contact the following: owners of said utilities or structures prior to any excavation, for verification and location of utilities and notification of commencement of work: a. Phone: (619) 633 -2770. All work performed without benefit of inspection will be subject to rejection and removal. C. GRADING 1. All grading shall be observed and tested by a qualified soils engineer or under his /her direction. He /She shall observe and test the excavation placement and compaction of fills and backfills' and compaction of trenches. He /She shall submit soils reports as required and will determine the suitability of any fill material. Upon completion of grading operations he /she shall state that observations and tests were made by him /her or under his /her supervision and that in his /her opinion, all embankments and excavations were constructed in accordance with the approved grading plans and that all embankments and excavations are acceptable for their intended use. pol4566 3 2. The contractor shall properly grade all excavated surfaces to provide positive drainage and prevent ponding of water. He /she shall control surface water and avoid damage to adjoining properties or to finished work on the site and shall take remedial measures to prevent erosion of freshly graded areas until such time as permanent drainage and erosion control measures have been installed. 3. All areas to be filled shall be prepared to be filled and fill shall be placed in accordance with standard specifications. All vegetable matter and objectionable material shall be removed by the contractor from the surface upon which the fill is to be placed. Loose fill and alluvial soils shall be removed to suitable firm natural ground. The exposed soils shall be scarified to a depth of 6" and then compacted to a minimum of 90 percent. It shall be the contractor's responsibility to place, spread, water and compact the fill in strict accordance with specifications. 4. Cut and fill slopes shall be cut and trimmed to finish grade to produce smooth surfaces and uniform cross sections. The slopes of excavations and embankments shall be shaped, planted and trimmed as directed by the engineer of work and left in a neat and orderly condition. All stones, roots and other waste matter exposed or excavation or embankment slopes which are liable to become loosened shall be removed and disposed of. The toe and top of all slopes shall be rounded in accordance with the Grading Ordinance. 5. All trees, brush, grass, and other objectionable material shall be collected, piled or otherwise disposed of off the site by the contractor so as to leave the areas that have been cleared with a neat and finished appearance free from unsightly debris. Approval of location of debris fill shall be secured from the soils engineer and City Engineer prior to the disposal of any such material. D. EROSION CONTROL 1. Equipment and workers for emergency work shall be made available at all times during the rainy season_ All necessary materials shall be stockpiled on site at convenient locations to facilitate rapid construction of temporary devices when rain is imminent. 3. Devices shown on plans shall not be moved or modified without the approval of the Engineering Inspector. 4. The contractor shall restore all erosion control devices to working order to the satisfaction of the City Engineer after each run -off producing rainfall. 5. The contractor shall install additional erosion control measures as may be required by the City Engineer due to an uncompleted grading operation or unforeseen circumstances which may arise. 6. The contractor shall be responsible and shall take necessary precautions to prevent public trespass onto areas when impounded waters create a hazardous condition. 7. All erosion control measures provided per the approved grading plan shall be incorporated hereon. 8. Graded areas around the project perimeter must drain away from the face of slope at the conclusion of each work day. 9. All removable protective devices shown shall be in place at the end of each working day when the 5 day rain probability forecast exceeds 40%. Silt and other debris shall be removed after each rainfall. 10. Construction debris is defined as lumber, piling, poles, crates, boxes, containers, and other objects which could be used for construction similar to that being used on the site. The storage status of Contractor equipment within the City limits shall be determined and the location mutually agreed upon prior to access to the Public Beach. Use of Corporation Yards for storage shall be negotiated directly with the Director of Public Works separately from any Permit processing; compensation will be due the City. 8. A solid waste container of sufficient size shall be made available and conveniently accessible to Lifeguard Services so that debris removed from the Public Beach may be immediately and safely stored. This container shall be lockable with a duplicate key given to the Lifeguard Supervisor. Permittee shall be responsible for regular monitoring, maintenance and cleaning of this facility. 9. Permittee shall obtain special permission from the City Council for access and use of the Public Beach on City- recognized Holidays, Sundays, and, between the hours of 7:00 P.M. and 7:00 A.M., Mondays through Saturdays, per Chapter 9.32 of the Municipal Code. 10. Advanced notifications shall be provided to the Office of the Lifeguard Supervisor (619) 633 -2748, a minimum of 48 hours prior to each access period through Moonlight Beach State Park. Notification shall include date (s) , time (s) , equipment types and duration of work. A single notification shall not include more than one week of work at any given time. 11. The access and use of any Contractor vehicle on the Public Beach shall be approved by the Engineering Inspector and Lifeguard Supervisor immediately prior to such access. 12. Permittee shall delineate the accessway through Moonlight Beach State Park to the satisfaction of the Engineering Inspector and Lifeguard Supervisor. When children are present, flagmen will be required to route Contractor traffic. Special consideration will be given when crowds are present, including prohibition of access. 13. Permittee shall not block at any time access to the Public Beach for emergency personnel or vehicles. 14. The operation of Contractor vehicles while on the Public Beach shall be conducted in a reasonable, safe and prudent manner. 15. Prior to hauling dirt or construction materials to any proposed construction site to which access is authorized by this Permit, the permittee shall submit to and receive approval from the Traffic Engineering Division for the proposed haul route. Prior to placement of any concrete product at the base of the coastal bluff, the permittee shall indicate to the Engineering Inspector what methods are to be used to dewater the job site. 17. Staging or repairs of equipment or supplies is prohibited on City Property or right -of -ways. Parking of personal vehicles on the Public Beach will not be- allowed. Offending vehicles will be cited and towed. 18. Any entrance gates used to gain access through the Publc Beach area shall be immediately locked after access. Any ruts or berm damage to sand areas shall be immediately and repeatedly repaired to remove any public safety hazards. 19. Permittee shall restore or replace on a daily basis any signage regulating handicap person's access, or any other signage, disrupted, damaged or destroyed by permittee's operations. Permittee shall repaint and restripe pavement markings as needed. 20. The proposed winter season berm and drainage system of Moonlight Beach State Park, when constructed, shall be maintained in good working order on a continuous basis, and any breach to the berm due to the operations of the permittee shall be properly filled or sandbagged before the end of the current low tide period. Any sand loss or damage resulting from the failure to maintain the winter berm will be at the expense of the Contractor to restore or repair, respectively. 21. Permittee shall remove debris from the Public Beach on a daily basis or within the maximum period of twenty -four hours from when requested to do so by the Lifeguard Supervisor or Engineering Inspector, whichever occurs first. 22. On Fridays preceding weekends when Special Activities are scheduled at Moonlight Beach State Park, Permittee shall cease operations and remove all equipment and personnel from the Public Beach by 5:00 A.M. All roadways, ramps and walkways shall be swept clean. 23. A preliminary review of the failure was performed by ACCUTECH Engineering Systems Inc and a geologic reconnaissance was performed by Michael Hart. These consultant reports are appended to this application. The failure has jeopardized a mid -bluff retaining wall on the southern half of the property. Currently, the bluff is actively sloughing and is a immediate threat to the public on the beach below and the stability of a retaining wall on the property to the north. The applicant also proposes to extend the existing seawall to elevation +36.5 MSL on the northern half of the property. The southern half of the seawall has already been extended to this height. This elevation will match the existing elevation of the walls on adjacent properties. The type of walls proposed are typical of the walls in the area. Both walls are necessary to stabilize the bluff and represent the minimum necessary to mitigate the hazard. PHOTO 1. Photograph one shows the upper bluff portion of the failure. The proposed project will increase the stability of the property to the north. The proposed project will improve public safety. Access for the seawall extension will be from the beach. The upper retaining wall will be constructed from the bluff top on the applicants property. The project has been designed and engineered by licensed professional engineers. The purpose of this study was to describe the engineering geologic characteristics of the sea -bluff and to comment on the suitability of the exposed bedrock units as foundation materials for the proposed retaining walls. The scope of this study included geologic mapping of the sea - bluff, examination and geologic logging of an exploratory pit located near the base of the bluff, and a review of aerial photographs and readily available geologic literature. The scope of work did not include an evaluation of the stability of existing retaining walls or the sea -wall located at the base of the bluff. Site and Project Description The site consists of a gently easterly sloping residential lot with frontage of approximately 50 feet along Neptune Avenue. The rear yard and patio lie near the top 2 edge of an approximately 90 feet high sea -bluff that is supported at the base by an approximately 20 feet high sea wall constructed of reinforced concrete beams and timber lagging. The upper 70± feet of the bluff is partially supported by two tiers of timber retaining walls. The approximate northern half of the two upper walls failed in January of 1995 resulting in a loss of the surficial soils and ground cover, a portion of the rear yard that was supported by the upper -most wall, and a loss of backfill soil behind the wall located at mid - slope. It is proposed to replace the failed walls with engineered tie -back wall systems. It is understood that Accutech Consulting Engineers is currently evaluating several wall design options and are also performing geotechnical studies to determine soil strength parameters for foundation design. General _Geology The site is underlain by Pleistocene -age marine terrace deposits that are correlated with the Lindavista Formation and the Eocene Torrey Sandstone (Wilson, 1972). The nearly horizontal contact between these two units occurs approximately 17 feet above the current beach level, or three feet below the top of the sea -wall (Figure 2). The Torrey Sandstone consists of dense, moderately well- cemented light grey to nearly white medium - grained sandstone. This unit forms the near - vertical lower portion of 3 the sea -bluff that is now protected from marine erosion and supported by the previously described sea -wall. The overlying Terrace deposits consist of compact but essentially uncemented and nearly cohesionless medium to coarse - grained sand. Approximately 300 feet north of the site, the Torrey Sand is overlain by a thinly - bedded clay shale unit that has contributed to large -scale translational landsliding in that area. In order to determine if the shale bed was present on site a shallow observation pit was excavated near the top of the sea -wall (Figure 2b). The top of the Torrey Sand was exposed in the base of the excavation and consisted of dense, well- cemented medium - grained sandstone. An oblique aerial photograph taken in 1971 prior to construction of the sea -wall provides further evidence that the slide -prone clay shale unit is not present along this section of the coast (Figure 3). Bluff Recession A comparison of oblique and vertical aerial photographs taken in 1928, 1953, and 1971, as well as other photographs of adjacent areas, indicate that during the period between 1928 and the present numerous bluff - failures have occurred, chiefly in the terrace deposits. There are at least three principal factors that significantly affect bluff stability in the immediate area of the site: 1. The presence of weakly cemented to uncemented cohesionless sands. 4 2. The presence of high, excessively steep slopes. 3. Periodic blockfalls within the Torrey Sandstone that do not allow the overlying terrace slopes to equilibrate with their environment. It is also likely that groundwater is having an increasing adverse effect on unretained slopes as seepage along the contact between the permeable terrace sands and the less permeable Torrey Sand increases with increasing development and water usage east of the bluff. A determination of the average amount of bluff - retreat was not made because bluff erosion on -site and on adjacent properties has been or will be arrested by sea -walls and existing or proposed mid -slope retaining walls. In order for these walls to continue to protect property from erosion they must be properly designed and equally importantly, have a regularly scheduled maintenance program. Faulting Local and Recional Published geologic maps (Wilson, 1972) indicate that the closest faults to the site are minor faults that cut the Eocene aged Torrey Sandstone. These faults are relatively common and may be observed in the sea -bluff south and north of the site. Since the faults are not known to affect sediments younger than Eocene age and typically have displacements of only a few feet, they are not considered seismic hazards. 5 The closest active fault is the Rose Canyon Fault that lies approximately 2 miles off- shore. Recent studies have shown that the Rose Canyon Fault is capable of producing an M 6.5 earthquake. Such an event on this fault or other regional active faults in the southern California area could subject the site to moderate to severe seismic shaking. Conclusion and Recommendations 1. The results of this study indicate that the terrace deposits consist of massive to thinly- bedded light brown, medium - grained sands. Cementation is generally very light to absent, especially in the lower portions of the bluff. Based on visual observations of that portion of the bluff recently exposed by the surficial slope failure, the lithology of the terrace deposits is generally uniform from the bluff top to the contact with the Torrey Sand. Interbeds of clay, silt, or conglomerate, were not observed on site or on adjacent properties. 2. It is concluded that there are no geologic structures present that may represent unusual stability or construction problems. The wall contractor should be aware that caving conditions caused by the presence of cohesionless sands may be encountered during drilling of tie -backs and that groundwater may be encountered in some of the excavations and may exacerbate caving conditions. 6 3. Poor surface drainage is a major cause of bluff instability. Therefore, it is recommended that all surface and roof water be directed via swales or subsurface drains to the street. It is recommended that roof gutters, if not already in use, be installed on the residence. existing large -leaf iceplant .be removed and the slope 4. Irrigation of slopes should be only on a temporary basis in order to allow plants to become established. DATE: January 17, 1995 TO: Mr. Jerry Schnoebelen 678 Neptune Avenue Encinitas CA 92024 RE: Residence Located at 678 Neptune Avenue, Encinitas CA 92024 SUBJECT: Preliminary Review of Rear Slope Failure Dear Mr. Schnoebelen, Per your request, a representative of our firm visited the referenced site on Monday, January 16, 1995, to observe reported rear slope failure located behind (West of) the existing residence. Specifically, the request was due to concern by the owner of the present condition due to a slope failure that occurred during, and subsequent to, recent heavy rainfall. The concern was related to the safety of the remaining improvements, at both this site and neighboring sites, due to the observed condition. Upon arriving at the site, we observed a substantial hillside failure emanating from, and encroaching onto the rear yard, within ten feet (10') of the existing residence. Portions of the existing rear deck on both this site, and the neighboring site to the North, were undermined from the failure. The resulting slopes in the immediate vicinity of the residence were as steep as .75:1 (horizontal to vertical), and were near - vertical approximately forty feet (40') downslope where a "fissure" was observed. Water and sand migration were evident at this fissure, and active erosion of the slope was observed during our site visit. Based on the observed conditions, we believe that improvements at both this site, and the neighboring sites, are in jeopardy, and require emergency protection measures to reduce the likelihood of imminent massive failure, and to stabilize the slope to prevent continued erosion. A sound method of hillside support should be provided, with precautions utilized to ensure the safety of all workers. Schnoebelen 678 Neptune Avenue Encinitas, CA 92024 RE: Your undated correspondence (received on February 26, 1997) of 6 pages with 17 exhibits and your March 13, 1997 handwritten correspondence. Dear Mr. Schnoebelen: This letter is provided in response to your correspondence referenced above. In reviewing your letters and the City files, I have found no evidence that you have complied with the requirements for a major use permit which is required pursuant to Municipal Code Section 30.34.020. The only record of any City issued permits relative to work on or near the bluffs or the beach at 678 Neptune Avenue are a beach encroachment permit and a grading permit issued by t�e City Engineering staff. The December 31, 1996 letter from Hans Jensen attached to your correspondence as Exhibit 16 indicates that "Final inspection of Permit 4283TE,�a thorizing access across the public beach to a jobsite on adjacent private property, has been concluded to the satisfaction of the Field Operations Division, Engineering Services Department." In a conversation with Mr. Jensen on March 4, 1997, he assured me that Permit 4283TE was solely for removal of debris from the beach. The debris in question was associated with the failure of the bluff at your property. On March 19, 1997, Mr. Jensen indicated that Grading Permit 4283GR is not completed since additional materials need to be submitted. You have indicated in your correspondence that you have completed work on the bluffs and replaced a stairway. I refer you to Exhibit 5 of your submittal, a May 8, 1995 letter signed by me. Contrary to assertions in your letter, the exhibit summarizes our May 5, 1995 meeting and advises various City staff of the results of the May 5 meeting. The letter also cites coastal development permit 6 - 85 - 396 and the requirement that "The applicant shall contact the Coastal Commission office at such times to determine whether such repairs or activity may require a coastal development permit." Any emergency work completed on the face of the bluff requires that you receive an emergency coastal permit from the State of California Coastal Commission. My May 8, 1995 letter to you also authorizes "...the City Engineer ... to process your access permit for any lawful work on the bluff..." The referenced undated correspondence from you discusses City staff interaction with Mr. Ted Gildred. Mr. Gildred and Mr. Tom Tucker of Dyson and Dyson Real Estate came to City Hall as part of their due diligence investigation. In my conversation with them, Mr. Gildred indicated that he had made an offer on your property and was interested in the condition of the bluffs. He was given the complete file (Major Use Permit application 95 -106) for his review. Then, on February 10, 1997, at the request of Mr. Tucker, Diane Langager, Associate Planner and Project Manager for your application, sent the enclosed transmittal form and the documents cited on the transmittal form to Mr. Tucker. All information reviewed by and given to Mr. Tucker is a matter of public record. You also pose 12 questions in your undated correspondence. I will do my best to answer all of the questions. Mr. Artim is a geotechnical consultant to the City who reviews geotechnical reports. City consultants do not deal directly with applicants in order to remain objective. All appropriate information has been submitted by staff to Mr. Artim. The soils report for the backfill has not been submitted to him since it would be of no substantial benefit to submit the report at this time. In Mr. Artim's last response (dated June 23, 1995), he requested that geotechnical information be certified and submitted in a specific format. That information has not been submitted as of this date. If we submitted the soils report for the back fill at this time, Mr. Artim could review it, write another report and expend additional funding. Staff did not feel it appropriate to spend additional sums from your account since the information previously requested had not been submitted. Once the information requested by Mr. Artim has been submitted he will be asked to review all information. Mr. Artim advised the City on March 7, 1997 that he has not received any messages, either oral or written from Southern California Soils. He has received messages from you, but has not returned those calls since it was his understanding, and the general practice of all City consultants, that he was only to discuss technical solutions with your qualified consultants. Exhibit 13, my letter to you dated January 18, 1996 discusses the stairs and makes reference to other needed material.. The information requested in that letter has not been submitted. Your exhibit 15 was not responded to since you had previously stated in your November 8, 1995 letter (exhibit 12) that : "All I am doing is repairing the steps that fell again in January, 1995 ". I did not want to use moneys in your account to respond to a letter that you had written to dispute an earlier letter written by you. The evidence submitted to date indicates that the stairs are in violation of the Municipal Code and the Local Coastal Program regulations since they are in a different location than previously constructed and material used is different from the previous stairs. Under Coastal regulations, the replacement of 20 percent or more of the materials of an existing structure with material of a different kind constitutes replacement, not repair. Replacement of a stairway is generally not authorized on the coastal bluff. All time spent on your application, including the time spent reviewing the administrative record and writing this reply is being charged to your account. Additionally, the deposit account balance for Mr. Artim has been depleted due to the amount of time he has spent on the project as evidenced by the various letters in the administrative record. Since an unusual amount of time has elapsed between the original submittal and any additional work which may be needed by the environmental consultant, Mr. Hinshaw has advised that additional funding will be needed for his firm to complete their review once a complete application has been submitted. I recommend that $500 for the account of each consultant be provided, for a total of $1000. Again, the permit finaled by Engineering was for beach encroachment purposes. The major use permit is still required by the Municipal Code and Local Coastal Program regulations. The environmental consultants cannot finish their review until the third party geotechnical review by Mr. Artim is complete. Mr. Artim cannot complete his review until all information discussed above is submitted by qualified consultants. Mr. Skelley has processed several seawalls in Encinitas and is aware that the City and Coastal Commission requires concrete to blend with the bluffs as much as possible. Mr. Jensen has reviewed every seawall constructed since his employment with the City, his advice to color the wall to match the sandstone was appropriate. The Community Development Department has not issued a permit, thus we have not been able to condition the permit relative to color of the concrete. The wall and stairs were repaired and/or replaced without proper permits; if permits are issued, appropriate conditions will be assigned to the permit. In accordance with State open meeting laws, the City Council can only meet as a group when an item is on a posted agenda. In order to have your use permit application on the City Council agenda, the Planning Commission, as the land use decision making body for the City of Encinitas, would first have to render a determination. Incomplete applications only go to the Planning Commission in order to have the Commission deny the application. Your application as discussed in previous correspondence cited above is incomplete. With consideration given to the history of your application, staff will place the item on the Planning Commission agenda if all required information is not submitted prior to May 1, 1997. If the Planning Commission denies your application, you may then appeal that determination to the City Council. Pursuant to Municipal Code Chapter 1. 12, the City Council may affirm the Planning Commission's action without a hearing or direct staff to set the appeal for a hearing. If the appeal is set for a hearing you will then be able to address your concerns to the City Council. You indicate that you are not adverse to meet with me to discuss the status of your application; with consideration given to the history of the application, the meeting would only be productive for City staff if you retain a qualified engineering or geotechnical consultant to attend the meeting. Upon retention of the qualified consultant, please have the consultant contact me to arrange the meeting. The consultant should review the case file prior to a meeting with City staff, specific attention should be given to the letters cited on the transmittal to Mr. Tucker. It is customary for staff to respond to letters relative to development applications. I am sending copies of this letter to the City Council and City Manager for their review; should they wish clarification or need additional information, the Council members or City Manager will contact you. City staff looks forward to working with your consultants to complete the project. However, as noted above, if all necessary information is not available to process the application by May 1, 1997, staff will place the application on the agenda of the Planning Commission with a recommendation to deny the application. The buyer of my property questioned someone's statements and letters from your department which caused him to cancel the purchase of my property. Not one that wants to litigate, I request a statement from you, in writing, as to what the buyer was told and what paper work was submitted to him. The first part of this letter is a chronicle of events that applies to your City Planning Department. During a major storm on January 7, 1995, the north Y2 of my upper bluff • retaining wall failed. The failure caused all the crib walls, vegetation and my stairs, both above the lower seawall and on the seawall to collapse. The City sent me a letter (exhibit 1) stating if I wanted to replace the fallen structures I needed a "major use permit ". I met with you, Lauren Wasserman, Alan Archibald, Hans Jensen and my engineer, Dave Skelly, to arrange emergency permits to start construction to ease the chance of a total bluff failure and to insure the safety of my home. In that meeting you asked if I would complete the major use permit process. I answered, "To the best of my ability ", because I had no idea what was involved. You also asked if I was going to replace my stairs and I responded, " I do not know yet, it depends on how much money I have left after rebuilding the fallen structures." Two days later I contacted Diane Langager to start the emergency permit process.
