District of 5.5 Acres Located at thP Southwest Comer of EI Camino Real and T'ennis Club Drive

The appli.ant, Mr. Stuazt Grauer, is requesting annexation of 5.5 acres of propeny into thc
Cardiff Sanitation District. Annexation to the Cardiff Sanitation District is a condition of
approval of Case No. 98-236 MUP/DR/CDF/EIA, approved by the Planning Commission on
- May 17, 2001. The development project consists of phased construc!ion of a private school
~ faciliry, comprised in the final phase of two buildings totaling approximately 22,000 sq. ft..
In conjunction with this development, the applicant will extend the sewer tnain approximatcly
100', on-site only. The cost of the sewer improvemcnts will be financed entirely at thc erpense
of the developer.
T'he Pianning Commission reviewed the Environmental ]nitiat Study prepared ior the project and
determined that, with the incorporation of mitigation measures, the environmental impacts of the
project would be insignificant and adopted a iviitigated Negative Declaration.
ANALYSIS:
The proposed annexation is in conformance with the Cardiff Sanitation Board's policy 1"or
annexations of legal size lots and is wit:?in the Disuict's sphere of influencc.

The annexation will generate $700 in processing Fee revenuec and 53417/LP)U in capaciry fee
revenues to the Distiict.
RECOMMENIiATIONS:
Staff recommends that the Board of Directors adopt Resalution No. 2001-11. Application for

WHEREAS, this Board of Directors hv received a request From M:. Stuart Grauer that
the hereinafter described territory be anrexed to the Cardiff Sanitation District (hereinaRer
seferred to as che Sanitation District); and
WHEREAS, this Board of Directors desires to initaate procecdings to annex said temtory
to the Sanitation Districr,
BE IT RESULVED AND ORDERED as follows:
1. Pursuant to Govemment Code Sections 56800 and 56700, application is hereb}• madc to
the Local Agency Formation Commission of the County of San Diega for a proposed
change of organiz.:tion as follows:
A. This proposal is made pursuant to the Cortese-Knor [.ocal Govemmcnt
~ Reorganizatior. Act of 1985 (S. 56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization and thc names of all districts
for which any such change of organization is proposed ere as follows: The
annexation of the hereinaftar described territory to the Cardiff 5anitation District. ~
C. The names of al! other affected counties, cities and districts are: Ci.ty o[ Encinitas.
D. A description of the extericr boundaries of the territory propused to bc: annexed to
flie Sanitation Distriet is described in ".Attachment 2" hereto attached.
E. Said territor,r is uninhabited and comprises approximately 5.5 acres.
F. It is proposed that said temtory be annexed subject to the Follo«+ing condition:
Payment of District processing, Local Agency Forniation Commission processing,
and State Boazd fees.
G. All the owners of land within such territory have given their wTitten consent to
such annexation subject to the aforementioned terms and cor.ditions.
~ H. The reasons for this proposal are as foliows:

~ (1) The Sanitation District is empowered ta and is cngaged in furnishing
sewage disposal facilities.
(2) The territary proposed to be annexed to said District is developed anu/or
proposed to be develope:d and used for c•esidential ancUor connmercial
purposes and prov;sion for sewerage disposal facilities for said territory is
essential for such p'urposes.
1. It is hereby requested that pmceedings te taken for the annexation of territory as
herein sMve proposed.
J. This annexation is consistent with the sphere of influence of the Sanitation
District.
K. 't'he Boazd concurs with the City of Encinisas Planning Commission's
determination that, with the approved mitigation meacures, the pro'tect will hsve
an insignificant imipact on the environmental and adopu a Mitigated Negative
Declaration for the project.
2. The Clerk of the Boazd of Dzrectars is hereby authorized and directed to file a certified
copy of this resolution wiih tite Excautive Ofticer of the Local Agency Formation
Commission of the County of 5an 'Diego.

84308, and the Regulntions of the Pair Pulitical Practices Commission (FPPC), Section 18438.

when your application haz 6cen filed, or the proceeding is otherwise iniciated.

"Agent" is defined as a person who representc a party in ccnnection with a prc;cceding. lf an
individunl acting as an agent also is acting as an crtaployee ar membcr of u Isw, architutural,
engineering, or cc,nsulting firm, or a similar entity or corpo:ation, both the individual and the
'-entity'or corpor-aiiori arc agEnts. When a' closed corporation is a party to a procecding, the
mxjority shareholder is subject to these provisions.

require disqualification, and returns the contribution within 30 days of knowing about ttic
conVibution and the relevant proceeding, that comrtiissioner shall bc pertnitted to participate in
the proceeding.
