SUBJECT: Adoption of Resolution No. 2001-08, Annexation to the Cardiff Sanitation
District of 0.49 Acres Located at 642 Rancho Santa Fe Road - Barber Annexation (Assessor's
Parcel No. 265-35545).
BACKGROUND: Mr. and Mrs. William Bazber are petitioning for annexation of 0.49 acres to
the Cazdiff Sanitation District. The applicarits have a failing septic system and wish to connect tu
the public sewer.
~ On December 13, 2000, the Cardiff Sanitation District Board reviewed thc proponent`s requesi
and adopted CSD Resolution No. 2000-18, approving an anneration application to the District.
The proposal was subsequently eeviewed and approved by the Local Agency Formation
Commission on March 12,2001.
ANALYSIS: The proposed annexation is in conformance with the Cardiff Sanitatiun District
Boazd's policy for annexations of single-family residences on legal-size lots, confoim5 with the
current zoning, and is within the District's sphere of influeace.
FISCAL AND STAFF IMPACTS: The annexation will generate $700 in proccssing fce
revenues and $3417/EDU in capacity fee revenues tu the District.
RECOMMENDATIONS: Staff recammends that the Board of Directors adopt Resolution Nn.
2001-08, approving annexation to the Cardiff Sanitation District of 0.49 Acres Located at 612
Rancho Santa Fe Road - Bazber Annexation (Assessor's Parcel No. 265-35545).

ANNEXING TERRITORY TO WHICH OWNERS HAVE COhSENTED
"WILLIAM BARBEit ANNEXATION"
WHEREAS, pursuant to the Cortese-Knox Local Govemment Reorganization Act af
1985 (Govt. Code, Section 5600 et seq.) preliminary proceedings were commenced by resolution
of applicatiun by this Board an December 13, 2000, as Resoi'ution No. 2000-18, for annexation
to the Cardiff Sanitation District (thereafter referred to as tiie District) of ceitain territory then:in
described, which description has been modified pursuant to the dirrctions of the Local Agency
Formation Commission; and
WHEREAS, the annexation proposed by said resolution uf application was presented to
and approved by the Local Agency Formation Commission of San Diego County on March 12.
2001 and this Disvict was designated as the conducting Disvict and authorized by resolution of
order said annexation without notice or hearing and without an election pursuant to Govcrnmcnt
~ Code, Section 56837;
NOW, "THEREFORE, IT IS RESOLVED, ORDERED AND DETERMMED, pursuant ¢o
Government Codp Section 57025 et seq.;
a. The manner in which and by whom preliminary proceedings were commenced ,
was by resolution of application by this Board as stated above.
b. The territory to be annexed has been designated DA 00-37 by the Local Agsncy
Formation Commission, and the exterior boundaries of such territory are as
hereinafter described.
c. The territory proposed to be annexed is uninhabited and wili be benefited by such
annexation as described in Health and Safety Code Section 4830.
d. The reasons for the proposed annexation as set forth in the resolution of
applicadon refetred to above are:
1. The Disvict is empowered to and is engaged in fumishing sewage
disposal facilities. -
• 2. The territory pmposed to be annexed to said District is developed and/or
proposed to be developed and used for residential and/or comnacrcial
purposes and provision for sewage disposa! Pacilities for said trrritory is
essential for such purposes.

e. The terms and condi:ions of the proposed annexation are: Payment of State
~ .I Board of Equalization fees,
f. All ttte owners of land within such territory have given their wrinen consent to
such annexation, as provided in Govemment Codc, Section 56837; and therefurc,
as approved and authorized by the Local Agency Fortnation Commission, this
Board may adopt its resolution ordering the annexation without notice and
hearing and without an election, as provided in Government Code, Sectian
57002.
g. The reguiar County assessment role will be utilized and the affected territory will
not be taxed for existing bonded indebtedness.
IT 1$ FLTRTHER RESOLVED AND ORDERED that pursuant to Govemment Code
Section 57002, the following described incorporated territory in the City of Encinitas, State of
Califomia, be and it hereby is annexed ta and made a part of the Cardiff Sanitation Disvict.
IT IS FURTHER ORDERED that the Clerk of this Board immediately transmit a certificd
copy of !his resolution along with a remittance to cover the fees rcquired by th. Govemment
Code Section 54902.5 to the Executive Officer of the Local Agency Formation Commission of
San Diego County, so that the Executive Officer may make the filings required by Chapter 8
(commencing with Sestion 57200), Part 5, Division 1, Title 6 of the Govemment Code and by
Chapter 8(commencing with Section 54900), Part I, Division 2, Title 5 of the Government
. ~ Code.
