BACKGROUND: Mr. Alvin Mayo is pctitioning for annexation uf 16.67 acres to the Cardiff
Ssnitation District. Annexation to the Cardiff Sanitation District is a condition o}' approval for
TPr9 99-207, approved by the Planning Commission on July 27, 2000. The developmcnt projec:t
consists of four single -famly residential parcels and a remainder parcel.
~ On December 13, 2000, the Cardiff Sanitation pistrict Boazd reviewed the proponene's requrst
and ac'.opted CSD Resolution No. 2000-20, approving an annexation application to the District.
The proposal was subsequently reviewed and approved by thc Lucal Agency Fannation
Commission on March 12, 2001.
ANALYSIS: The proposed anneration is in confnrmance with the Cardifi' Sanitation District
Board's policy for annexations of sing!c-family resi:',cnccs on Icga!-sizc lots, canforms with thc
current zoning, and is within the District's sphere of intluence.
FISCAL AND STAFF L.IPAC'd'S: The annexation will generate $700 in processing fee
revenues and 53417/EDU 'sn capacity fee revemies to the District.
RECOMMENDATIONS: Staff recommends that the $oard of Directors adopt Rcsolution No.
2001-07, Annexation to the Cardiff Sarzitation District of 16.67 Acres Located at the 1'erminus of
Wildflower Road - Mr. Alvin Mayo Annexation (Assessor's Parc.;l No. 254-091-59).

A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
ANNEXING TEdtRITORY TO WHlCH OWNERS HAVE CONSE_NTED
"ALVIN MAYO ANNE?CATION"
WHEREAS, pursuant to ihe Cortese-Knox Local Govemment Reorganizatic,n Act of
, 1985 (Govt. Code, Section 5600 et seq.) preliminary prviceedings were commenced by resolution
of application by this Etoazd on December 13, 2000, as Resolution No. 2000-20, for arsnexation
to the Cardiff Sanitation District (thereafter referred to as the District) of certain eerritory thtrein
described, which description has been modified pursuant to the directions of the Local Agency
Formation Commission; and
WHEREAS, the annexation proposed by said resolution of applicatian was presentrd to
and approved by the Local Agency Formation Commission of San Diego County on hlazch 12,
2001 and this District was designated as the conducting District ar.d authorized by resolution of
order said annexation without notice or hearing and without an election pursuant to Government
Code, Section 56837;
NOW, THEREF'ORE,1T IS RESOLVED, ORDERED AND DETERMINED, pursuant to
Government Code Section 57025 et seq.;
a. The manner in which and by vrhom preliminary proceedings were conunenced
was by resolution of applicaiion by this Board as stated abc,ve.
b. The territory to be annexed has been designated QA 00-36 by the Loczi Agency
Formation Commission, and the exterior boundaries of such territory are ais
hereinafter described.
c. The territory proposed to be annexed is uninhabited and will be benefited by such
annexation as described in Health and Safety Code Section 4830.
d. The reasons for the proposed annexation as set forth in the resolution of
application referred to above are:
1. The District is empowered to and is engaged in furnishing sewage
disposal facilities.
- 2. The territory proposed to be annexed to said District is developed and/or
~ proposed to be developed and used for residential and/or commorcial
purposes and provision for sewage disposal facilities for said territory is
essential for such purposes.

e. The terms and condiuons of thc proposed annexation aze: P•aymrnt of State
Board of Equalization fees.
f. All the owners of land within such tcrritory have given their written cunsent to
such annexation, as provided in Govemment Code, Section 56837; and tiwrefore,
as approved and authorized by the Local Agency Formation Commission, this
Board may adopt its resolution ordering the annexation without notice and
hearing and without an election, as provided in Govemment Code, Section
57002.
g, The regulaz County assessment role will be utilized and the affected terr'story will
not be taxcd for existing bonded indebtedness.
IT IS FURTHER RESOLVED AND ORDF.RED that pursuant to Govemment Code
Section 57002, the follawing described incorporated territory in the City of Encinitas, State of
Califurnia, be and it hereby is annexed to and made a part of the Cardiff Sanitation Disuict.
IT IS FU;tTHER ORDERED that the Clerk of this Board immediately transmit a certified
copy of this resolution along with a remittance to cover the fees required by the Govemmeot
Code Section 54502.5 to the Executive Officer of the Local Agency Formation Cotr~mission of
San Diego Counry, so that the Er,ecutive Officer may make the filings required by Chapter S
(commencing with Section 57200), Part 5, Division 1, Title 6 of the Govemment Code and by
Chapter 8(commencing with Section 54900), Part l, Division 2, Title S of the Govemmer:
~ Code.
