ANALYSIS consis originally with activities orx inall ro osed ' and delineated in the April 22" City Council agenda repo_ rt, the proposed funded activities for the FY2008 -09 CDBG -R funds are described as follows: As noted, the City will receive $1 07',683 of CDBG -R funds. Although the use of CDBG -R funds generally allows the same =activities as annual- CDBG funds such -as housing and community development, the primary purpose of the funds was appropriated to stimulate the economy and assist those most affected by the current recessi with act iviti es such as job creation and preservation, - promoting economic recovery, en ergy. efficiency, -and - assisting ' those'-most impacted by the recession. CDBG regulations allo' 'W for public services, planning and administration, and. capital improvements (other activities). CDBG R .regulations allow that fifteen percent of: the funds can be applied to public services and ten percent of the funds can �be. applied to - planning administration. Staff recommends that $7,857. be funded from - CDBG -R funds. 2 127 Homeless Motel Vouchers The Community Resource Center requested' $7,.500, which $5,125 was - approved to be funded with FY2009 -1 o CDGB funds. Staff recommends 'that $2,375 be funded from CDBG --R funds. Food Bank — North County Community services requested $5,824, which $3,300 was approved to -be funded with FY2009 -1 o CDBG - funds. staff recommends that $2,524 be= - funded from CDBG -R funds. Staff recommends additional funding to the above three programs, since - the programs are more directly related. to the intent of ARRA .in that the programs directly assist those most affected by the current recession (that is, homeless, homeless - prevention, case management and job preparation and assistance). With Council's approval, these three programs will be fully funded at the requested amount. The recommended funding is approximately twelve percent of -the CDBG -R funds. Planning and A dminis tra tion Staff does not recommend any funding be allocated for administration of the CDBG -R funds. CDBG administration funds currently budgeted can absorb the CDBG -R oversight costs.. Capital- improvements (Other Activities) Melba Sidewalk - 'Im rovements --- This project. has. been identified by residents as a concern. for the safety. of - elementary and high school students using the existing asphalt sidewalk surfaces. surface drainage is causing a deterioration of the asphalt surfaces. The project meets the intent of ARRA because the contract can be awarded within 120- days and stimulates the,- economy with infrastructure improvements. -City council approved $'197,073 of FY2009 -10 CDBG. funds and $5,000 of. safe Routes to schools funds for the project. The total project cost is $297,000. Staff recommends that the project cost balance of $94-,927 be, funded with CDBG -R funds. If for some reason HUD.does not approve any portion of the CDBG -R funds for the identified - Public Services in this - report, then staff recommends that those Public services funds be allocated to the Melba Sidewalk Improvements and the city Manager be authorized to revise the Substantial Amendment for HUD's approval. FISCAL AND STAFF IMPACTS: Projects and activities are funded - through the federal CDBG and CDBG -R programs. HUD .provides the funding .to the City on a reimbursement basis, so City_ general funds are initially expended on project and. activity costs. until funds are drawn down from HUD to reimburse the city. staff administrative costs are funded- through the CDBG program. ' COIUI M EN DATIO N : staff raco mmends . the following actions: 1. Adopt Resolution No. 2009 --29 approving. the Substantial Amendment to the' FY .2008 -09 Action Plan (Attachment E); and 2. The attached CDBG Recovery Act (CDBG -R) Notice provides your community with a significant opportunity to address critical employment and economic development needs. In accepting these funds, it is imperative, however, that you be good stewards of these precious � taxpayer dollars by focusing your efforts on the Recovery Act goals of.investing in infrastructure that will create or sustain jobs in the near --term and generate maximum economic benefits in the ll long- term. I HUD is fully committed to implementation of the guidance provided by President Gbama in his March 20, 2009, memorandum regarding the need for responsible spending of Recovery Act funds_ The - CDBG -R funding presents a unique set of challenges because of the wide range of activities allowable under the CDBG program,. as compared to the more narrow range of activities allowable under the CDBG -R program. The goals of the Recovery Act are focused.on stimulating job creation and long -term economic benefit. In an effort to ensure responsible spending of Recovery Act funds; a number of actions have been taken. First, Section 1 604 of the Recovery Act prohibits the. use of funds for certain types of projects including aquariums, casinos, golf courses, swimming pools, and zoos. This prohibition is clear and direct, and HUD's guidance -on the use of CDBG -R funds reflects these prohibitions. In addition, HUD is: I. Conducting extensive outreach to housing and community development officials through. such groups as the National League of Cities, the U.S. Conference of Mayors, the National Association of County Officials- and the - National Governors Association to. underscore the importance of focusing on the Ivey elements of the Recovery Act as they examine projects proposed for CDBG- funding. - 2. Adding a "terms and conditions" to all grant agreements that clearly reflect the obligation of the- grantee to comply with the Recovery Act in can - ying out its responsibilities. i www.hud.gov espanol.hud.gov 131 r _ 2 3. Providing detailed guidance to grantees regarding expectations for projects and activities accomplished under the Recovery Act. 4. Encouraging grantees to engage with their auditors early in the planning process, as HUD has been doing with the Office of the Inspector General,. to - ensure that major risks to responsible spending are quickly identified, and mitigation strategies established, upfront. 5. Requiring grantees to identify, upfront, the specific activities and projects that they intend to fund with CDBG -R funds. The CDBG citizen artici ation process will a l , W ith P P P PP �' the additional requirement that grantees post their plans on their own websites in order to f receive a greater level of public comment -and scrutiny. Through these efforts, - HUD expects that .imprudent projects will be identified and weeded out and that GDBG - funds will be used in a manner consistent with the purposes and goals of the Recovery Act. 6. Posting all proposed grantee projects on the HUD Recovery.Website to provide complete transparency and encourage greater scrutiny. .The economic crisis has resulted in. many critical needs in our nation's communities. Last month, I signed into law the "American Recovery and Reinvestment Act of 2009," Public Law 111 -- 5 (the "Recovery Act" or "Act "), an investment package designed to provide a necessary boost to our economy-in these difficult times and to create jobs, -restore economic growth, and strengthen America's middle class. The Recovery Act is designed stimulate the economy through measures that, among other things, modernize the Nation's infrastructure, jump start Amer --. ican energy independence, expand high - quality educational opportunities, preserve and improve access to affordable health,. care, provide middle -class tax relief, and protect those in greatest need. It is not intended to fund projects for special interests. In implementing the Recovery Act, we have undertaken unprecedented efforts to ensure the responsible distribution of funds for the Act's purposes and to provide public transparency and accountability of expenditures. We. must not allow Recovery Act . funds to be distributed on the basis of factors. other than the merits of proposed projects or in response to improper influ- ence or pressure. We must also empower executive department and agency officials to exercise their available discretion and judgment to help ensure that Recovery Act funds are expended for projects that further the job creation, economic recovery, and other purposes of the Recovery Act and are not used for imprudent projects.. To these ends, T hereby direct that for any further commitments, obligations, or expenditures -of funds under the Recovery Act, the head of each executive department or agency shall immediately take. all necessary steps, to the extent consistent with the Act and other applicable law, to comply with this memorandum. Section 1. Ensuring Merit- Based.Decisionmuking for Grants and Other Forms of Federal Financial Assistance Und er the - Recovery Act. (a) Executive depart- ments and agencies shall develop transparent, merit -based selection criteria that will guide their available discretion in committing, obligating, or expend - ing funds under the Recovery Act for grants and other forms of Federal financial assistance. Such criteria shall be consistent with legal requirements, may be- tailored to the particular funding activity, and shall be formulated to ensure. that the funding furthers the job creation, economic recovery, and other purposes of the Recovery Act. To this end, merit - based selection criteria shall be designed to support particular projects; applications, or applicants for funding that have, to ' the . greatest extent, a demonstrated or potential ability to: (i) deliver programmatic results; GO achieve - economic stimulus ' by optimizing economic activity. and the number of jobs created or saved in relation to the rederal dollars obligated.; (iii) achieve - long -- term public benefits by, for example, investing in. technological advances . in science and health to increase economic efficiency and improve quality � of life; investing in transportation, environmental protection, and other infra- structure that will provide long -term economic benefits; fostering- energy independence; or improving educational- quality; and (iv) satisfy the Recovery 1 en A ` Act's transparency and accountability objectives. 3 f 1 134 1 12532 Federal Register 74, No. 56 /Wednesday, March 25, 20091 Presidential Documents (h) No considerations contained in oral or written communications from any person or entity concerning particular projects, applications, or appli- cants for funding shall supersede or supplant consideration by executive departments and agencies of such projects, applications, or applicants for funding pursuant to applicable merit -based criteria. Sec. - Z. Avoiding Funding of Imprudent Projects. (a) Funds under the Recovery Act shall not be committed, obligated, or expended by any executive depart - ment or agency, and shall not be used by any State or local governmental or private grantee or awardee, to support projects of the type described in section 1604 of Division A of the Recovery Act, which states that "(njone of the funds appropriated or otherwise made available in this Act- may be used by any State or local - government, or any private entity, for any casino or other gambling establishment, aquarium, zoo, golf course, or swim- Ming pool." (b) In exercising their available discretion to commit, obligate, or expend funds under the Recovery Act for grants - . and. other forms of Federal financial .assistance executive departments and agencies, to - the extent permitted by law, shall not approve or otherwise support funding for projects that are similar to those described in section 1604 of Division A of the Recovery Act. (c) In exercising their available discretion to commit, obligate, or expend funds under the Recovery Act for grants and other forms of Federal financial assistance, executive departments and agencies, to the extent permitted by law, shall not. approve or otherwise support any project, application, or applicant for funding that is imprudent or that does not further the job creation, economic recovery, and other purposes of the Act. To this end, executive departments and agencies shall exercise their available .discretion to decline approving or otherwise supporting particular projects, applications, or applicants for funding unless the department or agency has affirmatively k determined, in advance, that the project, application, or applicant has a demonstrated or potential ability to: (i) deliver programmatic results; (ii) achieve economic stimulus by optimizing economic activity and the number of jobs created or saved in relation to the Federal dollars obligated; (iii) achieve long -term public benefits by, for example, investing in technological advances in science. and health to increase economic efficiency and improve quality of life, investing in transportation, environmental protection, and other infrastructure that will provide long -term economic benefits; fostering energy independence; or improving educational quality; or (iv) satisfy the Recovery Ac transparency and accountability objectives. .(d) Where executive departments or agencies lack discretion under . the Recovery Act to refuse funding for projects similar to those described in section 1604 of Division A of the Act, or other - projects that the executive department or agency deems imprudent or as not furthering the- job- creation, economic recovery, or other purposes of the Act, the department or agency shall consult immediately with the Office of Management and Budget (OMB) about the project -and its funding requirements. Where legally permissible, � the department or agency shall: l (i) delay funding of the project for 30 days, or the longest period permitted by law if less than 30 days, in order to ensure adequate oppoi•tunity for public scrutiny of the project prior to commitment of funds; and f i (ii) publish a description of the proposed project (or project plan) and its funding requirements. _on the agency's recovery website as soon as practicable before or after commitment, obligation, or expenditure of funds ; for the project. (e) Executive departments and agencies, including their respective Offices of Inspector General, shall monitor compliance with the prohibition in section 1604 of Division A of the Recovery Act, referenced in paragraph (a) above, by contractors, grantees, and other recipients of Federal financial assistance (recipients). Sec. 3. Fissuring Transparency of Beg stered Lobbyist Communications. (a) An executive department or agency official shall not consider the view of a lobbyist registered under the Lobbying Disclosure Act of 1995, 2 U.S.C. 1601 et seq., concerning particular projects, applications, or applicants for funding under the Recovery Act unless such views are in writing. (b) Upon .the scheduling of, and again at the outset of, any oral- communica- tion (in- person or telephonic) with any person or entity concerning particular projects, applications, or applicants for funding under the Recovery - Act, an executive department or agency official shall inquire whether any of the individuals or parties appearing or communicating concerning such par - ticular project, application, or applicant is a lobbyist registered under the Lobbying Disclosure Act of 1995. If so, the lobbyist may not attend or participate in the telephonic or in-person contact, but may submit a commu- nication in writing. (c) All- written communications from a registered lobbyist concerning the commitment, obligation, or expenditure of funds under the Recovery Act for particular projects, applications, or applicants shall be posted publicly by the receiving agency or governmental entity on its recovery website within 3 business days after receipt of such communication. Both CDBG and HOME program funds are administered by -the U.S. Department of Housing and Urban Development (HUB). The Consolidated Plan and annual Action Plan are part of the application and planning process for formula -based community development programs. The Consolidated Plan articulates goals and objectives for use of these funds over a five -year period. Each year, the City approves and submits to HUD an Action Plan that implements the goals identified in the Consolidated Plan. The Fiscal Year (FY) 2008- 09 Action Plan is the fourth in the City's Five -Year (FY2005 -10) Consolidated Plan. The FY2008 -09 Action Plan is for the period from July 1, 2008 —June 30,'2009. The City Council approved the FY2008 -09 in April 2008 and activities commenced July 1, 2008. The statutes for the CDBG program are predicated on three national, objectives for the eligibility and expenditure of funds. These objectives include: benefit to low and moderate income residents; elimination of slums and blight; or assistance with local emergency needs HOME program f a re used to expand the supply of decent, safe, sanitary, and affordable housing,wit imary attention to rental housing, for very low- income and low- income families. The five goals established in the City's Consolidated Plan include the following: • The City will support affordable housing opportunities for renters and homeowners • The City will facilitate the development of affordable rental housing • The City will support the provision of homeless services and homeless prevention activities • The City will support community -based and regional services that benefit Encinitas residents • The City will improve the quality of life in lower income neighborhoods in collaboration with residents In addition to the FY2008 -09 CDBG and HOME funds, on February 17 2009, President Obama signed the American Recovery and Reinvestment Act of 2009 (ARRA) into law. The ARRA is commonly referred to as the stimulus bill. The City will receive an additional $107,683 of CDBG Recovery funds (CDBG as a result of this bill. On May 5, 2009., HUD issued Program Requirements for the use of CDBG -R funds. To receive the funds, \ City of Encinitas !'Y2008 -09 Action Plan Substantial Amendment Page 4 of 30 142 the Cit y rmust submit to HUD b y June 5, 2009, a substantial Amendment to its FY2008 -09 Action Plan identifying the activities to be funded by CDBG-R funds. The substantial Amendment must be made available for public comment for a seven -day period and any comments considered prior to City Council approving the use of CDBC -R funds. The opportunity for public review and. comment on the Substantial Amendment was noticed in the Coast Nevus a local paper of general circulation) and the City's website on May 15th. Also, citizens had the opportunity to comment at the City Council meeting of May - 27, 2009. Any comments .received were provided to city council for its consideration. AR RA's stated p are to: 1 ur p reserve and create jobs and promote economic � to recovery; 2) to assist those most impacted by the recession; 3} to provide investments needed to increase economic efficiency by spurring technology advances in science and health; 4 } to invest in transportation, environmental protection, and other infrastructure that p will provide long -term -economic .benefits; and, 5} 10 stabilize - state and local government budg ets in order to minimize and avoid reductions in essential, services and g � . counterproductive state and local tax increases. Generally, the statutory and regulatory provisions of the CDBC program also apply to the y . use of CDBC -R funds, which may be used for housing and community development. activities. CDBC -R funds have -a focused purpose in such activities as job creation and P promoting romoting economic recovery, - energy efficiency, and assisting those most impacted by the recession. Although the use of CDBC -R funds generally allows 'the same activities as annual CDBC funds, the primary purpose of the funds was appropriated to stimulate the economy and assist those most affected by the current recession. eDBG regulations allow for public services, lannin and administration, and capital improvements (other activities ). CDBG� p g R regulations allow that fifteen percent of the funds can be applied to public services and ten percent of the funds can be applied to planning and administration. The ro osed CDBG -R funded activities are described as follows, which allocates funding p p of approximately 12 percent to homeless and - homeless prevention sources, case job mans g ement- and and approximately 88 percent to a public infrastructure p ro ject. COMMUNITY RESOURCE CENTER Project: Homeless Prevention and Intervention services eDBG -R Funds: $7,857 Other Funds: $17,143 This -program, will assist individuals and - families who are homeless with the services to help get them out of th -eir homeless situation, and to provide at -risk homeless individuals a nd fa with the resources necessary -to prevent them from becoming homeless. The also basic employment workshops focused on empowering, educating, program p g ram and training the unemployed to f ind and maintain stable employment. Participants will receive intensive supportive services, including case management, housing assistance, and- bus vouchers.. City Council approved $5,125 of FY2009 -10 CDBG funds for this activity. NORTH COUNTY COMMUNITY SERVICES Project: North county Food Bank CDBG -R Funds: $2,524 Other Funds: $3,300 This program provides food to alleviate hunger in North ' County using volunteers and community resources.' Donations come from supermarket chains, local farmers, and food drives. All food and other items are sorted, stored, and prepared for distribution at. their San Marcos warehouse. Distribution is made weekly to two - thirds of the participating agencies, and monthly or bimonthly to the others. City Council approved $3,.300 of _ FY2009 -10 funds for this activity. CITY OF ENCINITAS, Project:. Melba Road Sidewalk improvements, - CDBG -R Funds: $94,92.7 Other Funds: $202,073 This project has been ,identified by residents as a concern for the safety of elementary and high schooi students using the existing asphalt sidewalk surfaces. Surface drainage is causing a deterioration of the asphalt surfaces, which will be replaced with concrete sidewalks, curb., gutter, and driveways. The project meets the intent of ARRA because the contract can be awarded within 120 days of receipt of funds and. stimulates the economy with job preservation and - public inf restructure improvements. city council- - approved .$197,073 of FY2009 -10 CDBG funds and $5,000 of Save Routes to Schools . € unds for this project..
