1. Francis E. MoJ'onnier did on the 27th daYof Febru , 1997, enter into an "Agreement to ImProve
` ~'Y
~ Water Facilities" with the San Dieguito Water District. The Agreement detailed the requirements for the
construction and installation of 2187 feet ofPVC water main within Seacrest Way, Sea View Court and
Pacific View Gourt in the City of Encinitas. The subject property was subsequently sold to Beck
ProperCies, Inc.
2. Said Agreement, including the plans and specifications for said improvements, is on file in the
Office of the Clerk of the Board of Directors.
3. Said improvements were completed by the current owner, Beck Properties, Inc., and accepted by
the San Dieguito Water District Board of Directors on the 24th day of February, 1999.
4. Subdivision Improvement Bond No. 1413355 from Developers Insurance Company in the amount
of $102,310.00 may be released at this time. The District will retain Certificate of Deposit Na
1007699515-000 from Wells Fargo Bank in the amount of $34,104.00 which shall be released at the end
of the one-year warranty period.
5. All requirements of said Agreement have hereby been satisfied except for warranty.
6. Neither acceptance of said improvements by the Board of Directors nor this Notice constitute a
waiver of any defects in the work of the construction or installation of said improvements.

SUBJECT: Consideration of Acceptance of Public Water Improvements and Authorization to
File a"Notice of Completion" for a 40-Lot Subdivision Developed by Beck
Properties, Inc., Located at the East End of Seacrest Way, APNs 256-430-1 to 28
and 256-431-1 to 12.
BACKGROITND: On February 27, 1997, the San Dieguito Water District entered into a"Lien
Covenant Re gardin g Real Pr o p e rty: I m p r o v e m e n t s R e q u i r e d as Con di tion on Final Approval of
Subdivision of Real Property" with Francis E. Mojonnier, owner of property located at the east end
of Seacrest Way. The properly was later sold to Beck Properties, Inc. The Covenant detailed the
requirements for the construction and installation of certain public water improvements.
ANALYSIS: The water improvements were installed in accordance with District approved plans
and specifications, under District inspection. District staff has no objections to filing the "Notice of
Completion." A 25-percent retention of security will be held for one year to cover warranty of •
improvements.
FISCAL AND STAFF IMPACT: Future expenses will be incurred for maintenance of the new
water improvements. Funds to cover the cost of said maintenance are collected through the sale of
water.
RECOMMENDATION: Accept Public Water Improvements and Authorize District Manager
to File a"Notice of Completion" for a 40-Lot Subdivision Developed by Beck Properties, Inc.,
Located at the East End of Seacrest Way, APNs 256-430=1 to 28 and 256-431-1 to 12.
