r, IN COMPLIANCE:
The Planning and Building Director of the City of Encinitas has determined that the parcel of real
property described below has been divided or has resulted from a division in compliance with the
Subdivision Map Act and with the provisions of the City of Encinitas Municipal Code. The parcel
described herein may be sold, leased, or financed without further compliance with the Subdivision
Map Act or any local ordinance enacted pursuant to the Act. No development is approved by this
certificate and future development of the parcel may require issuance of a permit or permits, or
other grant or grants of approval.
This project is a condominium conversion of a legal nonconforming structure. Section 30.16.010
of the City of Encinitas Municipal Code specifies a minimum lot size of 5,400 square feet and
minimum lot dimensions of 90 feet in depth and 60 feet in width for the subject R-8 (Residential 8)
zone. This Certificate of Compliance applies to one (1) parcel in compliance with the required
standards pertaining to minimum lot area and depth. This project is a common interest. subdivision
consisting of not more than two (2) residential units pursuant to Section 1351 of the California
Civil Code. Pursuant to Chapter 30.76 (Nonconformities) of the Municipal Code, specific
restrictions are placed on alterations, modifications or additions to nonconforming structures and
uses. Future property owners should contact the City of Encinitas to determine any potential
restrictions on alterations, modifications or additions to individual units. Development may be
proposed in compliance with all applicable standards of the subject R-8 zone.
