RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
COX ANNEXATION

the following resolution is adopted:
WHEREAS, pursuant to the District Reorganization Act of 1965 (Gov. Code,
S 56000 et seq.) preliminary proceedings were commenced 'by resolution of appli-
cation by this Board on December 16, 198P as Resolution No. SAN-2 , for annexation
to the Cardiff Sanitation District
(hereinafter referred to as the District)
of certain territory therein described, which description has been modified pur-
suant to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of application was pre-
sented to and. approved by the Local Agency Formation Commission of San Diego
County on April 6, 1981
and this District was designated as the conducting
I district and authorized by resolution to order said annexation without notice or
hearing and without an election pursuant to Government Code, Section 56261; NOW
THEREFORE
IT IS RESOLVED, ORDERED AND DETER}IINED, pursuant to Government Code Section
56310 et seq.:
(a) The manner in which and by whom preliminary proceedings were commenced
was by resolution of application by this Board as stated above.
(b) The territory to be annexed has been designated the
Cox Annexation
by the Local Agency Formation Commission,
and the exterior boundaries of such territory are as hereinafter described.
(c) The territory proposed to be annexed is uninhabited
, and will be
benefited by such annexation as described in Health and Safety Code Section 4830.

(d) The reasons for the proposed annexation as set forth in the
resolution of application referred to above are:
(1) The District is empowered to and is engaged in furnishing
sewage disposal facilities.
(2) The territory proposed to be annexed to said District is
proposed to be developed and used for residential and/or
commercial purposes and provision for sewage disposal faci1i'ties
for said territory is essential for such purposes.
(e) The terms and conditions of the proposed annexation are:
NONE
(f) All the owners of land within such territory have given their
written consent to such annexation, as provided in Government Code, Section
56261; and therefore, as approved and authorized by the Local Agency
- Formation Commission, this Board may adopt its resolution ordering the
annexation without notice and hearing and without an election, as provided
in Government Code, Section 56322.
(g) The Board finds, pursuant to Section 15119, Class 19(a), of the
State EIR Guidelines, that this annexation is not subject to the environ-
mental impact evaluation process because it is categorically exempt as an
annexation of property having an existing private structure developed to
the density allowed and where the extension of utility services will have
the capacity to serve only the existing facilities.

Your Board initiated proceedings for this annexation by adopting a Resolution
of Application for the Annexation of Territory to the Cardiff Sanitation
District on December 16, 1980 (SAN-2). The Local Agency Formation Commission
approved this proposed annexation and authorized the Board of Supervisors
(acting as the Board of Directors of the District) to complete the annexation
proceedings without notice and hearing and without an election on April 6,
1981 (DA 80-103).
On November 18, 1980 (SAN-1), your Board approved a Connection Agreement
betwp.en Sandra C. Cox and the Cardiff Sanitation District to allow her to
connect the single family dwel ling located on this parcel to the sewer system
of said District. The San Diego County Department of Public Health Services
determined that a potential public health problem existed at this site,
making this application exempt from the moratorium ordered by Ordinance No.
5494 (8/54-24-79). It is my
RECOMMENDATION: That your Board
1. Find, pursuant to Section 15119, Class 19, of the State EIR Guidelines,
that this annexation is not subject to the environmental impact evalu-
ation process because it is categorically exempt as annexation of an area
having an existing private structure developed to the density allowed and
where the extension of utility services will have the capacity to serve
only the existing facilities.

2. Adopt the enclosed Resolution Annexing Territory to the Cardiff Sanita-
tion District.
Discussion:
The petition for the annexation of subject property to the District was sign-
ed by one-hundred percent (100%) of the owners. The property for which an-
nexat ion is requested consists of 1.17 acre.. It is located west of Lone Jack
Road, near Regal Ridge Road. It is not contiguous to the existing sanitation
district boundary.
The subsurface sewage disposal system and leach lines serving the Cox.s
dwelling, are being destroyed due to landslides. The Department of Public
Health Services requests that this house be connected to the public sewer
system.
This property is shown on the San Diequito Community Plant in an area desig-
nated Estates (1 OU/AC) on said plan. The current zoning is R-R-0.5 (1
DUlAC). Division of this land is not possible.
Applications for annexation to the Cardiff Sanitation District are processed
only when the San Diego County Department of Public Health Services has de-
termined that a potent i al health hazard has been created by a fai 1 inq subsur-
face disposal system or your Board has determined that extreme and unusual
hardship exists.

Remarks: This action has no impact on the County General Fund Budget. The
cost of operation and maintenance of sanitary sewer wil I be paid
from sanitation district funds. The District is reimbursed from
annexation fee - $1,987.00; capacity fee - Sl,OOO.OO per [DU pIllS
$780.00 reimbursement fee; and sewer service charge - $84.00 per
year per EDU.

WHEREAS, the governing body of the
Cardiff Sanitation
Dis.trict
(hereinafter referred to as the District) filed with this Commission
a certified copy of a resolution of application for the annexation of
territory to said District adopted by the Board of Directors of said
District December 16, 198Q as Resolution No. 2 - Cardiff
pursuant to the District Reorganization Act of 1965 (Gov. Code
Section 56000 et seq.); and

WHEREAS, th~.executive officer of this Commission has filed his
report on said proposed annexation, which report has been considered
by this Commission, NOW THEREFORE
BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES
AND ORDERS, as provided in Government Code Section 56250 et seq.

1. The 'territory proposed to be annexed (hereinafter referred

(b) The nature of the proposed change of organization
and the na~es of all districts for which any such change of
organization is proposed are as follows:

for sewage disposal facilities for said territory is
~ssential for such purposes.
(i) It is hereby requested that proceedings be taken for
the 'annexation of territory as hereinabove proposed.
2. The Board finds, pursuant to Section 15101, Class 1 of the State
EIR Guidelines (California Environmental Quality Act of 1970), that this
annexation is not subject to the environmental impact evaluation process
because it is categorically exempt as a project consisting of a minor alter-
ation to an existing private structure and involving no expansion of use beyond
~hat previously existing.
3. The Clerk of the Board of Directors is hereby authorized and directed
to file a certified copy of this resolution with the Executive Officer of the
Local Agency Formation Commission of the County of Sim Diego.;"

On November 18! 1980 (SAN-I)! your Board approved a Connection Agreement
between Sandra C. Cox and the Cardiff Sanitation District to allow her to
connect the single family dwelling located on this parcel to the sewer system
of said District. The San Diego County Department of Public Health Services
determined that a potential public health problem existed at this site,
making this application exempt from the moratorium ordered by Ordinance No.
5494 (B/S 4-24-79). Mrs. Cox's application for annexation is enclosed
herewith. It is my

Discussion:
The enclosed petition for the annexation of subject property to the District
is signed by one-hundred percent (100%) of the owners. The property for
which annexation is requested consists of 1.17 acre. It is located west of
Lone Jack Road, near Regal Ridge Road. It is not contiguous to the existing
sanitation district boundary.
The subsurface sewage sewage disposal system and leach lines serving the
Cox's dwelling, are being destroyed due to landslides. The Department of
Public Health Services requests that this house be connected to the public
sewer system.
This property is shown on the San Diequito Community Plan, in an area desig-
nated Estates (1 DUlAC) on said plan. The current zoning is R-R-0.5 (1
DUlAC). Division of this land is not possible.
Applications for annexation to the Cardiff Sanitation District are processed
only when the San Diego County Department of Public Health Services has
determined that a potential health problem exists at an existing structure
and your Board has approved a Connection Agreement.

Remarks: This action has no impact on the County General Fund Budget. The
cost of operation and maintenance of sanitary sewer will be paid
from sanitation district funds. The District is reimbursed from
annexation fee - $1,987.00; capacity fee - $500.00 per EDU plus
$780.00 reimbursement fee; and sewer service charge - $60.00 per
year per EDU.

and assigns shall pay to the District through the Departl71Cnt of Sanitation
and Flood Control of the Colmty of San Diego on the first day of each calen-
dar month following the connection of said dwell ing to the sanitary seHer
of the District a monthly service charge of $ 5.00 or $ 60.00 per year
payable in advance. Said fee shall be paid pursuant to this Agreement unti 1
such time as the property upon \-Ihich said dwell ing is located is annexed to
the District.
7. The District shall have the pOt"er to increase the amount of the
~onthly service charge prescribed in Paragraph 6 from time to time in propor-
tion to any increased cost or expenses of operating the Dis trict.
8. The Ol-lner of said real property consentS to the commencement of
proceedings by the District to annex said property to the District. The
Owner agreeS that upon annexation of the above des cribed real property to
the District said property shall become subject to any and all regulations,
fees. taxes and assessments applicab Ie to the property wi thin the District.
The Owner further agrees to pay the fees [which depend on the acreage and
are $100.00 if the property being annexed 1.S five (5) acres or less J charged
by the Local Agency Formation Commission at the time they consider the
annexation of this property.
9. The District agrees that upon connection of said property to the
District's s ani tary sewer, the District shall accept the domesti c sCl"age from
such building discharged into its 5~.,'er ~ines, I..hich cbligation of the District
shall continue under the Agreement until such time as the above described real
property upon which such dwelling is located is annexed to the District, or
until this Agreement is terminated as hereinafter specified, whichever first
occurs.
10. This Agreement may be terminated by the Owner., her executors,
administrators. heirs, successors or assigns by giving to the District ninety
(90) days written notice of intention to terminate by serving such notice on
the Clerk of the Board of Directors of the District.
