AiN'NEXING TERRITORY TO WHICH OItNERS HAVE CONSENTED
PRAITHER ANNEXATION
On motion of Director Hamilton
the following resolution is adopted:

WHEREAS, pursuant to the District Reorganization Act of 1965 (Gov. Code,
S 56000 et seq.) preliminary proceedings were commenced by resolution of appli-
cation by this Board onSeptember 16, 1980as Resolution No. SAN 2 for annexation
to the Cardiff Sanitation District (hereinafter referred to as the District)
of certain territory therein described, which description has been modified pur-
suant to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of application was pre-
sented to and approved by the Local Agency Formation Commission of San Diego
County on April 6, 1981 , and this District was designated as the conducting
district and authorized by resolution to order said annexation without notice or
hearing and without an election pursuant to Government Code, Section 56261; NOW
THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to Government Code Section
56310 et seq.:
(a) The manner in which and by whom preliminary proceedings were commenced
was by resolution of application by this Board as stated above.
(b) The territory to be annexed has been designated the
Prather Annexation by the Local Agency Formation Commission,
and the exterior boundaries of such territory are as hereinafter described.
(c) The territory proposed to be annexed is uninhabited , and will be
benefited by such annexation as described in Health and Safety Code Section 4830.

(d) The reasons for the proposed annexation as set forth in the
resolution of application referred to above are:
(1) The District is empowered to and is engaged in furnishing
sewage disposal facilities.
(2) The territory proposed to be annexed to said District is
proposed to be developed and used for residential and /or
commercial purposes and provision for sewage disposal facilities
for said territory is essential for such purposes_
(e) The terms and conditions of the proposed annexation are:
NONE
(f) All the owners of land within such territory have given their
written consent to such annexation, as provided in Government Code, Section
56261; and therefore, as approved and authorized by the Local Agency
Formation Commission, this Board may adopt its resolution ordering the
annexation without notice and hearing and without an election, as provided
in Government Code, Section 56322.
(g) The Board finds, pursuant to Section 15119, Class 19(a), of the
State EIR Guidelines, that this annexation is not subject to the environ-
mental impact evaluation process because it is categorically exempt as an
annexation of property having an existing private structure developed to
the density allowed and; in part, as annexation of an individual small par-
cel of the minimum size.

56322, the following described unincorporated territory in the County of San Diego,
State of California, be and it hereby is annexed to and made a part of the Cardiff
Sanitation District
All that unincorporated territory in the County of San Diego, State
of California being a portion of Lot 18 of the Subdivision of Rancho
Las Encinitas, according to Map thereof No. 848, filed in the Office
of the County Recorder of said County and lying within the following
described boundary:
1. Beginning at the intersection of the center line of 12th Street,
if extended, with the center line of "J" Street as said Streets
are shown on Map No. 326 of the Colony of Olivenhain filed in the
office of the County Recorder of said County, July 8, 1885;
2. Thence North 14 °18'00" East parallel with and 40.00 feet westerly

APPROVING A PROPOSED ANNEXATION TO THE
CARDIFF SANITATION DISTRICT
"Prather Annexation"
On motion of Commissioner McClellan , seconded by Commissioner
Mahr , the following resolution is adopted:
WHEREAS, the governing body of the Cardiff Sanitation
(hereinafter referred to as the District ) filed with this Commission
a certified copy of a resolution of application for the annexation of
territory to said District adopted by the Board of Directors of said
District ,SeDtember 16, 1980 as Resolution No. 2 - Cardiff
pursuant to the District Reorganization Act of 1965 (Gov. Code
Section 56000 et seq.); and
WHEREAS, the executive officer of this Commission has filed his
report on said proposed annexation, which report has been considered
by this Commission, NOW THEREFORE
BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES
AND ORDERS, as provided in Government Code Section 56250 et seq.
as follows:
1. The territory proposed to be annexed (hereinafter referred
to as the Territory) is as described in Exhibit A attached hereto.
2. The description of the boundaries of the Territory is JIQJL-
definite and certain, but will be made so when modified to conform
to Exhibit B attached hereto.
3. The description of the boundaries of the Territory does
conform to lines of assessment and ownership.
4. All owners of land within the Territory have consented
in writing to the proposed annexation.
5. The District is a resident -voter district.
6. The Territory includes 1.70 acres and is _ un inhabited.
7. The change of organization does not constitute a minor
boundary change.
8. The Territory proposed to be annexed is hereby designated
the _ "Prather Annexation"
9• The Commission finds, pursuant to Section 15119(b) of.the
State EIR Guidelines, that this annexation is not subject to the
environmental impact evaluation process.
10. The Commission hereby approves the proposed annexation subject
to the proposed conditions, if any, as stated on Exhibit C
attached hereto and incorporated herein.
11. The Commission hereby designates the Cardiff Sanitation
District as the conducting authority and
authorizes the Board of Directors of said District to initiate
annexation proceedings in compliance with this resolution, without
notice and hearing and without an election.
12. The executive officer of this Commission is directed to
file and mail certified copies of this resolution as required by law.

WHEREAS, this Board of Directors has received a request from
Philip R. Prather
(Docunent No. 610302 ) that the
hereinafter described territory be annexed to the Spring Valley
Sanitation District (hereinafter referred to
as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate proceed-
ings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code Sections 5619S and 56140,
application is hereby made to the Local Agency Formation Commission
of the County of San Diego for a proposed change of organization as
follows:
(a) This proposal is made pursuant to the District
Reorganization Act of 1965 (§ 56000 et seq., Gov. Code).
(b) The nature of the proposed change of organization
and the names of all districts for which any such change of

On July 15, 1980 (SAN -1), your Board approved a Connection Agreement between
Philip Prather and the Cardiff Sanitation District to allow him to connect
one single family dwelling, located on this parcel, to the sewer system of
said District. The San Diego County Department of Public Health Services
determined that a public health problem existed at this site, making this
application exempt from the moratorium ordered by Ordinance No. 5494 (B /S
4- 24 -79). Mr. Prather's application for annexation is enclosed herewith. It
is my
RECOMMENDATION: That your Board
1. Find, pursuant to Section 15119, Class 19, of the State EIR Guidelines,
that this annexation is not subject to the environmental impact
evaluation process because it is categorically exempt as annexation of an

capacity to serve only the existing facilities.
2. Adopt the enclosed Resolution of Application for the Annexation of
Territory to the Cardiff Sanitation District

The enclosed petition for the annexation of subject property to the District
is signed by one - hundred percent (100 %) of the owners. The property for
which annexation is requested consists of 0.88 acre. It is located west of
Lone Jack Road, near Crystal Ridge Road, adjacent to the existing sanitation
district boundary.

The septic tank and leach field serving Mr. Prather's dwelling, were
destroyed when a portion of the lot was lost in a landslide. The house has
been vacated and cannot be reoccupied without creating a health hazard. The
Department of Public Health Services requests that this house be connected to
the public sewer system.
This property is shown on the San Diequito Community Plan, in an area desig-
nated Medium -Low Estates (2 DUA) on said plan. The current zoning is R -R -2
(2 DUA). Division of this land is not possible.
On November 13, 1979 (2 -SAN) (B /S 26), your Board acted to make available to
qualified applicants in the Cardiff and Solana Beach Sanitation Districts the
total additional capacity available in the San Elijo Treatment Facility. In
accordance with that action, flow data for Cardiff and Solana Beach
Sanitation Districts has been combined under the title of flow data for the
San Elijo Water Pollution Control Facility.
Data collected for the Reserve Treatment Capacity Report for the Ist Quarter
1980 shows the nominal capacity of the San Elijo Facility to be 2.7 mgd. The
committed average annual flow rate is 2.503 mgd from 11,302 EDU, leaving a
nominal reserve of 0.197 mgd (891 EDU). Since those figures were compiled,
guaranteed service in accordance with the Sewer Allocation Matrix (SAM) and
Sewer Capacity Commitment (SCC) has reduced the number of available EDU to
169 EDU, as of the close of business on August 19, 1980. This figure does
not take into account the demand for approved development (final maps) or
pipeline (TM /TPM in process) (346 EDU).
Applications for annexation to the Cardiff Sanitation District are processed
only when the San Diego County Department of Public Health Services has
determined that a potential health problem exists at an existing structure
and your Board has approved a Connection Agreement.

the Cardiff Sanitation District. On 15 July 1980, the Board of Directors of
said sanitation district approved this agreement which allows you to connect
to the District's sewer system while the annexation of said property is in
process.

AGREEiMEN T
CARDIFF Sanitation District, a sanitation district -in the
County of San Diego, hereinafter called the District, and PHILIP R. PRATHER
hereinafter called the Ouner, agree as follows:
1. The Owner represents that he is the Owner of the following
described real property in the County of San Diego, State of California:
A portion of Lot 18, Rancho Las Encinitas, Map No. 848
(Assessor's Parcel No. 264- 151 -10)
2. That said real property is located outside of the boundaries of the
district and adjacent to the Santa Fe Highlands Sewer Line.
3. That the Owner shall have the privilege of connecting the sewer
line from one single family dwelling located on said real
property to the District's sanitary sewers known as the Santa Fe Highlands
sewer line.
4. That the connection to the District's sanitary sewer shall be made
under the direction of the Department of Sanitation and Flood Control of the
County of San Diego, in accordance with the ordinances and regulations of the
County of San Diego and the District, and shall be made at such place on the
District's sanitary sewer and in such manner as the Director of Sanitation and
Flood Control of the County of San Diego shall specify. The cost of such
=,mection shall be paid by the Owner of said dwelling.
S. At the time of the execution of this Agreement the Owner shall pay
to the District the sum of $ 50.00 in addition to the normal District connection
fee of $ 95,00 for the privilege of connecting to the District's sewer.

6. The Owner, h i s executors, administrators, heirs, successors
a: d assigns shall pay to the District through the Department of Sanitation
and; :Hood Control of the County of San Diego on the first day of each calen-
da_ -:on_h following the connection of said dwelling to the sanitary sewer
o- the District a monthly service charge of $ 5,00; or $60 .00 per year
pa—fable in advance. Said fee shall be paid pursuant to this Agreement until
suc:i time as the property upon which said dwelling is located is annexed to
the District.
7. The District shall have the power to increase the amount of the
monthly service charge prescribed in Paragraph 6 from time to time in propor-
tion to any increased cost or expenses of operating the District.
8. The Owner of said real property consents to the commencement of
proceedings by the District to annex said property to the District. The
O,o.ner agrees that upon annexation of the above described real property to
the District said property shall become subject to any and all regulations,
fees, taxes and assessments applicable to the property within the District.
The Nner further agrees to pay the fees [which depend on the acreage and
are 3100.00if the property being annexed - 1s,Ji:ve "(5) acres or less] charged
by the Local Agency Formation Commission at the time they consider the
annexation of this property.
9. The District agrees that upon connection of said property to the
District's sanitary sewer, the District shall accept the domestic sewage from
sLzh building discharged into its sewer lines, which obligation of the District
shall continue under the Agreement until such time as the above described real
property upon which such dwelling is located is annexed to the District, or
until this Agreement is terminated as hereinafter specified, whichever first
ocLurs.
10. This Agreement may be terminated by the Owner, his executors,
admdnistrators, heirs, successors or assigns by giving to the District ninety
(90) days written notice of intention to terminate by serving such notice on
the Clerk of the Board of Directors of the District.
