the following resolution is adopted:
WHEREAS, pursuant to the District Reorganization Act of 1965 (Gov. Code,
S 56000 et seq.) preliminary proceedings were commenced 'by resolution of appli-
cation by this Board on September 15, 19~hs Resolution No. SAN-2 , for annexation
Cardiff Sanitation District
(hereinafter referred to as the District)
to the
of certain territory therein described, which description has been modified pur-
suant to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of application was pre-
sented to and approved by the Local Agency Formation Commission of San Diego
CoUnty on December 7, 198~ and this District was designated as the conducting
f district and authorized by resolution to order said annexation without notice or
hearing and without an election pursuant to Government Code, Section 56261; NOW
THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to Government Code Section
56310 et seq.:
(a) The manner in which and by whom preliminary proceedings were commenced
was by resolution of application by this Board as stated above.
(b) The territory to be annexed has been designated the Perkins
Annexation
by the Local Agency Formation Commission,
and the exterior boundaries of such territory are as hereinafter described.
(c) The territory proposed to be annexed is uninhabited
, and will be
benefited by such annexation as described in Health and Safety Code Section 4830.

(d) The reasons for the proposed annexation as set forth in the
resolution of application referred to above are:
1. The District is empowered to and is engaged in furnishing
sewage disposal facilities.
2. The territory proposed to be annexed to said District is
occupied with an existing dweiling which has a failing sub-
surface sewage disfXJsal system. Connection to a public sewer
system is requested in order to prevent ~health hazard.
(e) The terms and conditions of the proposed annexation are:
NONE
(f) All the owners of land within such territory have given their
written consent to such annexation, as provided in Government Code,
Section 56261; and therefore, as approved and authorized by the Local
Agency Formation Commission, this Board may adopt its resolution ordering
the annexation without notice and hearing and without an election, as
provided in Government Code, Section 56322.
(g) The Board finds, pursuant to Section 15119, Class 19(a), of the
State EIR Guidelines, that this annexation is not subject to the environ-
mental impact evaluation process because it is categorically exempt as an
annexation of property containing an existing private structure developed
to the density allowed by current zoning and where the existing sewer
line will not be extended.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government Code
Section 56322, the following described unincorporated territory in the County
of San Diego, State of California, be and it hereby is annexed to and made
a part of the
Cardiff Sanitation District

SUMMARY OF REOUEST / REPORT:
Mrs. Perkins petitioned for annexation of this parcel to the Cardiff Sanitation
District. Her property is improved with an existing dwelling have a failing sub-
surface sewage disposal system. The Director of Public Health Services requested
permission for this property to be connected to the public sewer system. On
August 18, 1981 your Board approved a Temporary Connection Agreement.
This parcel is zoned A-4-(1) (1 DUA). The Community Plan designation is Intensive
Agriculture. This property cannot be divided.
On December 7, 1981, the Local Agency Formation Commission approved this annexation
and authorized your Board to complete the annexation proceedings.

On motion of Commissioner Hamilton , seconded by Commissioner
Lake , the following resolution is adopted:
WHEREAS, the governing body of the Cardiff Sanitation District
(hereinafter referred to as the District) filed wi~h this Commission
a certified copy of a resolution of application for the annexation of
territory to said District adopted'by the Board of Directors of said
District July 9, 1981 , as Resolution No. 2
pursuant to the District Reorganization Act of 1965 (Gov. Code
Section 56000 et seq.); and
,
WHEREAS, the executive officer of this Commission has filed his
report on said proposed annexation, which repor~ has been considered
by this Commission, NOW THEREFORE
BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES
AND ORDERS, as provided in Government Code Section 56250 et seq.
as follows:
1. The territory proposed to be annexed (hereinafter referred to
as the Territory) is as described in the resolution of application on
file with the Local Agency Formation Commission.
2. The description of the boundaries of the Territory as described
in Exhibit A attached hereto is definite and certain.
3. The description of the boundaries of the Territory does
conform to lines of assessment and ownership.
4. All owners of land within the Territory have consented
in writing to the proposed annexation.
5. The District is a resident-voter district.
6. The Terri tory includes .94 - acres and is un
inhabited.
7. The change of organization does --- constitute a minor
boundary change.
8. The Terr~ry proposed to be annexe~s hereby designated
the "Perkins Annexation"
9. Certify that the determination by the County that this
annexation is exempted by Section 15119(a) of the State EIR
Guidelines has been:reviewed and considered.
10. The Commission hereby approves the proposed a~nexation subject
to the proposed conditions, if any, as stated on Exhibit B
attached hereto and incorporated herein.

It is directed to the Local Agency Formation Commission (LAFCO) for
their consideration and reco~menddtions. In a few h2eks, you will
receive a letter from them (LAFCQ) stating the elate on vlhich your pro-
posal will be heard by the LAFCO Commission. Your $100.00 LAFCO fee
was paid at the time you requested a Connection Agreement. It is being
held in trust for LAFCO and will be transferred tr them at their re-
quest.

Eckert the following resolution is adopted:
WHEREAS, this Board of Directors has received a request from
Elsie E. Perkins
(Document ~o. 627399 ) that the
hereinafter described territory be annexed to the Cardiff
Sanitation District (hereinafter referred to
as the Sanitation District); and
h~REAS, this Board of Directors desires to initiate proceed-
ings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code Sections 56195 and 56140,
application is hereby made to the Local Agency Formation Conunission
of the County of San Diego for a proposed change of organization as
follows:
(a) This proposal is made pursuant to the District
Reorganizatio~ Act of 1965 (9 56000 et seq., Gov. Code).
(b) The nature of the proposed change of organization
and the names of all districts for which any such change of
organization is proposed are as follows:
The annexation of the hereinafter described
territory to the Sanitation District.
(c) The names of all other affected counties, cities
and districts are:
None
Cd) A description of the exterior boundaries of the
territory proposed to be annexed to the Sanitation
District is described in Exhibit A hereto attached.

(h) The reasons for this proposal are as follows:
(1) The Sanitation District is empowered to and
is engaged in furnishing sewage disposal facilities.
(2) The territory proposed to be annexed to said
District is proposed to be developed and used for
residential and/or commercial purposes and provision
for sewage disposal facilities for said territory is
essential for such purposes.
(i) It is hereby requested that proceedings be taken for
the annexation of territory as hereinabove proposed.
2. The Board finds, pursuant to Section 15101, Class 1 of the State
EIR Guidelines (California Environmental Quality Act of 1970), that this
annexation is not subject to the environmental impact evaluation process
because it is categorically exempt as a project consisting of a minor alter-
ation to an existing private structure and involving no expansion of use beyond
that previously -existing.
3. The Clerk of the Board of Directors is hereby authorized and directed
to file a certified copy of this resolution with the Executive Officer of the
Local Agency Formation Commission of the County of San Diego.

SUMMARY OF REQUEST / REPORT:
Mrs. Perkins, owner of this 0.85 acre parcel, petitioned for annexation to the Cardiff
Sanitation District. The property is improved wjth an existing dwelling having a fail-
ing subsurface sewage disposal system. The Director of Public Health Services has re-
quested permission for this property to be connected to the public sewer system. On
August 18, 1981 your Board approved a Temporary Connection Agreement.
This parcel is zoned A-4-(1) (1 DUA). The Community Plan designation is Intensive
Agriculture. This property cannot be divided.

CARDIFF Sanitation District, a sanitation district in the
County of San Diego, hereinafter called the District, and Elsie E. Perkins
hereinafter called the Owner, agree as follmo/s:
1. The Owner represents that she is the Owner of the following
described real property in the County of San Diego, State of California:
Lot 2, Block A, Palomares Heights. Map No. 2114
(Assessor's Parcel No. 262-011-02)
2. That said real property is located outsi4e of the boundaries of the
district and adjacent to the Lake Drive et al'sewer line.
3. That the Owner shall have the privilege of connecting the se\o/er
line from one single fa'TIily dwelling located on said real
property to the District's sanitary sewers kno\m as the Lake Drive sewers.
4. That the connection to the District's sanitary sewer shall be made
under the direction of the Department of Public Works of the
COWlty of San Diego, in accordance \.;ith the ordinances and regulations of the
County of San Diego and the District, and shall be made at such place on the
District's sanitary sewer and in such nanner as the Director of
. Public Works of the County of San Diego shall specify. The cost of such
connection shall be paid by the O"~er of said dwelling.
5. At the time of the execution of this Agreement the O\iIler shall pay
to the District the sum of $50.00 in addition to the normal District connection
fee of $1000.00 for the privilege of connecting to the District's sewer.

and assigns shall pay to the District through the Department of
. Public Works of the County of San Diego on the first day of each calen-
dar month follOl-ring the connection of said dwelling to the sanitary se\.,er
of the District a monthly service charge of $ 7.00 or $ 84.00 per year
payable in advance. Said fee shall be paid pursuant to this Agreement until
such time as the property upon Hhich said dwelling is located is annexed to
the District.
7. The District shall have the pO\'ler to increase the amount of the
monthly service charge prescribed in Paragraph 6 from time to time in propor-
tion to any increased cost or expenses of operating the District.
8. The Owner of said real property consents to the commencement of
proceedings by the District to annex said property to the District. The
O\-rner agrees that upon annexation of the above described real property to

the District said property shall become subject to any and all regulations,
fees, taxes and assessments applicable to the property within the District.
The Owner further agrees to pay the fees ~vhich depend on the acreage and
are $100.00 if the property being annexed is five (5) acres or less] charged
by the Local Agency Formation Commission at the time they consider the
. annexation of this property.
9. The District agrees that upon connection of said property to the
District's sanitary se\ver, the District shall accept the domestic sewage from
such building discharged into its seHer lines, Hhich obligation of the District
shall continue under the Agreement until such time as the above described real
. property' upon whi'ch such dwelling is located is annexed to the District, or
until this Agreement is terminated as hereinafter specified, whichever first
occurs.
10. This Agreement may be terminated by the O\-rner.. her executors,
administrators, heirs, successors or assigns by giving to the District ninety
(90) days written notice of intention to terminate by serving such notice on
the Clerk of the Board of Directors of the District.

11. This Agreement may be terminated by the District by giving ninety
(90) days \Hitten notice of intention to terminate to the Owner.. her
executors, administrators, heirs, successors or assigns, or to the occupants
of the aforesaid dwelling.
12. This Agreement is entered into pursuant to authority granted to
the District in the Health and Safety Code, Section 4742.1, and the parties
agree that in no event shall this Agreement continue in force for a period of
more than fifty (SO) years from the date of its execution.
13. This Agreement shall take effect \~hen executed by the parties.
