plan could be developed.
Ms. Brown reviewed the housing needs in Encinitas and the CHAS
priorities.
Consultant Roland Canfield reviewed the housing programs that would
be available to the Ci~y of Enc!nitoa ovor tho next five years.

On January 26, 1994, the City Council established the Housing Authority. The Board has
adopted bylaws~ a seal, personnel policies and a code of ethics. At. the May 4, 1994,
workshop the Board reviewed the City's housing goals and needs and considered some
housing programs. The Board directed staff to return with further Information on housing
programs to be discussed for consideration In adopting a Five Year Program Plan.

Staff Is presenting descriptions of programs which could be used to accomplish the
proposed Five Year Program Plan. The programs provide various ways that the ~Iouslng
Authority can Implement the work plan such as purchasing rental units or homes for
purchase. DeciSions on whether to purchase units or build units could vary within the five
year time period as the market changes.
If there are any programs which would be totally unacceptable to the Board, those
programs would not b,e considerad as a possible option for plan Implementation.

For the acquisition of units the EHA would ccmplle with the assistance of a realtor a
package of projects for the amount of the anticipated bond Issue (for example,. $8
mllllon),lssuo the bonds, and purchase the properties. cesa allocated funds would pay
for all the Issuance costs and HUe/FHA provides the credit enhancement through
mortgage Insurance. At least 20% of the package of projects must be low Income but
EHA can determine In which projects of the package and to what extent low Income
tenants will occupy tho units.
The N'OFA (Notice of Funding Availability) for Section 8 should be Issued It, early June.
Applications are due wlthl" a month. In the meantime, the EHA must negotiate with the
County and HUe over the present 58 certificates which are part of the County /HUD
contract but are being used b\l Enclnltas' residents.

The annual.HO~E grant can be used to support any of the proposed programs such as
rehabilitation or new construction,

The plan will produce 208 Section 8 certificates for families and elderly, 160 units for
elderly, 210 units for familleG,end 11 units for home ownership. Of these units 135 new
construction units would meet the Housing Element goal, In addition 120 homeless
persons will be provld6d transitional housing,
The cost of the plan Is approximately $900,000 from COBG to produce $18 million In
bonds, The federal government would provide funding for the other programs. The EHA
would obtain a $500,000 tax exempt bank note for home ownership program (203k).
EHA would generate $19 million in bonds and notes and approximately $13 millloni~in.
revenue for units and certificates from federal government programs. Staff needed .to
administer programs or manage units would be dependent on the program and the
revenue generated. Staffing could be contracted from the City or privately and will be
funded through grants and projects.

Due to the long City Council agenda preceding this meeting, staff recommends that
Council receive the materials, address any Irnmediate questions, and continue the agenda
I~em to a special meeting at which time the Board could consider adoption of the Five
Year Plan and authorizing staff to implement Plan.

PROGRAM OPTIONS FOR HOUSING GOALS

GOAL: RENTAL HOUSING FOR FAMILIES
I. Section 8.. rental assistance funded by Hue
.em:. . City has control over the number of certificates Issued within. the City. For
the past 4-5 years there have ,only been 44-58 certlfloates In the City. If the City
administers the program, HUe can directly give certificates to the Houslnu
Authority. Enelnltas' residents don't have to walt five years to obtain a certificates
as they are not co,npetlng with residents In a large Jurisdiction like the County for
a place ~n the waiting list.

Hue provides funding for program administration. If adr,,'nlstered efficiently, EHA
can build a reserve fund which can be used for other housing programs.
Con~ Housing Authoi'lty hires staff which Is funded with the program administration
funds to administer program.
II. Bonds (Attachment A for types)
A. Acquisition of existing units.
1. Lease back program: (a) EHA buys units, sells to profit or nonprofit
owner with restrictions, EHA leases back from the owner: or (b) EHA leases
from an owner without prior purchase.
2. 501 C 3 program: EHA Issues bonds and lends the funds to a nonprofit
developer who.. owns and operates the project. This can be a private
nonprofit or the housing authority can set up one of two kinds of non profits
which EHA controls.
(a) At~ms Length Nonprofit- separate Board with a housing authority
representative
(b) . ~Iter Ego Nonprofit- EHA appoints board.
The advantage of the EHA setting up a nonprofit Is that administrative costs
(such as salaries) do not have to come from project rents allowing rents to
be lower. Administrative costs can be spread across a variety of programs
such as Section 8.
Also the EHA can control the sites and Income levels of tenants.
3. EHA acquires and owns units. At least 20% of l'JI units owned must be
for low Income. For example. one project In 3n expensive area could be all
high income supporting more low rent units In another part of Clt').

nonprofit applies to HUe for all the funding necessary.

normally has to apply several times before application is approved.

I. EHA buys emergency shelters or transitional housing with Stewart Me Kinney Act
(homeless funds from HUD) or with tax exempt borrowing and contracts with nonprofit
homeless service provider to manage.
