Districi of .67 Acres Located at 441 Cole Ranch Road - Uanny Way AnneYation (Assessor's
P'arcel No. 265-025-27).
Br,CKGROiJP1D: Mr. Danny 'JVay is petitioning for aiinexation of .67 acres to the Cardiff
Sanitation District. The applicant has a failing septic system and vvishes to connect to the oublic
sewer. The applicant plans ;o extend the sewer in Cole Rar:ch Road approximately I20' ~to his
property. 7`he approximate cosc of the sewer project is $6,000 and wilt be paid solely by the
~ appiicant.
On October 25, 2000, thz Cardiff Sanitation District Board reviewed the prr.ponent's request and
adopted CSD Resolut:on No. 2000-16, approving an annexation applicat;on to the District. The
proposal was subsequently ieviewed and appraved by the Local Agency Formation Cummission
on February 5, 2001.
ANALYSIS: The proposed annexation is in conformance with t'he Cardiff San:tation District
Board's policy fe.r annexations c,f single-fam:!v residences on legal-siZe tots, canforms m-ith the
currenf zoning, and is within the District's sphere of influence.

ANPIEXING TEItRi'I'QRY TO yVHICH OWNERS HAVE CONSENTED

WHEREAS, pursuant to the Cortese-Knox Loc:al Governrnent Reorganization Act of
1985 (Govt. Code, Section 5600 et seq.) preliminary proceedings were commenced by resolution
of application by this Board on OctQber 25, 2000, as Resolution No. 2000-16, for annexation to
the Cardiff Sanitation Distriet (thereafier referred to as the District) of certain territory therein
described, which description has !ePn n:^difie~ purs»?nr to the directions of the L.ocal Agenc}•
Formation Commission; and
WHEREAS, ihe annexation proposed by said resolution of application was presented to
and agproved by the Local Agency Formation Commission of San Diego County an Februar}• -41,
2001 and this DisVict was designated as the conducting DJistrict and authorized b} resolutiort of
order saad annexaxion w-ithout noeice or hearing and without an election pursuant to Gvvernment
~ Code, Section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to
Governrnent Code Section 57025 et seq.;
a. The manner in which and by whom preliminary proceedings were commer:cea
was hy resolutjon of application by this Board as stated above.
b. The territory to be annexed has been designated DA 00-27 by the I:Mal Agency
Formation Commission, and :he extecior boundaries af such territory are as
hereinafter described.
c. The temtory nro,eosed to be annexed is uninhabited and will be benefited by such
annexation as described in Health and Safety Code Section 4$30.
d. The reasons for the proFosed annexation as set foreh in the res.olution of
application referred to above are:
1. The District is empowe*ed to and ',s engaged in furnishing sewage
di:sposaj facilities.
2. 1'he te:-ntory proposed to be annexed to sa:d District is deveioped and/or I
proposed to be developed and used for residential aind/or commercial
gurposes and provision for sewage disposal facilities for said ierritory is
essentiai for such purposes.

e. TYie terms and conditions of the praposed annexation are: P,3yment of State
Board of Equa]ization fdes.
~ f. All the owners of land within such territory have given theis writterz curisent :o
such anr~exation, as provided in Government Code, Sectian 56837; and uherefo►e,
as apprnved aad authorize-i by the Local Agency Formation Cornmission, this
Board may adopt its resolLtaon o•rdering the annexation without nosice and
hearing and wifhout an election, as provided in Government Ccxie, Section
57002.
g. The regular Coi.inty assessment role will be utilized and the affected temtory wnll
not be taxed for existing bonded indebtedness.
IT IS FURTHER RESOLVED AND ORDERED that pursuant ta Govemment Code
Section 57002, the foliowing described incorporated territory in the City of Encinir-W, State of
California, be and i: hereby is annexed to and made a part of the Cardiff Sanitation District.
